Hi Christine and Paul,

I agree totally with what Alan and Sheila are saying , you would'nt allow some one to encroach onto your boundary in the UK so logic says why would it be any different in Spain ? Check with your lawyer.

When we bought in Feb 06 we asked Taray where the aircon units were to go as the concealed roof space was not obvious when we looked at the showhouse. Antonio, who is still at the site office , told us that that is what this area was designed for.  He told us at the time that the norm ( cheapest option)  was one per main living /sleeping room  which would account for the 4 units. Taray are well established builders and I find it hard to believe that they would not provide sufficient space to accomodate up to 8 units in this open area knowing this. Have you checked that  the fitter your neighbour used has not just been a bit careless when measuring up. These units are fairly standard sizes and 8 should fit in, all be it snugly. I also seem to remember being told that aircon units as well as satellite dishes were not going to be allowed to be fitted to the visible external walls of any property, but obviously check this with Taray as things may have changed since we bought.

Hi

That doesnt sound right does it? Hope you are able to get it sorted. That would naff me off i think.

We have decided to give it a go without air-con units and just have fans. I lived in Dubai for a bit and the air-con made me feel ill all the time and dried my skin out terribly blah blah moan moan  so we will have to adapt with fans and see how we go. We might melt!!

Hi Shiela and Alan. Did you know in your signature section your picture just shows up as a box with a red cross in it?

Hope you are enjoying the sunshine, im just enjoying a peppermint tea and laughing because the fence panels have blown down. Is food cheaper out there? . 3 courgettes just cost me £2... blimmin henry, no wonder some of my student friends live on 12p noodles and cuppa soups, its getting so expensive!!

Hi Sheila andn Alan

To answer your question, why a quad would need 4 air con units. We were advised by our air con fitter to have 4 seperate external units as if one part of the unit malfunction and you need to replace it you loose the whole unit which runs 2 internal units and are more expensive to replace than a single unit. Hope this makes sense. Also double units are a lot deeper and  when fitted would have  covered hlf our bathroom window,

Have you ordered air con units? Would be interested in any info you have. We are obviously concerened now about the amount of space as we hadn't realised until today that the gaps in the roof above the kitchen/ utility are shared with the property behind & as we are waiting fro the land registry before completing our space may have been taken up by our neighbours. Will have to get our agents to have a look for us

hope u manage to sign up and everything goes ok  ours is supposed to be ready 1st march  but  told dont book flights yet waiting for confirmation from parador, noticed from the site that u live in bradford is that west yorkshire dont know if their are any more if so we only live down ther road from u in huddersfield so we will be near neighbours home and abroad

Yes it is Bradford, West Yorkshire. We actually live in a village called Baildon, don't know if you have heard of it or not? Looks like another day is going by without news on the Land Registry. Have you heard anything yet?

Yes we have ordered air con units. We chose Panasonic units with an inverter, which we were told would save us 30% on our fuel bills. Panasonic also apparently have a 5 year guarentee where some only have 3 years. If there is anything else we can hep you with just ask.

Hi All

We've had an email from our solicitor today to say that the directors of Taray have been to the land registry office to try & speed things up & have been told that everything should be in order within the next few days!!!!!!!!!!!!!!!!!!!!

Here's hoping.

I've had a bottle of champagne in the fridge since early January waiting for this news.At this rate it will either be vintage or have gone off by the time we crack it open. We are getting really really impatient now!!

Thanks for the info on the air con units Christine & Paul. Somebody else told us inverter units were better. Can you let us know who you got a quote from?

First of all apologies, Paul tells me were getting Mitsubishi air con units, with inverter of course. All this land registry business is very stressful, especially as were going out next Saturday for 12 days and want to be able to take delivery of our furniture etc. Plus it is our only time off work till May.

The person we are having to fit our air con was recomended by someone living out in Spain and say he is very reliable especially if it malfunctions. His name is Tom Bull and his e-mail address is heatcoolsol@hotmail.com. Obviously we hav'nt tried him yet so don't know personally what his work is like, but he comes highly recommended.

What number is your property ? Is it a quarter villa or a apartment ?

Thanks for the positive land registry news, fingers and toes crossed it will arrive in time for us going out there and also for all you other guys waiting to sign your title deeds

Thanks for the info re the air con - it is a bit of a minefield so we will email Tom Bull, all the costs appear to be thereabouts the same - we are having one air con unit fitted courtesy of our agents as part of the deal so not sure what they will be fitting as they are rather vague (I think we can rest assured it won't be top of the range, but heyho we won't kick a gift horse in the mouth!!)

We are No 21, Manzana 3 , Quad- or nIcky no mates as noone appears to be buying outside the walkway, but it was either this plot or waiting until December 2007. Just outside from where you are.If there is anyone on the outside would love to hear from you!!!!

Surely this land registry must go through this week. Our solicitor did sound more positive in the last email we had, Taray must be getting really fed up with the delays as they obviously want to get their cash in for the banks to continue funding.We are going out again on 6th April, but will try & get out before if we can complete, unfortunately Sue is very busy at work so it is not that easy to keep swapping holidays.

We'll keep everything crossed for you that it all happens before next Saturday!!!!!! We are going out again over the May day bank holiday

We are over in Spain at the moment till the 23rd, we were supposed to sign over tomorrow, but still their is no news, just bank said don´t get our hopes up. Hacienda San Cayetano looks great though, it´s nice and sunny here this morning even better. Will let everyone know if we hear anything about land registry. Here´s hoping.

Hi everyone,

We are confused. Everybody seems to be getting really excited about this land registry document but surely this is only a step towards the issue of the LFO ?  We understand that this document ( "Escritura de Declaración de Obra Nueva y División Horizontal" )  gives the actual property legal standing. Our lawyer tells us that it has been granted and that it should be recorded within the next few days. The document that gives YOU as the owner actual legal title toYOUR property is the LFO.

We have been over this point before, so without sounding pessimistic how does this land registry document help us complete ?  The LFO has not been applied for yet and no one is clear when this will happen?

We are sure the LFO is issued upon the completion of all contracted services ( including the pool ) This will not happen until the end of all the building work.

Licence of First Occupation and Completion

The fact of having the purchase deeds signed  before a Notary in Spain means that your house “has been born” to the “legal world”. It is necessary a previous or simultaneous title which is the  “New work declaration deed” over the land. The Notary deed will allow you  to transmit the house. That is in the civil  and registry level.

The developer must also fulfill some requirements before the Public Administration ( i.e.- before the Local Council: planning obligations, reparation duties…) therefore, the Local Council won´t proceed to the granting of the First Occupation License (Licencia de Primera Ocupación) till these requirements are met.

The lack of FOL can impede the owner to have the power supplies connected : water, electricity, telephone, gas… it can even imply an impediment to have the house as registered domicile in the Local Council “ Padrón” registry.

The proper definition of the FOL is of a  license by which  it is checked that what it has been built  is adjusted to the Project. The FOL verifies if the building can be assigned to its legal use, because it is located in a proper  planning zone and it meets the basic safety and health conditions, it also confirm that  the builder has fulfilled his commitments on urbanisation of the surrounding land.

Regarding FOL and completion, Consumers specialists state:

1.- The seller who signs the public deeds of purchase without FOL ( First Occupation License) is in breach of contract even if the house has been physically handed over, because the ownership rights that he is trasmitting are not valid for the use of the house till the FOL is granted.

 2.- The buyer can be opossed to the signing of the deeds till the FOL is granted if the completion date was fixed for anytime after the end of the work, and the seller cannot cancel the contract due to this negative of the buyer until he fulfills his contractual obligations ( by obtaining the FOL).

 3.- The buyer can cancel the contract ( even after the signing of the deeds), with full devolution of amounts, interests and compensation of damages if after the completion date, either  the deeds having been signed or not, the building does not have the FOL.

4.- If the buyer decides not to cancel the contract, he must not occupy the house, even when having being formally handed over, because that would involve an administative infringement and because he can be deprived of its use by the competent Administration.

We have been on the phone to the bank in spain this morning asking about wheter we would be allowed a mortgage without the lFO. Their reply was yes (this was the bank manager) but first they would have to check all insurances were in place and that everyone was covered if it all went wrong as they would have the most to lose. Im not saying we would or wouldnt complete without this license but there are obvioulsy options, insurances that can be put in place to cover yourselfs if you needed a mortgage to complete. we are concerned that like you our phase will also be delayed by 3-4months.

Hi Kenny,

 

My understanding is that you can complete with the land registry deeds ( a bank will not issue a mortgage without this) but the LFO comes later - that is when we will come off builders electric etc.  THe LFO is not issued until the site ( or part of it) is fully ready, but it's the deeds that you need for the mortgage etc.

 

I could be wrong though!

Hi All

I think tonight I have come home & hit an all time low, so pleeeasssse somebody out there reassure me that we are doing the right thing buying on San Cayetano.

We have had an email from the solcitor today (after she has told us last Friday that the land registry would be in place by last Friday/ Monday this week at latest) to say that this may now happen this Friday or next Tuesday (as it is a bank holiday in Spain next Monday). Ken & Elaine, you are saying that your solicitor has said that the horizontal divisions have been done so this means that the documentation should be in place. Our solicitor is saying it isn't!

The land registry was applied for on 27th November & this is now over 15 weeks ago - our Uk Agent says this is usually sanctioned 4 - 6 weeks after appllication. Medsea, our Spanish agents told us 2 weeks ago that the registration would be completed in 7 days

We had a letter from Taray dated 14th December saying that the property was ready for completion & to contact our solicitor re signing of the title deeds - this was now 13 weeks ago.

Time just seems to march on & nothing is happening, our property has been ready since last October

We are getting really really frustrated - we cancelled flights at the end of February & it is starting to look like we won't complete in time for our Easter flights.

Both the solicitors & the agents reassure us that it is fine to sign without the LFO as Taray have mains electricity & water on this site & that the LFO will be applied for on the first phase once the land registry has gone through

Any comments would be very reassuring
