Landmark ruling forces Spanish bank to refund deposit

A landmark ruling may have been made by a provincial court in Cantabria, northern Spain, this week when it found in favour of a buyer who paid a deposit on a property in Arce that was never built.



The purchaser was told that he had the legal right to demand a full refund from the bank, Caja Cantabria, that guaranteed the construction.



The bank was reminded of its responsibility under Spanish property law 57/1968 "to protect the funds paid by the buyer into a special account and ensure they are used solely for the purpose of building the property" and then promptly held to account for failing in its duty.



"This is an encouraging development for those affected in the Cantabria region, but it is too early to say whether it creates any kind of legal precedent for people in other parts of Spain" said the Spanish Embassy. 



Charles Svoboda, vice president of the Valencian action group Abusos Urbanisticos - No (AUN) said: "while this is an improvement, and it does make me hopeful, it's important to remember that half of the Spanish banks are in financial trouble and many of the developers have gone out of business or simply disappeared - so where is this money going to come from to pay people back?"

I think the key point in that article is about the banks already being in trouble and where is the money going to come from. In my cynical opinion this is why i do not think the authorities will sanction a mass contrywide refunding of monies because the ruling body knows the impact it would have on the country if hundreds of  thousands of euros(possibly millions) were to be refunded to there rightfull owners when Spain is already skint.

Just my humble uneducated cynical opinion.

Trouble with this news  Auntie Linda is  it is not really news ! I have been banging on about this being the way forward for years . 

Folk preferred to listen to Tony and SARC with their false hope and  blind faith in SJ/HdT coming good and  doing the "right thing " building houses ,coming out of admin, getting finance ,  swapping properties  !! yada yada yada !!!!

 For any chance of success in this type of  action a joint litigation should  have been  started a long long time ago for any chance of a result and a quick settlement  people should be at the end stages of this action by now . If not it is probably too late .

I too really  wish that everyone gets their money back but I doubt it .

All I can say is  " Thanks Tony  "  you  have done very well in helping SJ/HdT . If your  brilliant  organisational skills  and resources  had been put into an action against the bank instead of  backing SJ/HdT most   could  be in a quite different position right now .Cheers Tiger ?????????

TONE HAS BEEN BANGING ON ABOUT THIS MESS THAT STARTED 2???? YEARS AGO

I DON'T KNOW WHERE HE GETS HIS FIGURES FROM? PROBABLY THE SAME PLACE AS ALL THE REST OF HIS INFO, ALMUDENA.

WE INVESTED BACK IN NOVEMBER '05 AND A LOT OF PEOPLE WERE INVOLVED BEFORE US, SO FOR SOME IT'S NOW GOING ON 6-7 YEARS WITH NO END IN SIGHT.

AND WITH ELDERLY PEOPLE WHO INVESTED PENSION/INVESTMENT MONEY, FOR RETIREMENT TO A SUNNY CLIMB, NO AMOUNT OF COMPENSATION CAN MAKE UP FOR ALL THESE YEARS LOST.

YOU SHOULD TRULY BE ASHAMED OF YOURSELF TONE, I HOPE YOU SLEEP WELL.

Anyone who is brave enough to take real legal action  will win in the end !!!!!! Good  Luck . As  you know  I am out  of this fiasco.full deposit  paid back  plus interest , plus legal costs.Didn't cost me much at all .

Everything is a joke if it relates to JA, only thing you can do is have a good laugh at her!

Remember, she is one of a few who have had their money back.
Can't blame her for laughing.

Yes & JA had a bank gaurantee and did not mention it for quite some time, that is why & how she got her money back. No other reason.

I may be wrong on this, but I thought I read some time ago, long before I joined the forum, that she had a BG on one property but not the other.
Perhaps she will confirm?
