Shutters

Does anyone have any idea where to buy the brown blinds that are allowed on Phase 2?  I dont particuarly like them but  I presume they are the only ones allowed.

 

 

Some townhouses and apartments on other phases have cream sail blinds similar to the clubhouse and I know Bryansblinds do them.They can also then fit blinds for each side that work on some kind of roller handle or I think you can have electric ones.They're quite expensive but they may be more to your liking than the brown ones.

The cream sail blinds that you are talking about, are these the ones that go on the top of the pergolas like they have in the club house? If so, are these allowed on phase 2? We would like to have these as we seen some on a penthouse, but heard that they had put them up illegally!! And we should not put them up without permission.

They are the type I'm talking about.They are so attractive and I had my heart set on them.We had ours measured and priced up but like you were unsure if they were allowed so decided not to go ahead until we found out especially as they were expensive.As far as I can recall it was around €600 for the sail and then if were to add a blind to the front and sides it was coming to €1200 to €1300.Tried to find out last year if they were allowed but couldn't get a definitive answer.What I did hear was that people had to take them down because they were blocking the sunlight into other people's terraces but that if you weren't it was ok.Have no idea how true this is and am certainly open to correction.I have seen them in Leroy Merlin too but whether you can get the right size is another matter.

All owners are entitled to and should have a copy of the Bye Laws pertaining to Roda taken from the Law on Horizontal Property in Spain.

Ask Housing for your copy.

These specifically list what additions or changes are allowed or not allowed and if there is any query, of which there have been many, this should be directed intially to Housing on

It is my understanding from the Bye Laws that the sail type blinds are not allowed. Neither are the side panels with handles as these require runners to be bolted to the wall - and this is definitely not allowed.

All of this was discussed at last year's AGM so check your minutes

I for one don't like the ones recommended as they are not particularly attactive and certainly not practical as they flap about in the wind a lot.  I would like to see some that are more sturdier, particularly against the wind as it would mean I could sit out on my terrace during the winter months.  Are the shutters for the whole resort or does each phase have its own recommendations?

I totally agree with you about the recommended ones. I personally think they look hideous and the very dark browm makes it lool very gloomy! However, unfortunately they are the only ones currently allowed on Phase 2.

Initially this design was the only one allowed on the whole resort and I don't think any communities have yet changed the bye laws regarding this. However, I too have noticed cream ones appearing on Phase 4

we have a copy of the rules and regulations and adhere to them ,what upsets me though that,some people do what they want and no one seems.to police it. On phase two.I have seen Sail blinds,odd looking pergola on the roof opposite to us which has been there for over 2years and a terrace on our block with complete set of glass panels which is definitely a fixed structure, not to mention what looks like a chinese laundry hanging from the roof of a terrace on phase one! We know it is illegal but who is doing anything about it!

Several owners on Phase 2 were told to rectify some breaches of the rules after the 2011 AGM. But as you are aware legal actions can take a long time to resolve in Spain and they may be using delaying tactics.

Glass curtains (ie no central frames) are allowed but sliding glass doors with frames are not. If it is not a glass curtain then please let the President and Housing know about these as they need to be resolved.

The problem with Bye Laws in Spain at least is that they are effectively written in stone.

To change them takes 100% agreement within the community and to police them properly is almost impossible.

 

Court actions have been commenced against illegal pergolas etc. but as Pommers says this takes forever and could be costly so owners who wish to flout the law, do so.

Sail types shades were put in place in a number of communities and at the last phase 2 AGM it was decided it was not cost effective to go to Court.to ask for them to be removed.

What is apparent is, rather than attempting to change bye laws, each and every suggested idea should be put to Housing and the President or Committee of a Community, who will hopefully be sympathetic to new ideas, whereby common sense may hopefully prevail, however it must be remembered that if you allow certain changes then someone else will always want to bend the rules a little further, so some give and take on both sides is needed along with approval of other owners at AGMs or EGMs.

At present the Bye Laws are the same for each community but there is no consensus of agreement about what alterations may be permissable, time for the Entidad to work with the Communities.

 

If you have a proposal, take it to Marisol and to your President for consideration, a number of owners of ground floors especially on the ends have asked what could be done to alleviate the winds and draughts, so perhaps it is time for a sensible conversation that everyone can be happy with.

It seems that currently glass curtains would be acceptable but blinds requiring frames are not, perhaps better suggestions exist.
