We're buying in Block 10 and have been waiting for the delevelopers to obtain the First Occupation Licence from the Town Hall since last June. I thought I'd share with you an update I received from our lawyers this week as follows:
We had a meeting yesterday with the technician of the Town Planning Department at Mijas Town Hall in charge of this complex to find out the reason for the delay in the issuance of the inhabitation license and it seems to be a combination of inactivity on the part of both the developer and the Town Hall itself. To be precise, the developer was informed some months ago about a problem in the pedestrian access to the garages from the evacuation point of view which seems not to have been solved.
There is also another factor which has nothing to do with the construction but has to be resolved before the issuance of the inhabitation license. In this case the Town Hall has done nothing to start the process.
We expect to be informed in the following days about the breaking of the deadlock with regard to this last point.

Thankyou for the update. I have bought in block 3 and have had no info from my agent or the developer for at least two months...It seems strange that the developer is dragging his heels. Surely it is in his interest to complete the works so that he can get his hands on our money???

we visited the calanova site this week and according to Nora in the sales office blocks 8,910 are due to be given the licence soon and the rest not for another 3 months. The town hall is due to give a time scale in the next 2 weeks so the situation will be clearer then.

Hi all, we have bought in Block 4. An email from Steve Gilbert I received on April 3rd suggested the new bridge over the motorway was not yet in place and that he had heard rumours of fire escape problems with the underground car-park. Our solicitors are trying to get answers from Town Hall but as of today (May 1st) complete radio silence. This is our 4th year of waiting! This message was last edited by mark w on 6/1/2007.

Block 1 2 and 3 have had Lofp application submitted 30 April but do not expect any action before elections at end of May

And still we wait! Received the following from my lawyer today. We're buying in block 10:
We have been informed by the Town Hall people that the issuance of the habitation licence is being held up because of a simple administrative matter, that is, they have not received yet the pertinent report of the technician dealing with Calanova development.

An email I got from Steve Gilbert on June 4th said "I'm happy to inform you that in my opinion the first occupational licences for Calanova Sea golf blocks 8, 9, and 10 plus blocks 1, 2, 3, and 7 should be granted within one month. For technical reasons not related to the apartments the first occupational licences for blocks 4, 5, and 6 will be a bit longer, hopefully not more than a further month or two......
As we are in 4 this is somewhat a pain....

I have just had a communication from my lawyer. She says that licence of first occupation has been applied for all blocks but the town hall will issue them in three phases. Phase 1 will be in about 30 days and phase 2 and 3 to follow in 60 and 90 days. Block 3 is in phase 2 so I am expecting issue and legal completion at end of July. Our contracts then allow us another 30days to pay the final sum and take possesion. Taking into account the Aug holidays I am expecting to take possesion in Sept (2007).

Mark, As I am also waiting on block 4 I agree. I also deal with steve and find him to be brilliant and honest (I have dealt with 5 agents in Spain and also a mortgage company that charge a hell of alot and do absolutely nothing and Steve by far seems to be the only one over there working)
If what acezz says we may be having champagnes on the balcony by October. Apparntly all the problems have been fixed and block 4 is in line for final licensing. Steve also advised that block 4 has great views. Trying to be positive in the finale stages of the worlds most longest drawn out development ever.
I have given the golf plan to many of my pro golfer friends though and they say the course is fantastic for low handicap players and should therefore draw a good rental price based on the demographic.
As a potential neighbour I say lets hope so.

I will be in Spain in October and hopefully residing in my apartment. It would be nice to meet you all and have a glass of bubbly at the clubhouse (portacabin actually) if you are in the country at that time.

The text of my previous post got completely messed up and should have been as follows:
I've just received the following email:
Dear Member,
I am contacting you to advise the current status of the Habitation Licence application, according to information just received from Mijas Town Hall:
Phase 1 – Blocks 8,9,10 – This phase has now been fully inspected by the town hall technician who has produced a favourable report, proposing that the habitation licence should be approved. All that currently remains is for the governing body to approve this report and issue the necessary habitation licence. No specific timescales have been given but they say that this should be processed soon due to the positive report received from the technician.
Phase 2 (blocks 1,2,3,7) and Phase 3 (blocks 4,5,6) – A further technical inspection has been scheduled for next week. In the same way as phase 1, this inspection report will be submitted to local government and once approved; the licence can then be issued.
Obviously neither IAP nor your lawyers are in a position to give specific timescales as this depends entirely on the internal processes at the Town Hall. Once the licence has been issued the developer will then allow a period of 4 weeks for the title deeds to be signed. The developer’s office closes for the middle 2 weeks of August so theoretically signings could be taking place from September onwards.
It is extremely important to ensure that you are fully prepared for the legal completion of your property. You should already be in possession of an NIE number and should also have arranged Power of Attorney for your Spanish lawyer (unless you intend to visit Spain in person to sign the title deeds when the developer notifies your lawyer of the official signing date). Ideally you should have a mortgage offer agreed in principle by this stage and should also ensure that your lawyer has details of the broker/mortgage provider you will be using. Mortgage valuations and Snagging Inspections can now be carried out on individual properties.

We have just received the following e mail from our solicitors on the completion date.
(Please be advised that we have received notification from the promoter that they have obtained the corresponding licence of first occupation, however we are waiting to receive a copy of the licence and will provide this to you as soon as we have it. The promoter has indicted the 22nd august to proceed with the signature at the Notary. )

We have been informed that the promoter will not be able to pick up the licence because he is on holiday until the end of August - we are told that the occupation licence is ready and waiting.. Let's wait and see what happens..
