It has been agreed that the two garden/Pool areas are to be charged separate, then may I point out that the owners of properties on the South side of phase II & III (C//Hispasat) along with the owners of the properties on the East & North side of Phase I (C//Orbita & C//Marte) abut a public highway maintained by Pulpi, and not the"Private road" that serves the remaining properties. The costs involved with road and pavement repairs,renewal, & maintenance, including Road lighting Barrier repairs etc. should therefore be met by the owners of the houses that abut this private road and not the remaining owners (circa 50%).
As the Rules are presently being formulated by the new committee, the effected parties should write to the president, via the Management Company, expressing their concern over this charge which in due course will become larger each year as the roads etc deteriorate.
The split of the pool/garden cost are confirmation that the costs can be allocated and not charged to the whole community.

Initially it is not a problem in the way the community fees are being allocated, but longer term it could be and agree now is the time to acknowledge in legal minutes when expenditure is incurred on the private road the appropriate costs will be allocated appropriately to the liability as within the deeds and the appropriate properties.

Formally addressing this via an agenda item at the next meeting is perhaps the best approach.

 

As when buying any house, we also requested clarification on the responsiblity for certain things and for the purchase in Spain this included future liability for road expenditure.  We specifically selected a plot which was on a public road, rather than private road so can understand your concerns around giving clarity to all on this matter at the beginning of setting up the community.

 

Equally, we would like to assure any readers/fellow owners our desire is to have a well kept and managed  community/development, irrespective of the phase a property is located on.

Letters were sent out by post, also I believe Dominic notified his clients, and distributed notes on the meeting held on the 7th.

The only people with post boxes are on phase 1, we have been told Piensa have no money to install anymore post boxes. I did receive an email off Domonic but it was very short notice ( not Dominics fault I may add) as we all have work comitments. The splitting of the community is in my mind foolish but we have no say at all in what happens, lets wait and see when someone asks for community charges off me.

 Hi All

If you are part of phase 1, 2 & 3, feel strongly about private road & how costs are distributed (as stated in posting by Derek), you should write to the president of our comunidad via the management company (to keep track of all correspondence)  to  - comunalia@hotmail.com

In reply to Mick, the post boxes are all allocated up to the north side of phase 4.

Mick as you are on phase 4 you will not be receiving a bill for phase 1, 2 & 3 comunidad.  You will be part of another comunidad for other phases which will be set up at some time in the future.
