JUST a question, has anyone had any luck with getting the deposit back?

 Nope dont really expect to now they have no assets or should I say the banks cant find any assets. In a way feel like we had a lucky escape  financially as if we had gone through with the purchase at the contracted price we would all be sitting on a much bigger loss than our deposits , saying that still want our money back as we  have been cheated by so called businessmen   who wont have lost anything unlike us.  

We went to court and won the case and as you say there are no assets. We went back to the lawyer we had and asked about the bank guarantee that man said we claimed off the builder and i repleyd that he advised us to do that.. The bank have had our money and the assets of the builder some lawyer he turned out to be.

On the brighter side we bought another apartment in the next village with an open view of the hills and we have no one overlooking out little place in the sun. I always say it was only money and not my health they took

Am still hoping is all i .say - that something is retrieved from this situation - how ever long it takes.

I have not been able to make any contact with the solicitor in Valencia - that I beleive 3 of us from this forum got involved with.

Was wondering if anybody had any news from them - J.B Costa solicitors..?

Hi Babsy,

 If your solicitor has gone the same way as mine did then thats why you have heard nothing from him. In my opinion they sue the builder knowing very well that the builder will no longer have any assets. The banks are the ones that have the money but most if not all the lawers have dealing with the banks.

I've joined another forum just for the likes of us its called lost property deposits Spain.

We Have to keep trying .

The latest court case has been won,  looking better for us all now however they will appeal no doubt , for those who have not registered on the lost deposit in Spain site  the link is below

.A group action maybe the way to proceed  as soon as the case is  finally won and not appealed, the lawyers may be able to refer  to the findings so making actions easier.

Hi everyone , not been on here for a while

sounds good someone getting there money back lets hope we do

i also have taken urbasa to court and won but not seen a penny and cost me another grand

they are looking for assetts as usual

so i have contacted my lawyer today to see if anything else is going to happen

i will proberbly get same old responce (waiting for courts to find assetts) but worth a go

maybe we all need to get together again and take the banks to court like they did , there is more of us than there was of them

Hi George...thanks for reply. I have a family member living in Spain who has just sent me some cuttings from a local paper..where it appears that some cases like ours..ie. No bank garentees are starting to win cases as the money by law is been obtained from the banks if the builders or landowners have gone bust. These solicitors that are taken on these cases are also operating a no win fee basis...thought it might be worth given it a go....and anyone else out there that might be interested.  I originally had a group solicitor going with some of the people on this website..but after sending all my original paperwork and approx £500..I have not heard from them for the last 3 years and don't seem to be able to make contact with them...so my fist fight is to try and get my documents back...although I have photocopies....

If anyone interested I can provide the name of the solicitors from the cutting out of the paper...let me know.

I feel sorry for you people, not only did you get conned by crafty Developers, some of you have been scammed by Solicitors. Charging £500 and then disappearing....disgraceful. Have you checked with the Colegio de Abogados?

Hi conchi.....I know it's an appalling situation. I know a lot of people have probably walked away from it...and I can't say I blame them.....but I still think if there is anything that can be done...it's got to be still worth a try.   Tried to have a look at the colegio de abogades....but could not really find anything in English...and not sure what the site is.....if u get a mo...please advise...then I can try it a different way....thanks baby'sbaby's

 There's a law firm holding a seminar on the 9th december They are going to talk about the off plan rip off. I'm thinking of going there to see what they are intending. If they want paying upfront I shall be giving them a little talk myself. There far too many crooks calling them selves lawyers and linning there deep pockets with our hard earned  money. Just hope that they have a plan that looks good

Hi everyone

Like many others no doubt i had given up ever seeing return of my deposit but now I am retired and have more time on my hands I will take some interest to see what can be done realistically to get something back either from the bank or the lawyer who took our deposit and passed it on to Urbasa

so if anyone has any info for a lawyer who will take on basis no win no fee would be very grateful

i will also look for such a lawyer and if I get any joy will post it on the forum
