I know that this is a sore point with a lot of owners but as a villa owner we don't have a President or committee so I  depend on the forum or newsletter from the administrators to keep us informed.

Does anyone know what is happening with regard to the follow up of the debtors? I get the newsletters but apart from the spiel about armbands and the like I have no idea what is happening.

Maybe someone from one of the communities can let me know as I know that there was some posting lately about this but I can't find it now.

I am asking as we had dinner a few nights ago with some friends from another resort up the coast who were using a firm to recover debts but the company is now either in administration or winding up but I am not sure if Roda was using the same UK based company as I can't see any information on the name of the company we are using.

I know that this will get the usual airplay coming up to the AGMs but at this stage surely we should be informed of what has happened since the Entity AGM over 6 months ago and what is going to happen over the next few months as it is a bit late to be talking about this only once a year especially when the debt figure could encompass the actual cost of the services in the next few years.

Any other villa owners think that it is time for us to have a representative who knows what is going on?

I can't speak for the Entidad as I am not on the board and getting info from them is difficult.

If you want more info from a community point of view then PM me.

As Pommers says villa owners are part of the Entidad and they are supposed to be updating a very poor website but as in most things Spanish time is not a pushing issue.

You are though perfectly entitled to and should ask whatever questions you like of the board via Resortalia the Entidad Administrator who send you your quarterly novices.

In some resorts, villas do make up Communities but this is Roda a very ill thought out political nightmare.

I hope the following assists. I am a solicitor and the founding partner of Welbeck Law LLP based in London.

The company of debt collectors you were told about may be Kettlewell Solutions Ltd which went into liquidation.

Information is available on our website blogs.

We specialise in tracing UK community fee debtors and pursuing them through the UK courts which are much faster than the Spanish courts.

If the debtor does not pay we get a judgment from the court using fast track European law.

More information is available on our website but we already have clients in Murcia and we are recovering debts for them.

Who ever your community uses to collect their debts please make sure you check they are solicitors. Further information is available on my blogs on the EOS website.

Hi Jeremy

Sorry just saw this as we were en route to Murcia.

I sincerely hope that Resortalia are using your services as we need to get these people to pay up. I am a villa owner and we have no representation on the Entity Board but I imagine that the Presidents and Entity Members read this forum if they are clued in at all.

Thank you Mandy.

We have been talking to one Roda community president who was going to use our services but it appears they have decided to use the Spanish legal system.

They may also be considering using debt collectors who are largely unregulated as opposed to Solicitors, such as ourselves as we are authorised and regulated by the Solicitors Regulation Authority. We are also specialists in this field.

Meanwhile, the amount owners are being asked to contribute towards community fees may well be increasing because the debtors are not, in my view, being chased effectively.

Hand on heart, it makes no sense to me!

Hi Mandy,

There seems to be a bit of a misunderstanding here.  The members of the Entity Board are elected by and from all owners at the Annual General Meeting and they are elected to represent ALL owners, not just those of their particular community or phase.  Although villas do not form part of any Community, and do not therefore have to pay community fees, they certainly do form part of the Entity and pay entity fees.  Community debts are the responsibility of each individual community.  Entity debts are the responsibility of the entity.  Hope this helps to clarify the position.
