Just been to have a look at the SARC website, not a single mention of HDT being liquidated. it would be interesting to see their opinion as what to do now, regarding the way forward, last up date was in january 2014.

We still haven't had any positive outcome from our lawyer. Now that hdt are in liquidation, our lawyer is now talking about going back to court and no doubt going to cost more money. He doesn't seem to have gone the way of other lawyers. We have to meet with him (more money as we stay in Scotland) and decide what to do next!!

Would it be unkind to state the obvious, and say why not include two or even three lawyers for initial advice.
Then you can get an idea of the options of progress, and ask them if any have had success with similar cases. I think the days of 'I want my house' were always numbered, if it is the same lawyer who supported that action, perhaps a sacking is in order????

Many thanks for your reply, it is useful info.
i take it you are in Alicante court as that is where my first hearing is to take place [i guess both first and second hearing are held in the same court]. i hear the bank's legal team give you a hard time and that you need to keep calm and don't let them provoke you.
so your wait for the second hearing is only five months from the first hearing. that's quicker than i thought it would be; hope mine is no more than 5 months.

Hearing is in Almeria.
Just finding out after recent events if i still need to attend. No point in banks asking me why i want my money back and why i do not want my property when the crooks are bankrupt.

could you just confirm where your first hearing was?
if it was alicante why is the second one in almeria? did you or the lawyer get a choice?
i'm not looking to having to traipse all the way to spain just for a court hearing. what a nonsense it all is. i hope you find that you won't have to attend.

We are using a Spanish lawyer, Martin De La Herran of Abolex Abogados.
Martin has already had successful outcomes in court, winning deposits back for us unfortunates !!
Our first hearin scheduled for 5th November 2014, and we've been told we don't need to attend that one.
If its contested, ( and no doubt it will be ? ), then we will probably have to attend the next one ?

Hi, We use Martin too. We won our case against the banks in April, the bank placed our deposit in the court in Alicante in May, and the court has held onto it ever since! Martin has only just got the paperwork from the courts to release my funds. I`m hoping the money will be in my bank account in the next couple of days.
To anyone who hasn`t thought about suing the banks, I think this is your only hope of ever salvaging your money.
HDT have strung everyone along for the last 8 years or so, with false promises and blatant lies. Why did they wait till the days before they were to repay 10% to creditors to ask Jumilla council for the return of bank guarantee money? What happened to this new plan that had been submitted to the same council? All lies to allow HDT to continue trying to hoodwink buyers.
Good luck to everyone following this path.

Hi All,
Just a quick update, my funds were in my bank account yesterday.
Good luck to everyone who are suing the bank. It`s a long road, but persevere, it`s the only way of getting your cash back.

well done I bet your delighted to say the least ! Hopefully we won't be far behind you ! The court has given the bank 20 days to deposit our money into our solicitors bank (obviously 20 working days taking into account August holiday ) did the bank appeal in your case ?

Delighted is an understatement ! I keep checking my online account to make sure its still there lol.
Yes the bank appealed, and hopefully it will be a formality. The bank will need to wrestle me to the ground to get my money off me. It`s been a long 8 1/2 years and we still have the worry of the appeal, however I remain positive.
Just to let you know we won the case at the end of April and the bank appealed on the last day. The bank then lodged
the deposit with the court on May 22nd and the paperwork was sent to my lawyer on the 29 th of July to have the funds
released. Then my lawyer went on holiday , however he transferred the funds and they went into the bank yesterday.

Yes our bank appealed on the last day which was mid June solicitor lodged the request for deposit plus legal interest the following day. We await for our deposit to be returned solicitor said sometime in September !
We purchased two properties so we have quiet a significant amount to come back ! Yes our is already spent as well and if bank win appeal ( which is highly unlikely) they will have to fight for the money ! We bought ours in October 2004.
worst mistake we have ever made and thankfully the end is near !

first of all, well done joanniemac and hew1. so pleased for you.
could you please confirm that the judge ordered the bank to refund your monies at your first hearing?
also, can someone please confirm that the second hearing is always held in the same court [or town at least].
i really hope the judges have made such a substantial legal precedent now with all these decisions that the court hearings become almost a formality in future [not only for my benefit but for all of us - we've been 'robbed' by the banks and they know it.
