Hi 

 

Does anyone have experience of this. My partner has penthouse on phase 1 bought from new that has no outside lighting ( not covered by maintenance as internal to his flat), locks on windows broken, leak in bathroom roof and plug sockets coming out of wall. 

Before he goes down route of paying to have it all done will he have any luck with his guarantee ???

Hi

In days of yore perhaps he would have stood a chance.  I suggest that he might like to ask the administrators Resortalia for their advice but would think that he might not be successful.  As in all things the builders guarantee is probably now not worth the paper it is written on.  But he may possibly be able to claim on the buildings insurance (either community or his own, I think - and I am sure someone will correct me if I am wrong - for consequential damage - not the damage itself!  For example damage caused by a leak is covered but not the fixing of the leak is one example. Resortalia should arrange for an assessor to visit and give a decision on the leak.   All the other stuff sounds to me as if he will have to find an electrician and odd job man to come in and do  what needs to be done and pay for the work. It's been 8 years since Phase 1 was released for sale so I am almost sure that there would not be much chance with regard to successfully claiming against the builder's guarantee - but he can t

Easy response very much the same as Sandra your community fees include an element of buildings insurance which should cover the internal repairs to the damage from the leak but they will not repair the source of the damage, the window locks which are wear and tear and the plug sockets

The only guarntee is the 10 years NHBC type which only covers structural defects

The community buildings insurance is very limited and would probably not cover these type of things.

It only covers COMMUNAL elements - so problems with plugs, doors and locks are personal to your own apartment.

Your personal buildings insurance will also probably not cover this - except for damage cuased by the leak.

So I'm afraid these things will almost certainly have to paid for out of your own pocket.
