Caitlin, did you get your money back in the end? Last i heard was that you won your case and you were wondering whether to take your money or not. What happened? Btw, I'd take the money and run like fuck with it haha. Let them spend 15 years chasing you!
I've been to court recently and i'm waiting the outcome. The interesting thin gis that it is the same bank as you. I'm hoping they dont appeal too. Then i'll have my money this year!

Hi,yes we did decide to put the money without the interest in our bank,The next court hearing can take up to 2 years to try and claim the interest ,back so we have just over a year to wait for the outcome,As you said they can sing for the
money we have been paid ,after all its not as though we are stealing it its our money that we had to work very hard for , caitlin hope your case goes well and you and at least get some money back let me know,

Great stuff. You could always invest it for a better rate anyway. Take a look at Uown.co.uk for a rate of about 6.5%.
What did your solicitor say about taking the money? Where they able to stop you taking it? Did they want paying first?

Hi,Thank you for your advice and as for the money the solicitor was really good and said it was entirely up to us as the solicitor had it in his bank.he took the 20% out and then gave us the remainder which was all above board.Hopefully we will win the case for the interest as that adds up to quite a large amount .Did you ever buy anything else abroad...Caitlin

No. I haven't bought anything else. I may well end up buying something when i get the money back. I really want my holiday home, and also i want to retire there too, maybe in 10years or so.
Will you buy another place?

Hi,Hopefully we will all get ything back..Yes we have been looking around torreblanca area this time for an apt that is already built {not taking any chances} but no luck yet.We also want to retire there.Anyway good luck with your outcome and our solicitor did say he was very positive. Caitlin

Thanks Caitlin. Yes we are 90-100% certain of getting deposit, costs and interest back.
Funnily enough, my unbuilt apartment was in Torreblanca (Cortijo de)! I was just climbing up that steep hill behind the train station on Sunday afternoon. Lovely little spot. Very very quiet, very villagy. Just 2 or 3 places to eat/drink. I went up to the top and had a couple of beers in MonteMare (the Swan shaped hotel). I would love to live round there or even just a holiday home. Most would find it too steep, but i enjoy the exercise, and you get nice views on foot in the hills. I didn't see any for sale signs up on my travels around there...not sure if people put them up anymore due to break ins etc. (is that the reason?).

Hi,Not sure what the reason for not putting for sale signs up.We were also buying at the same place as you and often been for a drink up there it is lovely,we were up there three weeks ago and love Torreblanca it is home from home. Is your solicitor in Fuengirola ? and did he give you a date that they can appeal up to as ours appealed on the last day but hopefully that wont happen to you {will keep my fingers crossed }, Caitlin

Hi Caitlin, sorry, didn't remember that you were from the Cortijo development. Btw, I went up there to have a look at it ...it is completely ruined. Roofs missing, walls grafiti everywhere, flooded etc. It won't be getting taken over and finished off, that's for sure!
Solicitor is Malaga area. Final day is near end of March (i don't want to be too specific). Interest will be added from the start and also the interest rate from now on is 2% more than basic legal interest (3%). Hopefully i'll walk away with about £15-20K more than I paid (after solicitor fees, exchange rate and interest added).
Which bank were you claiming against?

Hi,We went up there a few times and was depressing to see what was to be our home one day,I really hope you get all your money back and more,It has been a long time coming and hope everyone is succesful,Our bank is Banco Atlantico,It will be a year in may since the bank appealed so hopefully it will onle be a few more months more,Caitlin

Howdy , it’ has been a long time since checking out this forum however I thought the following information may be of value.
At the court hearing yesterday ( April 18th ) in Malaga a little daunting to say the least . Banco Popular attending lawyer was trying to entice me to say I purchased the property for investment which is their only way of avoiding paying out under 51/68 . We now have to wait and see
