Hi,

Our estate agents emailed us 3 months ago to say completion dates for 15, 17, 18 and 19 would be July 2008.  They have now emailed us again a few days ago to say these blocks will be ready this July 2007.

Is completion date and occupancy/habitation licence date different?  How can we be expected to complete and move in when there is so much building work going on behind us i.e. pool and another block.

Do you complete before given habitation licence?  Please help.

Hi Womble (?),

You will be notified (by your lawyers) when the Habitation Licence is issued, which won't be before the local municipality have approved that the site is ready for "habitation".  To my knowledge, no one I know of in DV has been asked by the developer to complete before the Habitation Licence has been granted.   This can take a few months after they have completed the blocks - and there may indeed still be lots of building works going on around the site.  You shouldn't, in any event, complete without the Licence and your lawyers will advise you so. 

Personally, having seen these blocks early last month, I can't see how the LFO (Licence of First Occupation - same as Habitation Licence, I believe) will be granted by July, unless they've really put lots of work in between then and now!!  (Have a look at some of the recent photos posted in April and you'll see).  And even if it is, you can delay completing for quite a while (we did by about six months).

I would strongly suggest you speak to your lawyers before taking what your estate agents tell you as firm.  Your lawyers should be able to give you more accurate information.

Hi,  I agree with Pitby, the occupation (habitation) license are only issued or should be when the building matches the planning application and its safe and fit to be occupied. I know of cases after inspection when the planning office has made developers make changes to the site before granting licenses in Manilva.  Where is 15,17,18 and 19 with respect to the entrance?

I was told end of year to mid 2008 for completion of the full site by the developers office when I signed for block 8.

I am in Manilva for July so I can check, photograph the blocks for you, send me a PM with an email address if you want.

Hi Womble,

We are in Block 17 also & have had a similar email to yourself. Totally agree with Pitby & Manilvajl.

When there was some confusion re completion dates earlier in the year, I spoke to Ros y Falcon (Antonio). He advised that the July date was when the builder was due to complete & hand over to the developer. Even if that occured on time, he advised they would then need to apply for Licence of 1st Occupation as mentioned in the other posts, which could take a few months. Even when that is issued, they would not complete sales on all apartments at the same time and these would be staggered.

On basis that we won't be able to use the apartment this summer, we personally will be happy to see matters delayed until such time as block 16 behind us & the swimming pool are far more advanced than they are now. We have spoken to our solicitor & he has had no notification from Ros y Falcon as yet.

Womble. The advice given here is quite correct I believe. My take on what you have been advised is that I have been on site frequently, most recently 2 weeks ago, and I am suprised to hear these blocks will be ready. I drive past block 17 and the garage was being used as a store for all building materials. They will have had to have been working a shift system to get it into a habital state by july. But miracles do happen so let's hope so. I am there on friday so will be seeing what progress is made.

Thank you all for your replies.  Looking at recent photos taken in April it certainly doesn't look like block 17 could be habitable by this July.  We are hoping to travel to Duquesa in July so can't wait to see the progress for ourselves.

We are relieved to know that a habitation licence must be granted before you are asked to complete.

Hi all,

We visited DV on 31st July and were able to look around our apartment in block 17. Internally it has been finished, apart from a good clean still being needed.

Maria Lisa from Ros Y Falcon claimed that the Town Hall were due to inspect the same day re Licence of First Occupation. If this did take place, then she expected it to be end of Sept before any completions would take place. This did assume inspection actually occurred and no issues raised. There was certainly a lot of activity taking place in the grounds behind the block and also block 15. 

Apartment looked very good and finished to the high standard promised.

Realistically think end of Sept still looks optimistic and end of yr more likely. Given that block 16 is still a shell and the pool behind us is still in its early stages of construction, would prefer to see matters a little more advanced if possible before we complete.
