There appears to be a cash flow problem with the company.Some people on the development have had their water and electric turned off because they would not pay the builder money when he demanded it as their property doe's not have the legal paperwork and they are unable to realease their morgage monies. Although we have been told the escituras are immenent I personaly would not pay any further money to the builder until the relevant paperwork was available but having said that you must go with your consience and the advice of your solicitor.The builder seems to be of the oppinion that British purchasers are at his mercy and he has the authority to do as he wishes.It is time that all the prospective purchasers stuck together for what is right and fair as it is our hard earned cash and shwed the builder we are the people putting the money in his pocket not the other way around.

Having noted the rather cavalier comments posted by JOE1 on 07 Sept. 2006 on Trampolin Hills message board "Hi all" thread, followed by recent doubts expressed concerning the affairs of Solera Trampolin I feel that you should be made aware of my unfortunate dealings with messrs. Raphael, Ronnie and Antonio otherwise known as Trampolin.
Raphael is a Belgian, ex pro(?) goalkeeper & double glazing salesman.
Ronnie is/was a Belgian car salesman.
Antonio is a Spanish gypsy who came to own farmland which became the original developement site.
I came to know them when they operated out of a portacabin at Gea y Truyols, and was subsequently deliberately swindled out of 55,000 euros I had given them as a deposit when I was foolish enough to trust them. I will forward details of the con privately to anyone interested.
I would ask anyone doing, or thinking of doing, business with them to start thinking rationally, unlike myself, and perhaps satisfy themselves on the following points:
Why does Antonio need full time armed body guards and his house at Lo Santiago to be fortified?
Why do Raphael & Ronnie also need bodyguards?
Why did one English agent employed by them leave having been struck with a fire extinguisher, threatened with a gun and owed a lot of commission?
There is also their involvement in the importation and sale of super luxury secondhand cars of unknown origin from Belgium, some of which they delight in parading around in.
Stories also abound about other people owed money for services.
Do you know anyone on their original developements at Gea y Truyols or Lo Santiago( el Trampolin) who has got the escritura(deeds) to their property and are therefore not living there illegally?
I notice that the advertisement mentioned, on the site mentioned, in  the posting by GM on Sat. Sept 2nd. on "Trampolin Hills" message board has had the paragraph referring to agents commission of 18% (tax included) plus one free apartment for every apartment sold  ommitted since I last looked on Sept 7th. following GM's request to do so.
Make of that what you will, a bit car/ double glazingish?
Note also that Direct2Spain have ceased to represent them.
In any other circumstances would you honestly part with good money to these sort of people, say perhapsin the UK? I think not!!
I have written this in good faith and sincerely hope everyone has a satisfactory conclusion to their dealings but please tread carefully and consider your next move without your head in the clouds.

Having known the company for 2 years, I can see you are talking from experience.

Have you bought property from Solera or were your problems with them to do with something else? You are right, I dont think anyone has their escritura, even 2 years after purchasing. We cant proceed with our purchase until the escritura is available because we are having a Spanish mortgage. Although this is stated in or contract, the company phoned me this week to 'demand' a rather large cash advance (in the region of 70k) but as I dont have this kind of money in my back pocket, I wont be going down that path. It was not a nice conversation and not for the feint hearted! I think we buyers are going to stick together on this one and see what happens. We are told the escrituras are 'imminent' but they have been saying this for 2 years!

I have read with interest and a certain amount of trepidation, the posts on this forum.

We will be visiting the site late October and have been pressurised into paying another €45000 making a total paid of 75%.  This is not what is written in to our Contract.
They have threatened to make the Escritura in the Company name so should I assume that they are nearly at the point of issuing them?  Let us hope so.

The site was looking good when we were down in June and I am sure when all of the stress and politics is over everyone will enjoy their new homes.  We should certainly have an urban celebration of some kind maybe.

Hi

Has anyone else being contacted by the developer "asking" for a further cash payment? Like Jenechka we have been asked to pay another 70.000 Euros to make a total paid of 75%. For now, we are not going to pay any more money (and we dont have any more money) until we can get our Spanish mortgage.

What is the word from the site Willie John? I have heard that it has been a bit unpleasent for those living on site who cannot complete without the escritura to obtain their mortgages.

Does anyone know what the implications are of the company putting the escritura in thier name? Surely, our sales contract says they have to sell us the house for the amount stated in the contract. If they refuse, they are in breach of contract. Are they saying they are going to re-sell the house to someone else?

To be honest, I wouldnt mind if they did that, if first they gave us back the money we have paid so far. I still love the villa and the site but is it all worth it?

Does anyone else have an update for us all?

The site has settled down again this week after the threat's to some resident's have been resolved for the time being. Although we have heard of quite a few purchaser's being asked for more money even though they have paid what their contract's reqire them to.They also have been told that the company will put the house in their name if they do not pay.To the best of my knowledge this cannot be done and is just the builder's way of bulling purchaser's into doing what he want's.From experience once money has changed hands the builder will not want to keep his end of any agreement's verbal or otherwise.

I have not been asked for any more money from the company. I was however put in contact via email to a guy called Javier who seems to have a better understanding of couples like myself who went into this project willing to pay 1/2 upfront in cash and the balance via a mortgage on completion with all legal docsready for signature...He assured me that the deeds would be ready soon and that he may be able to give me further news once we visit the site around mid october... (not holding my breath) looking at the gallery for Lo santiago on the El trampolin website it would appear progress is being made with all the infrastructure.....All I would say is I am not prepared to pull out yet...But will have a beeter idea about my final decision once I have spoken to El Trampolin face to face....

Javier is the company solicitor and as such is a little bit calmer to deal with. He must also be aware that you can't threaten potential buyers into making payments outside the contract.

We are also visiting in October. We have stayed at mmgr a couple of times and might try it again. We have spent a small fortune on renting places to stay (when we should now be staying in our own place)

If anyone wants to meet up out there, send me a private message and we could arrange something. We can then swap information and present a united front!

WE ARE ON PHASE 1 OF THE DEVELOPMENT AND HAVE HAD OUR WATER CUT OFF ON 2 SEPARATE OCCASIONS.

AS WITH MANY OTHERS, WE ARE GETTING A MORTGAGE ON THE PROPERTY HAVING PAID SOME 65% TO DATE. WE HAVE EXPERIENCED ALL OF THE "THREATS" THAT OTHERS SEEM TO HAVE HAD RANGING FROM ESCRITURA IN THE BUILDERS NAME TO DISCONNECTION OF THE (ILLEGAL) WATER AND ELECTRICITY SERVICES. WE HAVE HELD FIRM WITH TRAMPOLIN AND TO DATE NOT PAID AN EXTRA PENNY. THE REQUEST HAS REDUCED FROM 50,000 EUROS TO 2,000 EUROS PER MONTH "FOR WATER AND ELECTRICITY" WHICH WOULD COME OFF THE FINAL BALANCE.

ALL OF THE LEGAL ADVICE WE HAVE HAD SUGGESTS THAT WE SHOULD NOT PAY ANY MORE. THE POINT IS THAT ANTONIO HAS ABSOLUTELY NO RESPECT FOR THE LAW AND CARES NOT ONE JOT IF HE COLLECTS ANOTHER DENUNCIA TO ADD TO THE 15+ HE ALREADY HAS. HE IS THE SOLE DRIVER FOR THESE ACTIONS AND RONNIE AND RAFA (I HAVE SPOKEN AT LENGTH TO BOTH) HAVE VIRTUALLY NO INPUT TO HIS DECISIONS.

WHERE DOES THIS LEAVE US......  IF WE SPEAK INDIVIDUALLY TO 10 DIFFERENT LEGAL "EXPERTS" WE SEEM TO ET 10 DIFFERENT VIEWS ON THE SITUATION AND HOW WE SHOULD PROCEED.

I BELIEVE THAT THE TIME HAS COME TO FORM SOME SORT OF RESIDENTS COMMITTEE AND APPOINT A SINGLE LEGAL COUNCIL TO ACT FOR US ALL AND SHARE THE COSTS ACCORDINGLY.

IF ANYONE WANTS TO PROGRESS THIS APPROACH, SEND ME A MESSAGE AND I WILL FORWARD MY EMAIL ADDRESS. ALSO TALK TO OTHERS YOU  KNOW ON THE SITE AND SEE IF THERE IS MORE INTEREST.

FINALLY, IF ANYONE WANTS A "BED FOR THE NIGHT (OR MORE) WHILE THEY VISIT EL TRAMPOLIN TO ASSESS PROGRESS, GET IN TOUCH AND WE WILL GLADLY ACCOMODATE (ASSUMING WE HAVE WATER ETC!!!!!)

We are over at the end of October and would certainly be interested in meeting up with you. We are in a slightly different position because we havent moved in or even been allowed to move our furniture in because we have only paid 40%. However, we have still had the threat that if we dont pay another 70K asap, they will take some form of action! They didnt say what that would be!

Have you spoken to Javier? Surely as a lawyer himself, he cant agree with the company's actions?

What really worries us is that if the escrituras are going to be available any time now (as the company are promising) Why would they be doing all this to recover more money? Because once the site is made legal, I am sure we will all be more than happy to complete and they can have all of thier money. It doesnt add up!

Hi everyone

Naturally we have similar concerns we have paid 60% of our villa and given the keys to move in as we were told completion in October 2005.  Our bank will not under any circustances release any further funds and like others we received a nasty telephone call demanding further money of which we have absoulutely no intentions of paying.  Our Spanish lawyer who is based in London calls the Developers Crooks and that he has never ever dealt with such bunch of cowboys in his life. We have also had our water and electrics disconnected after paying a fortune to have our garden landscaped as now the integration system is not working.

Can we suggest that we need to stick together and do not pay another penny although we believe some have, who have retired we strongly feel that we should all meet up and go into the office together, we have just cancelled our trip which should have been next Tuesday because of the uncertainty of this situation.

From Exile. We have been told Oct25 for the start of issuing Escrituras. Do not believe it these are crooks procrastinating as they have so many times since we moved in July last year. They are not the slightest bit interested in customer relationships and will milk us for all they are worth. We paid full price as we bought off an English agent/owner and we bitterly regret it because we stand to lose all our money not a percentage of it as with others. I think somehow soon we need to start threatening bad publicity via the anonymity of a lawyer`s letter. Local media, uk papers, Channel 4 would all love to hear about our plight at the hands of foreign crooked developers. The start of flat building near the twin towers could be disastrous if it puts all the Building permission back to square one. Have you noticed Trampolin Hills advertisements are being replaced by a general one? If TH is not completed by2010 as seems likely all the people buying there will want their money back asap

If you have paid all your money and have moved in, why do you think you might lose it all? Do you mean if the site is never made legal?

Also, what is happening near the twin towers? You said they are building flats? I thought that two of the owners were having villas built there (which I know are more than one story) Is this likely to cause further problems with permissions?

Can you tell me what has happened to the Trampolin Hills adverts becasue I have not seen any recently? You said they are becoming more general.

It is all very worrying!

Has  anyone thought of contacting Channel 4 Richard and Judy who gave a house as a prize in a competition and this is on Trampolin Hills supposed at the time to be completed by Feb 2007? Surely they would be interested to know it is illegal and the rest of the Development will probably never be built?

I read in an English newspaper recently that Channel 4 is to make another programme about trouble for ex-pats in Spain Unfortunately I could not cut out the details before it was thrown away but I am sure further references to this will be made and if so please let us see what we can do for goodness sake. Maybe bad publicity is the only thing which will get under Antonio`s skin, he cares nothing for any regulations and is unlikely to keep to any planning and building permissions he gets.Regards Exile
