Hi all those engaged in withdrawing from the Country club.

Just got back from 6 months stay in Mojacar withdrawing from the club. Engaged a top local obligado solicitor costing 3000 euros and he got our two bank guarenteed deposits and plot reservation fee back in 10 weeks. Total 56000 euros.

Huma indicated we would have to take em to court to get compensation and I could not be bothered. This excercise has cost me some £8000 over the last 3 years and there comes a point?  During our 6 months in Spain we learned many things and we wont be buying in Spain thank you. Most agents/solicitors believe those with bank guarentees will be safe but if the site is not built others will lose everything. A lot of locals dont think the site will be completed for a long time,if at all. I do hope they are wrong for all your sakes but believe I am well out of it.

As I have no further interest in Spain I will shortley be resigning the site but will continue for a short time for those that feel I can further advise.

You can get out with the right approach relatively easy!!

6/8 weeks from the start of the cancellation contract

it is now looking certain that it will re start but' if you can not wait 'then we can help you find an alternative property [ sorry not such good value!!!] and at the same time help you get a refund of your deposit within this time scale to enable you to buy the new property  

Having said that now, I think it may just be a little more difficult after they do re start.....but it may depend on the date they give you for completion

If you really want to be in Spain, say by early 2008 and have a good case [ bit like 'king dingalong father'] then ' right now is the time for action- we can help you find your new property and then help in getting your refund to buy the new one[ have to be a re-sale or new ready now]

I am staying in....but that is OK for my time scale

We have just received the cancellation papers which state that we will receive part of out deposit immediately and the outstanding amount in 2 months.

Now why dont I believe that ? ! ?

I believe it as much as last years posts on this web site " Building will start in September".....

.......And this years posts " Building will start in in September".  

If a Company in Spain identified some land, applied for planning permission to build and it was granted, how long would it  have taken in all?

What im getting at is that we have seen developments announced,then launched,then built to completition in the time we have waited for HUMA......Surely HUMA would be quicker because the basis plan was in place etc etc.Any thoughts?

Why is the planning for HUMA taking so long ?

Is there something we all dont know?

Does all planning take this long ? 

Can we honestly say HUMA have been a free flow of information about this matter?....Or very quiet and reserved/guarded in what they are releasing?

We didnt want to withdra and my wife got quite emotional signing the forms.....But this whole thing is starting not to add up.

Hi All

Can anyone tell me if i have to wait  for my contract to end before pulling out.

It ends 23 october 07, aldea says i can pullout any time by emailing a letter to  which i have had no reply (surprise surprise)

and my parador rep says i cant till this date as the builder is not in breach of contract.Even though i wont get the keys by this date.  

Im only asking for my £2000 deposit back

We are not waiting for planning permission, Andy, this was issued by the local Town Hall at the start.  We are waiting for the PGOU for Cuevas to be passed by the Juntas at Almería and Seville (and the court order to be lifted). 

All the Sectional Reports are now in (all have been approved) as shown in Huma's email yesterday (email posted on the owner's forum - I haven't asked for permission to reproduce it on here), and, as was posted on Huma's website (almanzoracountryclub.net) in April), the 'powers that be' in Almería have promised to expedite it's passage through the approval process.
