The letter was dated 10th October. We are buying plot R15 which was due to be completed this November. It is now due for completion in September 2008. This is the second time we've been notified of a delay in completion.

Well,well well. After such a long time you potential investors and would be residents still seem to be waiting for your places in the sun and I dare say that you will be waiting for many months to come before your dreams become reality, if at all. Get your Spanish lawyers to get down to the Town Hall in Jumilla and get them to explain to you all and get it posted on this forum exactly what the problem is that San Jose have with land on the golf courses which I was made aware of 2 years ago. Hi facere
What is the problem you are referring to? Do you realise that many people are hoping to retire to Santa Ana and this is going to be our dream home? If there are problems, this is not a joke as you seem to imply. We don't have lots of money to invest - we are just looking to move to the area after we sell our flat in the UK.
Your tone didn't seem very sympathetic, or maybe I have misunderstood your intentions?

I have heard rumors that there are Land Ownership issues with the golf course which SJ have known about for a long time.I would imagine this is what the farcere is referring to. I have tried to get more information from SJ but they are tight lipped.

I've just come back from a site visit where I spoke to the solicitor (Maria) as well as a variety of people on site.
I have seen the Urbanisation licence which was granted back in June 06. This licence, signed by the Mayor who has just been voted back in after recent elections, states that the land is OK to be turned from rural to urban.
After this the developer has to apply for the build licences for each phase. The development of the Golf courses will require a licence and I believe that licence will be in place any day now. It has been a case of waiting their turn after the elections and all the beaurocracy that goes with it. Remember Santa Ana isn't the only development in Murcia.
The principle however is not in doubt that the site can be developed on and turned into a golf resort. this has never been in question since June 06 after the Mayor signed the Urbanisation licence.
As in the UK licences take time and I belive SJ were overly optimistic about the admin being done within their timescales.

Thank you for your reassuring update. it's difficult having to be patient and wait for things to happen, however if the original licence covers the urbanisation, there are no real worries.
Hope that you had good weather and enjoyed yourself out there. Can't wait to get back to Spain, though at least the sun is out at the moment.

Thanks mickyl some imformation does raise our spirits i have no doubt the build will commence it`s just us brit`s must adopt the spainish way of life and relax a little just because something is not done tomorrow does not mean it will not be done at all.
After all is this not the reason why we are all moving to spain hope you had a good visit

Hello again. It is the end of October today and San Jose still do not appear to have actually started the upbuild yet. I have no doubt that the build will commence in some form soon but I feel that San Jose have not been entirely honest with you all and Javier or one of their directors should have explained on one of these forums what the real reason for the delays has been. It has nothing to do with the licensing for the upbuild but as I understand it revolves around the fact that they do not actually own some of the land that one of the golf courses is on, as the owners would not sell to them.
This should explain to you all the reason why no work of any significance has been done to the golf course and without the golf course what is the point of continuing building the houses!! I believe that San Jose has taken some sort of legal proceedings similar to compulsory purchase in the UK and that they are going through the 'reparcelation' procedures now to make the land theirs thus allowing them to commence the project in earnest.
I for one though, could not live in an area where I knew that some poor farmer had been forced out of the home that his family had owned , perhaps for many, many years, by a large company that has more financial clout than he had, as my social conscience would not allow me.
Just try to get San Jose to 'come clean' to you all about their problems at Jumilla and the reasons behind the projects that they have agreed to do for the mayor of Jumilla to get the support required to acquire the land that they needed.
You will all be pleased to know, however, that you will never see my name on this forum again despite the fact that I too wanted to buy a property on this development.

Hi I have just spoken to EPP who are my Agent and they have put me in the picture.
There was truth in the rumour that farmers owned some of the land that one of the Golf courses was going to be built on.
San Jose purchased all the land apart from one small section about 12 months ago.
The small section was owned by one farmer who was haggling over price. He eventually sold 6months ago.
San Jose now own tha land and have licences to prove this. My agent is putting a pack of licences together for me to view and I should have these by next week.
The reason for the delay in build is like UK. The site needs to be inspected prior to building consent being given, this takes time but is a formality. Once the site has been inspected the licence to build will be granted and building can commence.
There is no question about whether the building can legally progress. This is my understanding. Once I have more info I will let you know.
I will also suggest to my Agent that they post their info on the forum.

Hi All
Linda Needham has posted on Yeclaserve that the documents to raise are on view in the Ayuntamento in Jumilla
So if there are no objections we may see a bit of action in the new year as they have to be on view for a month

Yes, I feel that everyone not issued with a Bank Guarantee should be concerned.
No BG's have been issued for over a year with some purchasers waiting sinse 2005.
All promises from San Jose to me on this issue have been broken and thay have acted in total disregard of the law with no professional honesty or integrity and by association I feel I cannot trust any statement SJ issue.
