I previously posted a thread regarding sewage smells in ground floor apartments and on a visit to our apartment last week the smell was just as bad as usual. We have been trying now for approx 8 months to get the issue resolved but have had absolutely no luck with the builders to come and rectify the problem. I have arranged appointments twice with the site office for them to send someone down to examine the situation and have flown over twice but on both occasions nobody showed up. When I was there last week and nobody showed up I decided to investigate the problem myself and get a plumber in and he was able to tell me the problem before he even came out the problem is that they don’t put water traps under the bathroom sinks and as this is connected to the main sewer pipe as soon as someone flushes a toilet in the block there is a puff of air the returns back up and out the nearest outlet which is in fact our bathroom sink. We are now having to go down the legal root to get this rectified as it’s our last option. It not only is rotten to smell but MUST be un healthy to have those toxic gases coming into our bathroom
This problem is so bad that the previous time I was there we actually had to move out and stay in the sunset beach so for those of you that have not signed for your apartments yet check that there are water traps under your sinks for your snag.

THANK YOU FOR POINTING OUT THIS PROBLEM WE WILL ADD IT TO SNAGING BUT WHEN THAT WILL BE I DONT KNOW WE ARE PHASE 4 BLOCK 2 OUR SOLICITOR KEEPS SENDING US E.MAIL TELLING US MAYBE WE SIGN NEXT MONTH BUT HE HAS BEEN DOING THAT SINCE LAST MARCH THE LAST E.MAIL TELLS US DECEMBER BUT WE THINK ITS MORE LIKE 2008 BEFORE ANYTHING GETS SORTED HE HAS NOT RETURNED OUR LAST E.MAIL WERE WE TOLD HIM WE WERE TAKING LEGAL ACTION ABOUT DELAY AND THE FACT OUR APARTMENT IS NOT AS IN SALES DISCRIPTION AND PLANS DISPITE THE FACT IT IS VERY NICE

My friend has an apartment on phase 1 and she has the same problem as well as being over run with little black drain flies coming from the bathroom air vent, the person in the apartment next to her has had an over flow of toilet waste in the house and the smell in my friends apartment (in the kitchen) is very unpleasant. He decided to dig part of his garden up, dig under the terrace, which is hollow!! where he found a broken sewage pipe. Nobody would take responsibility e.g Pepi from Arenal or Preinier Sur, so he decided to denounce Pepi at the town hall. This has got people moving and hopefully the problem has been resolved. Whilst in Spain I was also informed by Preiner Sur that they are not releasing the apartments until the whole of phase 4 is complete. I`m not sure how valid this is as the information is changing by the day.

Was this the sales office or the head office staff of PrieneSur that said they would only release the whole of phase 4 when all the apartments are complete ?

if what sef has been told is true i for one have no intention of waiting untill the end of next year for apartment as we have allready had to pay for a valuation twice on our apartment so this is money down the drain and making a third mortgage aplication is not on we will pull out of phase four block 2

Hi Sef/Babe,
I hope this is not true,I had though they were trying to release blocks 1-3 first.In another forum arenalgolf.com the bantam a member is living onsite in phase 3 and keeps a daily log of whats going on and according to last friday they had fenced off the golf course from the front of blocks 1-4 and cleaned up the road/pavements etc.The cost of the mortage valuations as Babe has said should be paid by the developer as they are the reason why more valuations are needed.We asked our solicitor to lodge a claim against the developer for the cost of renting past August 07 as this was the agreed extension for our apartment in block 7.We have been out in October,will be out December and March and May 08.

With the greatest respect to all concerned why should Antonio in the Technical office be any more reliable than any other source of information?
If what Antonio said proves to be true then it is likely to be the result of a decision taken by the local council rather than the developers, since they have just notified purchasers in some Blocks in Arenal Duquesa, the other site sold by Arenal 2000 to Caja Sur , of their completion dates in January (see the Arenal Duquesa Forum on this web site).
Our own observation of recent developments on the site doesn't substantiate what Sef has been told although we are well aware that on past performance anything could happen!

It is in the best interest of Prenier Sur to complete as soon as possible, they said that Gerens are in negotiations with the town hall to try and release the blocks as previously planned.

Hi sef , babe, neutral and others,
We received an email from Lawyers of Spain today which said;
"According to the update the developers sent us on Friday, they expect to receive the Inhabitation Licence for the first three blocks by January. They will then be in a position to deliver the properties during the first quarter of 2008. As soon as the Inhabitation Licence is delivered by the Town Hall, the developer will send a notification giving the completion timescale so clients can have the time to organise their mortgages, paperwork etc".
From what we have read on the Arenal Duquesa Forum this is what has happened on that other Prienesur development.
The difference would appear to be that the Benalmadena Town Council appears to be rather more "picky" than that in Manilva.

Thanks for the update lets hope the licence is granted in January for the 3 blocks.It would also be nice to see some progress being made on the promised facilities around the site too.keep up the good work.

I THANK ALL WHO HAVE POSTED INFO ON THIS SITE. BUT WE ARE STILL ALL BEING TOLD DIFFRENT EVEN OUR LAWYERS . WE WERE AT THE DEVELOPERS ON SITE OFFICE IN JULY AND WERE TOLD FACE TO FACE THEY HAD THE LICENCE FOR 1.2.3. IN PHASE FOUR AN AS SOON AS THE SIGNING FOR THE LAST OF PHASE 3 WAS COMPLEATED . THEY WOULD GO ON TO PHASE FOUR. AS HAND OVER HAD TO BE COMPLEATED BY END SEPTEMBER
WE LATER MET WITH OUR LAWYER WHO ALSO CONFIRMED THEY HAD THE HAB LICENCE AND WOULD START TO SIGN IN A FEW WEEKS TIME BUT THEN UP CAME A PROBLEM WITH SEWAGE THAT TOOK WEEKS TO SORT OUT AND ONCE THE WORK WAS COMPLEATED A FUTHER LICENCE ON THIS WORK HAD TO BE ISSUED THIS IS WHAT OUR LAWYER TOLD US . IN A FUTHER E.MAIL 3 WEEKS AGO HE INFORMED US THE SIGNING WOULD BE THIS MONTH . WHY ARE ALL OUR LAWYERS GIVING OUT DIFFRENT INFORMATION WOULD IT NOT BE BETTER FOR DEVELOPERS TO POST UPDATE ON THIS SITE SO WE WOULD ALL UNDERSTANT WHAT IS GOING ON . AS EACH MONTH WE ARE GIVEN A LIGHT AT END OF TUNNELONLY FOR IT TO BE TURNED OF
