Hi,
We are buying on phase 4 block 2 and as most of you know blocks 1-3 have a completion certificate from the architects "Scarper & Leggit PLC"
Just got off the phone to our lawyer regarding the habitation license, she said that the documentation the town hall has received from Arenal is the prelimanary paperwork and not a full application, therefore was unable to provide me with any idea at all as to when the apartment can be handed over.
Has anyone heard differently?

we were told the in july by our solicitor that licence had been granted but after reading the last post i got in touch with with office and spoke to Pepi and he confirmed that everything is ready for blocks 1/2/3 on phase 4
all the apartments have been cleaned and they are waiting for developer to give them the go ahead to inform the notary to start the signing as this must all be done before october
at this moment they are handing over the last of phase 3 and will start phase 4 in a few days time

Thanks for that Babe. It certainly confirms what we have been observing on a daily basis over the last couple of weeks. There has been a lot of activity around those 3 blocks, pool areas mowed and weeded and windows and doors open. The pool itself however has not yet been emptied and cleaned.

I was told today by my lawyer that it will probably be 2009 before Phase 4 is completed and released (by a reliable contact in Gerens).
The licenses will NOT be granted before a year, believe me. Instruct ´Soraria Camacho´ in Gerens to cancel and claim refund under bank guarantee at 034951295151. Take your money and run away

As our apartment in Phase 4 Block 2 is alledgedly complete we are unable to claim on the bank guarantee as it is no longer valid!
When you say the license will not be issued for a year at least, does this include blocks 1-3? or do you mean the last block of phase 4?
A previous post had said the developer will not release any blocks till all of phase 4 was complete.
If the last of phase 4 will not be ready till 2009, what about the club house, driving range & golf course?

With the greatest of respect Natoj I would question why your lawyer's information and that of your Gerens contact is any more reliable than that coming from anyone elses lawyer or Gerens contact!
Some of we Phase 4 purchasers are actually living on site and are happier to rely on the evidence of our own eyes than the rumour and supposition that seems to be coming from all quarters.

To natoj and all - if we take our money and run .... can we bring it back out of spain - are there any legal implications attached? What costs are likely to be incurred ?
Has anyone contacted gerens to pull out ... what would we get back ? also would we incur further lawyer costs to enable contract to be closed .... there are so many quuestions - has anyone done it ?????

I also am awaiting completion in Phase 4 - Block 2.
I would not expect there should be a problem taking money out of the Spain for a returned deposit.
I am also very interested - is anybody actually getting their deposit back (with the 10%) or is this realistic.

I think the general approach by the solicitors is you can get your deposit back,but if you want the 10% you'll need to take the developer to court and hence more legal fees.So is the hassle worth it for maybe 5000 Euro.The solicitors/developers has this well boxed off.

Hi All
I got a call from Andulician Dream Homes a few weeks back and she said they cannot sell the property's on their books for Arenal Golf but because of the ' situation' couldn't remove them either. Not completely sure what she meant but her comment was it was a good development if they could just sort out whatever hte problems were. Unfortnately we cannot afford to wait 1-2 years which is what it is likely to take for our apartment on Phase 6. Our lawyer has instructed us that as of 30th Sep 07 we can claim our deposit back with the 10%. We have instructed him to do this when the 30th arrives, so I am interested to know if anyone has got there money back yet! And I will keep you posted how we get on.

10% seems to be a sum that might be achievable if you go after the developer.But this seems a long draw out process,and is not always achievable.It seems a lot less problem to claim back your bank guarantees if the developer has failed to complete on time.

Hi All
John ( a guy who purchased on block 3) emailed us on tuesday to say his solicitor had recieved a cheque for his deposit he cancelled in July so that didnt take to long, not sure whether he got the 10% or not, will ask the question though.
