Hi Everyone on Thalassa,

My name is Noel and we have recently purchased on Thalassa.

Could anyone assist me on the following topics;

Our bank are withholding 945 Euro because they are awaiting the cancellation of the builders mortgage, which we never took out, does anybody know how long it takes to get this money back??

Also, as many of you also have had snagging problems, can anyone assist me in getting the Air con heating working??

Hi Noel,

Maria had to get onto the air con company, who had to order a part that was actually missing from the system.  I cannot beleive that KM did not complete all the rest of the units that must have needed doing. Sorry had no experience with other matter, so cannot comment .

Sorry about your negative experiences,

I had a similar experience regarding the with-holding of funds from the builders mortgage. I didn't take out the builders mortgage having arranged a better rate of interest from an outside source, however, on the completion day my mortgage company advised me not to sign anything until KeyMare had repaid ALL of the monies outstanding on the property. My solicitor said that this was normal practice in Spain, but my mortgage lender was having none of it!! We walked away from the table at the Notary and more than four hours later (after many frantic phonecalls) the money was fully repaid and the deal went ahead, I have been told by another owner that KeyMare did repay the monies within two weeks when a similar thing happened to them.

Regarding the air-con working on heat......have you checked that the control is showing  a sun instead of a snow-flake? I know that they look very similar, and it is rather obvious, but I have made the mistake without my glasses on!

Our lender withheld 975€ from us for builders cancellation, even though we ensured our solicitor had it in the paperwork that Key Mare should pay the money at Notary. Apparently it can take up to 3 months to get a refund, even though the sale should be registered with the land registry within 30 days (I think, or less). We emailed our lender every day and also had a complaint ongoing with them, so they refunded two days after completion.

It is amazing that lenders and developers still allow this to happen, given that the charge is an illegal charge under Spanish law and has been for some 20 years!!

Badger your lender for the refud. Check with your solicitor to see if he has the land registry documents and a copy will also be sent to them.
