Hi All,

Unfortunately, due to the withdrawal of self certification mortgages in the wake of the 'Credit Crunch' I could not complete on my apartment in block 21, second floor. I paid my 30% deposit in 2005, and had an insurance backed indemnity included.

On 18th January this year, Keymare cancelled my contract, sending me a notarised letter to that effect. Although it was typed out in English,the contact email apparently could not speak English.  I was told that the promissary notes/cheques were available from the notary's office in Vera (no address though). I was in a tiss, as I would either have to come over from the UK or have a Power of Attorney done in favour of my lawyer, and after loosing over 16k euro penalty I felt strongly about loosing even more!

 

After many emails, and phone calls, Amandine Cano had a private cancellation contract sent to me as an attachment, I sent the contracts by post, as the Keymare legal team did not acknowledge that scanned documents are legal. (More time delay) Then, due to silly me writing in English at the bottom of the documents that it was purely due to not being able to finance the purchase that I could not proceed...the private contracts were voided. (The last clause stated that niether party would take legal action over the situation. I rang Amandine in mid Febuary to be told that I had to resend the contracts without the writing on...I have suffered severe depression and, through sheer frustration, put the telephone receiver down.

 

Amandine has now moved from 'Customer Services (?) to Sales, and I sent many more emails to Ana Maria, but, due to poor English presumably, got no response to any of them. I resent the new signed contracts on 19th March......I eventually was told to speak with Maria.

Finally, last Monday, I was told that I would now loose ALL my deposit...even though I have it in writing that I will be penalised 30% of the original 30% deposit. Maria would not answer emails and I have not had written confirmation of the change of heart. However, I do have a notarised letter saying otherwise. I have lost a small fortune in Spain, granted due to gullability and naivity......the domino effect..........Maria appeared to take great delight in causing me pain.......my dark cloud of depression is gathering again...thanks to Keymare...the one developer who I thought was above most of the many corrupt ones over in Spain!

Any helpful comments, or guidance gratefully received!

Really sorry to hear of all your problems.

I would suggest that you go onto the general forum & put your post on there or PM Mariadecastro.

Maria is a Spanish Lawyer who gives great consumer advice & she has also acted for other EOS users in getting deposits repaid. I am sure that if she cannot help you herself, she will be able to offer some advice on what your next course of action is.

Contact maria de castro NOW!!

Maria is constantly responding to posts saying that to keep 100% of you deposit ( 30% of asking price) is abusive under spanish law. I am sure she will be able to help. Even if she cant, ( which I doubt) she charges nothing for her advice, and is honest about the probability of success ( we have communicated with her -only wish I knew of her sooner- as we would have had a better outcome)
