Hi, I thnk I have just inherited my late fathers appartment in Spain.  I have a legal document called 'acuerdo de alteracion de la titularidad' - I did a google translate and I think it is the entitlement to the property but not 100% sure and the only people I know who speak Spanish are in Spain and I am in England.

Also banks say they need an 'escritura' before they can release any funds - what is that and where do I get one from?

Any help gratefully received.

This looks like a good website so think I will be on here quite a bit,

Tracey

You need to get yourself a lawyer to deal with this, if you have inherited here in Spain there will be taxes to pay etc !!  The escritura is the title deeds for the property, perhaps your father had a lawyer or fiscal rep here that maybe able to help you.

Trixitrin: The document is the notification of the Catastro ( Official registry of properties) on the change they have made regarding holders of ownership rights on the property.

Did you already go through probate procedures in Spain?

The escritura the Bank is requesting is the Notray deed of the acceptance and award of the inheritance.

Hi

Thanks for your help, I have indeed been through the notary and gestor and paid a substantial amount of inheritance tax and did think that the documents I recveived were the change of deed acceptance etc.  I will now contact the bank with these and see if these are the acceptable documents for them to proceed with the release of the bank account funds.

I will shortly need support when selling the property but do not envisage that being for some time.

I have to say that it has been an eye opener going through the Spanish legal system as it is somewhat different from England.  Thankfully I had an interpreter to help.

Thanks again for your help.

You need to look for " Escritura de aceptación y adjudicación de herencia"

Good luck and keep us posted!
