I thought you might be interested in the email I sent to Diana:-

Dear Diana,
Re  The EU - PROTECTING THE RIGHT TO PROPERTY -
SEMINAR

What  use are new EU laws when  a country such as Spain is
so institutionally corrupt that it's own consumer law  is flagrantly
ignored by it's lawyers and judges?

Even where a judge awards in favour of the consumer the financing Banks
and Developers behave like stubborn donkeys and ignore the judgement or
refuse to pay up. No-one makes them answer to the law, they appear to
be beyond it!!

The number of appeals and resultant backlog of cases  in Spanish courts
has resulted in Developers and construction  companies asset stripping
the company before the judge has got round to deciding the outcome of a
case, leaving the consumer penniless.Their bankrupcy laws are a
joke.

Don't tell me the Spanish government is unaware what has been going on!
It has been complicit by being ineffective in compelling the Banks and
Developers to honour the consumers contracts.

If you read the comments given by over 1100 victims of the Spanish propertyscandal on the link to the 'gopetition'
page below, it will provide you with more than enough evidence that change is required.

Withholding EU funding to Spain would be an excellent start and might
focus their minds on arranging refunds and compensation for those
swindled.

I am a retiree as are many of those swindled.
My personal loss stands at in excess of 100,000.00 Euros and even
though a judge has ordered Banco Pastor to re-imburse me they have
completely ignored him.

Spain will boast of all the laws it has in place to protect the
consumers but in truth they are useless, toothless laws which are easily
brushed under the carpet at the sight of a brown envelopes.

Spain and I suspect many others are just not fit to be in the EU.

As seen with the recent cucumber debacle, Spain is at the front of the
queue to get compensation itself from the EU, but when it comes to
paying out to those their government has failed to protect it just will
not pay up!

It is a huge problem and urgently requires investigation.Good Luck to
you all.

Yours sincerely, and as long winded as ever,

Sandra X XXXXXXX

P.S. Do you think that notice of property releted seminars and such
like could be sent out earlier? Many of us would have liked to come to
Brussels for the meeting but short notice prevented us organising it.

This is the video from the seminar on property rights that took place on June 14th. It is two and three quarter hours long but it raises some intreresting points.

I have since written to Diana Wallis MEP who chaired the seminar (she is the vice president of the European Parliament) to query the aspect of member state competence and the systemic failure to enforce legislation, also the issue of a compensation fund, and will report back as soon as I receive a reply.

For those wishing to make contact with her, her email address is diana.wallis@europarl.europa.eu
