Thank you all. SOLVIT very helpfull see below.
It is Ana Iglesias, from SOLVIT Spain.
I am very sorry for the problems your wife suffered to get a visa.
Once your wife is in Spain, she has to apply for her residence card in the Foreigners Office of Alicante before the expiring delay of three months of her visa.
If I have rightly understood she arrived on 24 December to Spain, so she has to apply of her residence card before the 24 March.
If you happen to have any problem with the marriage certificate when applying for the residence card, please let us know. If the marriage certificate has been legalized on the 8th October 2012 by the British Consulate in Bangkok, and then accepted by the Spanish Consulate, you shouldn’t have any problem.
We have discussed with the Spanish Immigration Authorities on validity of the certificates. They have agreed that the rule of 3 months of validity is not applicable to those cases.
Accordingly, you can enter a claim in case you have any problem with the issuance of the residence permit.
Kindest regards,
Ana IGLESIAS
