have you triedro sue the Bank in which you dos the avances payments? It's be comino a good option as Courts are ruling in favour of buyers and against the Banks that didn't provide BG or checked other entity has provided them to buyers.

Good advice, you will have a lot more chance taking action for the return of your deposit against the bank rather than the developer.

Our legal advice has not been the best. The company came recommended by a property expert from channel 4. They need a rocket up them and all we have done is throw good money after bad!

The Courts are changing to a more open-mind in order to state Banks' liability for not guaranteeing (or check the guarantees) for the paid amounts.
So, now there's a reliable way to get the monies back.
Our advice for you is to sue the Bank (unless you have a BG or appear in the report of the AACC as "guaranteed")

I really do not know. I have contacted our Spanish lawyer to let him know of the urgency and he keeps promising to get back to me but never does. I think the best thing is if we change lawyers but he might drag his heels sending paperwork to a new lawyer.

Two routes ahead:
1) Action against the bank under Law 57/68
2) If you used a lawyer, proffessional negligency action
You must also get your credit registered at the Creditor´s meeting procedure
