IBI on static caravans

Hello All

I have been an EoS member for some time but have not signed on for quite a lomg time and cannot remember whether this is my first post or not!  Thank you for reading this anyway and I shall be grateful for any response.

Recently, I purchased a mobile home on a park inland from Malaga and was told at the time, that IBI was not levied on mobile homes as they were classed differently. Since then, I have received a letter from the park owner to the effect that we are now liable due to a legal decision.  As I understand it, the park owner will collect the tax and then remit it to the authorities.  Is there anyone else in this position?  It seems to me a rather odd and egregious decision considering that a mobile home is not freehold and is the subject of a licence to occupy and not  a lease or a title deed.  Having said that, might paying the IBI give the home owners a more secure position and greater recognition given that park owners currently have a great deal of control over disposal of the homes and can make arbitrary decisions without there being any apparent recourse to mediation?  Finally, ought the mobile home owner to be paying this tax directly to the authorities rather than via a third party?

I have done a few searches and it seems to be that some pay it and some don’t, so I would suggest you contact your town hall, probably only they can give you a substantive answer for that municipality. .

I would not think that an owner of a park would lie about such a thing as that would amount to a very easily provable criminal offence.

If the law has been changed as you have been told, I don’t see that as a bad  or outrageous decision.  People living in any permanent home pay whether they own or rent.

The law is often hard to understand.  Example:  In USA  so called mobile homes (RV’s) on private land, parks etc.  which are bricked into place, very permanently,  with flower beds, plumber water and sewage etc. have to pay the State number plate renewal registration tax (Road tax) every year.

Why not take the letter to a solicitor or an accountant or the tax office

What about other owners?

Ask the land owner if you can pay it direct and give him a copy of the invoice

How much money are you talking about for I.B.I on a caravan to give you a idea what l.B.I cost on a larg Villa on a well kept urbanization with 3 beds 3 bathrooms and a swimming pool is 375 EU per year a good friend of mine has a Villa on a gated complex the fee for the upkeep of the complex is 400eu per year and the I.B.l is 125eu per year the I.B.I is paid direct to the tax office.

Just as in UK, the IBI varies considerably from municipality to municipality.  Other fees also vary.  My son has a an apartment on a gated complex, with 4 swimming pools, 24 hours guards etc, his community fees are around 1.600 p.a. for a two bedroomed apartment. 

A large villa in that municipality would have considerably higher charges than  those quoted by Windtalker.

I don't see how you can pay IBI without a cadastral value or reference number. Normally the site owner would pay the IBI for the whole site and then charge a ground rent for the plots to cover the services, water, rubbish collection etc. 

Your local council would be the only ones that could issue you with a IBI bill so beware of what the site owmer says
