Thanks for all your replies. This has complicated things with Brexit looming. We'll have to try and work out what's best - a crystal ball would be handy!

This was thanks to a sentence of the European Court of Justice that made it illegal for Spain to charge residents in any European country more than Spanish nationals. The sentence does not stop Spain from charging more inheritance tax to non European Union citizens.
When Brexit take place non-residents of Spain that are residents in Britain that inherit a property in Spain will not be entitled to claim any of the exemptions that are offered by each autonomous region of Spain which represent the major part of the exemptions and have a huge effect on inheritance tax. Presently these exemptions allow many close family members (spouse and descendants to not pay any inheritance tax in Spain)
Looks like that is out of date now.

Yes it might be out of date if what the supreme Court declares has in fact enforced a change in the law, But this is Spain, has it? Would you invest all your money in a ‘’should’’?

Actually, neither of them. The Spanish Congress makes the laws. The Courts interpret them, the Government enforces them.

If the law suits the government, probably, when it gets round to it; if it doesn't, probably not, at least until forced to by the courts. And then you have to consider the autonomous regions (mis)interpreting things differently. Would I invest all my money in a "should"? See my avatar!
