Good idea Rixxy, it's worth a try. And good point Smiley (is there anything we don't agree on?) Think of the ethics. Do unto others etc etc. And think of the future. If you are happy with this lady, you may wish to use her again to sell in a couple of years time. If she has done a good job for you, she deserves her cut. I suppose you could just call the seller to check if she did ever put your offer to them, though.

Oh no!!! You have me worried now Smiley when you say 'acid on the car etc!? We have just bought our 'dream home' (paid 10% deposit yesterday and complete next week). But it has been a NIGHTMARE purchase! There was a top name very large estate agency involved acting for some other buyers we were competing with but it came through for us in the end! But now this agency is very p----d off to say the least and they know we are the competitors and they are already making 'threats'! The worst of it is the manager of branch involved lives on the same urbanisation!!! We have 2 dogs and that is what worries me!
Re buyers market inland our property was valued at €400K and we are paying €300K, we really fought for it as we know it is a good investment!!

How much under the asking price did the seller agree to?
Are you paying any black money?
Is the seller Spanish or another nationality?

Doh! Well, I´m happy for you Sharon, but that wasn´t what I was hoping to hear!
I was hoping for "seller wouldn´t knock anything off the asking price" & "wanted loads of black money". I´d have felt like I was in good company then!!

Hi Anne,
If it's any consolation, the only 'cash' money I am paying is to the agent - I did not want to include the agent fee in the selling price. It is bad enough paying whopping commission (I got him down anyway) without paying tax on it too!!!!!

Well, it is now more than a week since I put forward my offer for a property and I am even more convinced than ever that the agent is not passing my offer on to the seller. WHY?????
I have offered 12,000 euros less than the asking price (knowing full well that it would be refused, but you have to start somewhere right?). At the time the agent said, "oh the seller will never accept that". I said "ok, but offer that to start with and let me know the seller´s response". SILENCE. I have called and sent two emails to the agent. STILL SILENCE.
Is the agent just waiting for me to offer something that she considers sensible before bothering to call the seller? I don´t plan on raising my offer until I have heard some kind of response from the seller - maybe he is keener to sell than the agent thinks?
This is soo stressy! Why can´t it just be simple?

Its never simple and I think the agent is already telling you the answer in her own way. She has made it clear that the vendor will not accept the offer - as I have mentioned before the Spanish always reluctant to drop prices. For example you may know already but there are a huge number of Spanish landowners throughout Spain that have had land passed down generation upon generation. It is on the market for sale at 500,000€ for the land in 2006 - when we move into 2007 it will automatically go up in price because we are now in a new year. Assume they had a buyer in November 06 at 480k for the land and they declined but now we are in March 07 and the buyer comes back and says ok will buy it for the 500k, the likely reply will be sorry the price is now 530,000 owing to inflation. They are not of the nature "a bird in the hand is worth two in the bush". I suspect that in this case silence is not golden and the agent is likely to proud to get their head chewed off for showing them such a "derisory" offer when it is already the lowest priced on the market - if it is your dream home as you said before you will need to swallow your pride before they do I think.

Just another observation, as I happen to have my company lawyer in the office, he tells me if your lawyer rings the owner and finds that the estate agent did not pass on your offer then you can deal directly with the owner and save 1.5%. The agent will have been negligent on your behalf if they did not make your offer to the owner and so you could get out of the agreement you signed with them, maybe even sue them!! Nice thought ehh!! Anyhow.. get your lawyer to ring the owners first.

Yes, I do have the seller´s phone number, although I am nervous about going behind the agent´s back. Especially when you read all these stories about acid being thrown on cars, etc. On the otherhand, I have sent two emails to the agent with my offer so I have proof that I have attempted to deal seriously with the agent. She didn´t even have the courtesy to respond to either of the emails.
Do you think a first offer of 12,000 euros below asking price was too stingy of me? Sharonw stated earlier she got a full 80,000 off the asking price - and that was where she ended up, not started! And then I hear/read articles about "the market being 30% over priced", "prices are going to drop/crash this year". Should I play it cool and hang on? Afterall, the house I love is on an urbanisation so there are something like 300 other identical houses!! If I lose this one, it stands to reason another one will be along sooner or later.
Gillespie - a lawyer hasn´t checked the deeds, etc yet because I haven´t agreed to buy the house yet. Aren´t all of those checks made after deciding to buy the house, but before signing the contract?

Jerezgirl, Smiley's comments are spot on as usual, except that I think you said the seller was German? Either way, I've been following your story, and I agree wholheartedly with Gillespie here - if the agent is not doing what you ask, cut 'em out, they don't deserve to have your business. Call the seller, apologise for the direct approach and the breach in normal procedure/ethics, but explain that you are worried that the agent is not acting in the best interest of either party, and take it from there.
I had an exact same scenario a few years back, cut the useless agent out, completed the deal direct and everyone was happy. The useless agent never ever got back in touch to find out if I was even still interested in buying anything. Go for it, girl! And like you say, if it doesn't work out, there's plenty more out there to choose from. Nothing ventured.......

JerezGirl....I need to get my head around this. It´s best if you get your lawyer to check out the property before you consider an offer. Or I don´t see the point in getting all excited as it could end in tears if the property turns out to be a dud. As an agent I usually have my clients make an offer through their lawyer so that the client is fully aware of what they are making an offer on. i would hate to see you dissapointed after all this effort and hope. The reason why many people are caught out here in Spain is because they employ a lawyer afer they have bought. Lawyers should be employed to help with conveyancing and not to sue the estate agent for selling dodgy properties. Despite all the wisdom on this forum i still cannot believe you haven´t had the property checked out by a lawyer first!! I am posting this from home and don´t use internet explorer only opera so I can´t add smileys, formatting or paragraphs to show I´m only trying to stop you making mistakes. please take this as genuine advice, I´m not getting on at you. ;+) ..There u see the best cuddly bear smiley I can do.
