Hi all,
Just to let you know, I have made exhaustive searches on the question of BG'S, and according to Maria de Castro BG'S have no expiry date. If the date is written on yours as it probably will be, under Consumers and Contract Law it is an abusive clause causing it to be null and void and therefore it is illegal. BG's are to be in force until First Licence of Occupation is granted. Whatever the law states takes precedent over whatever abusive clauses these charlatans have had written into them. So if anyone out there has found themselves in a position where the Bank has refused to honour the Guarantee because of expiry date, just represent it. Do not be afraid to exercise your legal rights. I sometimes wonder how many Spanish lawyers actually know the law in depth, or are most of them merely conveyancing lawyers, just being aware of the generalities of property law and not the finer points, or are they actually colluding with the Banks, or are they afraid of them.? I will never understand the Spanish mentality, but one thing I do know, the law on BG'S is clear and unambiguous, there is no room for misinterpretation by corrupt judges or lawyers, so go kick some ass.

That is so interesting to read. After being in this ACC debacle like many others for a few years this is the first time I have read this about the legal side of a BG.
I do not doubt for one moment what you are saying and this will be some VERY welcome reading for many people concerned about dates on their BG.

Hi all, I agree with the info being givenm out here. I visited Aldea 6 weeks ago and asked for my BG but they refused to give me it unless I cacelled the contract and paid them more money, I refused point blank and insisted on them giving me the BG as it is mine, after arguing with them for 30 mins or so (and shouting at them) they went and got the originals for me without payment but it was only because I stood my ground and I was aware of my rights due to someone posting a similar email on the ACC site, thanks whoever you are!!!
So, stand your ground and demand what is yours!!!

Not going off the point but can anyone tell me, how it came to pass that Aldea lawyers (mine included) managed to act for so many people and gave the go ahead for their clients to act, especially when there was no planning in the first place...Dooooooh!... I mean surely as qualified lawyers they must have known that there was no planning there. Can anyone tell me what agency or lawyers are acting for HUMA.....By any chance would it be..........Aldea?
can anyone tell me what is happening with paraodr Properties at the moment. From what I understand their UK branch and the Spanish branch are according to UK two separate companies and UK are wasing their hands of the situation.
PS: I still dont have my money back/

I questioned my solicitor fuster +co, as to the high costings of the legal work to purchase on Acc, they informed me it was to ensure that all the criteria was met and all legal documentation in place and we would not be instructed to transfer monies unless everything was correct and in place !!!????
Maybe,just maybe i should of payed him more money,,and save myself thousands.
