I'm not sure how many owners from La Reserva look at this forum, but there must  be more like those of us who are fed up with the large number who are  not paying community fees. With this in mind if any of you feel that enough is enough  please send me a private message with your block number and Manzana to start with so I have numbers.

I will be going over shortly and will arrange to meet up with one of the Vice Presidents of the Community to pass on our sentiments. I must say that this issue was brought up at the AGM and I think it is the utter frustration of the fee payers that it is so hard to make these people pay up. The legal system is long and expensive(I assume we are all paying towards the legal action) and it appears it is difficult to pursue those who live outside of Spain, which seems a bit strange as the banks in Spain are now chasing people all over Europe for their assetts to pay off mortgages due to people having to give up and hand back their keys. Non the less we were told at the AGM that there are legal processes in place.

However looking at the list of debtors it is apparent that a lot of people who have completed on property long before the block 7 fiasco have not paid a penny, they all can not be p.....ed  off with what they ended up with as Erin Mayo suggests.

I did actually sit and complete the Community questionnaire for Justin and I had to give up trying to add up the outstanding fees for our community, on average missing out the "small amounts" and averaging it up  it added up approx to over 400,000 euros . You could do a lot of gardening, cleaning entrances, securing more areas a\nd cleaning pools + rooting out undesirable long term renters and making owners take more interest and responsibility for who they are taking their money off. 

Given that the legal side of getting this money is slow there should be a swift reaction in place for anyone who misses two payments and that has to be linked to restricting utilities to the apartment and permant publicity in entrance blocks not just before an AGM meeting. So going back to the start it could be worth a try to let the Administrators know that this is a real injustice to the paying members and they need to try and look at other measures. I have had no answer to my email asking for a date to be set in August this year for the AGM but I will be pursuing this as well when I go over.

Just a thought on Erin Mayo's theory if  his/her theory is correct hit them where it hurts -in the pocket. Why don't we all just stop paying our IBI, wealth/renta/basura tax until they hurry up and give us our licences!!!!!!!!! don't think that will work unfortunately.

p.s. Basura tax is now due to be paid for some us who have been waiting years for them to sort it out, and surprise surprise after being told we would only have to pay the current year when they sorted it out,  they are now asking for 2007 and 2008 approx  332 euros by  October. Never mind we could always miss the next lot of community fees to compensate (joke)

Thanks very much for the information on what a garden is. I hope I can remember this for future reference. However if you seen some of the gardens around La Reserva there is not a lot growing. I remember one owner telling me that his garden had no irrigation laid down by the builder. All it would have took is a bit of pipe work. A GARDEN IS WHERE THINGS GROW..............we are reaching a new low on this thread. It really is getting funny now. Round and round the garden like a teddy..........or round and round the patio like a.................Enough is enough. Stop laughing.

So take it yer still not paying the dues.
I cant recall how many apartments there are on La Reserva but just think what could be done with everyone paying fees and say all posted a sum of say 500 Euros
 to sort the problems.
That would be some fund to bring La Reserva right up to the standards we all want so helping to look after the development/occupants now and so protecting everyones interests in the longer term.
Appreciate that this could be difficult with so many I am all right Jacks but may have to start somewhere even if it is on a block by block basis.
One way or another those that dont pay must either pay willingly now or have to pay in the future,with interest back dated.(Pay or have an embargo placed on your property preventing any sale until its paid)
Then a list should be put together by the management commitees and a name and shame list should be posted in every occupants property .they of course should be refused access to amenties and have NO say in any decisions thats made which effects them directly or indirectly.
La Reserva has one major good advantage and thats the location being one of the main reasons that interested us all in the first place.
With everyones support it could also be one of the best in the area which is what we hoped for in the first place.

just dan   right behind you. The problem i have realised is that Manzana 3 is to big, we have all be set up by the developer.We were told by a certain estate agency(***  that can't be mentioned ) that block 7 was a separate community
Manazana 3 is about 480 units.

 i agree if everyone paid up there communitt fees we would have the money to get things done and even pay less!!! Unfortunately we are the pioneers and untill everyone with cold feet joins the party its not going to change. The ADMINISTRATORS can only case debtors in Spain so all the UK investors are laughing but will have to pay when sold. There has to be a better way to make these people pay,, the developer must have there details.

It seems that we may have a problem ( no not a glass arf  full)

Now is it fact that each block will form its own community,?if thats so then the im alright Jack will spread upwards.
I.E Why should we give a toss about problems on say block 3 when our block is all nice and cosy/no dogs shit/Pikeys or abandoned cars.

Is it a fact that La Reserva is to large and for a central committee to be able to set rules covering the whole community.

Should this be the case we would need to see if anything tangible can ever be acheived in bringing the whole together to the benefit of all.
If we have rules for one block committe and others for the next we could just have a little ole conflict on interests.
For one I am aware that one person has 10 apartments and lets them out and ask would he give a toss as long as rents are paid.

Now I for one would welcome any postings/suggestions .

I have one for consideration.

All ligtweights that take the p-ss who dont pay fees are transfer to say Block 3.
Then we could use the dosh from the others to build a massive wall a bit like Berlin Wall and put in a small entrance for dogs to go crap in.Cats as well and even humans caught short afer a few beavies)
A large crane to dump the cars over the wall and the rubbish built up in front of one or two properties
No doors to the pools.
No trees or plants/no grass and no one attending gardens
No security Etc Etc


SOoooooo .You dont pay then no problem for you me ole son  .The La Reserva Supreme Court sentences you to transfer to cell Block Mezzanine 3.
Oh no I hear them cry Anything but that.please let me pay.

Well thats sorted then.problem solved

Hi Dan, You have got me all wrong, I never said I was witholding community fees, mine are paid in full. I was just trying to understand why so many had not paid and the reasons for same when everyone came running at me. In a ways I was trying to reach out to those people to bring them around to pay their fees without shouting at them. All of a sudden I was a coward, romantic and whatever else. I have never seen so many non payers in a community and I just simply wounder why? OK shout away everyone and see where it gets us or try the middle ground for a change.

Well dont know how that one went off course then but think it touched a few nerves,
Lots of stress by lots of people and emotions do take over at times and cloud facts.

SOooo many really good guys and gals that  want and need this all to work in these tough times and  those that wont stand up and be counted should be bought to account.as the party is over.

Time to stop the negative crap as its Sooooo worn out and itf thats anyones bag then hopefully others will agree that they sod off.
Time for any valid problems and views to be put forward and constructive replies I am sure would be welcome,( May be not but that my opinion anyway )
Time to sort the future of La Reserva and other developments on the Costa del Sol as you cant do much about the past.

keep it going Dan     we are only going to improve our lot if we all talk and perhaps use our collective power to pressure the developers/administrators to get things done. Attending the AGM sadly seems to be a waste of time!!

Yep the A.G.M thingy is what concerns me for reasons in my previous posts ( to many with self interests I fear,)
The one thing is for sure that we need to get as many people as possible that think positive and want whats best and get them to out number the lightweights/moaners and those with their own motives.( use the forums for that very reson)
Get these as-holes to be the minority and they are simply out numbered.

Easy really

Serious the need to keep positive and determind to gets thing right is going to be a tough yet worhwhile cause.
