Hi,
I am in Phase 2 and I went for snagging already but I think I will not get the house until August. I also have a colleague in pahse 4 who also went for snagging but he is currently waiting for completion.
I very much doubt that I will have my house ready for this summer as in Spain everything takes for ever!
I still do not like that part of the estate has ecological walls (which I hate) and some parts have the cement facade which looks much better.
Anyway I am just waiting for them to fix all the minor problems which I picked up from snagging and I will hopefully get the house by August.

Hi All,
I went snagging last week in phase 4. Promaga refused to move my deposit from phase 4 to 2 as they would have to pay the bank 50k to settle the mortgage, as I don't want one! I had a good look round the apartment and was surprised to find it so small!
They sold me an apartment with a living space of 119.16 M2 but I could only find around 69M2 inside the flat and 7 on the balcony, I suppose the remainder is made up of the space outside on the varanda... although VIVIENDA I have been told is "Living Space" which is on the brochure I got from them.
Th say that Mr Givera is tricky is an understatement! He is a shaddow that sneaks out in the dark, I have been to his office over 50 times and I have never found him available to discuss anything. It is not good not to be able to talk to the man who makes all the decisions, has anybody seen him?
I am waiting for the final licence to be issued, I have been promised it for the last few weeks but I suspect August will be the earliest!
If anybody want to buy a nice 2 bed flat...let me know!!

Do you have a 2 bedroom in pahse 4 or2?
I have a two bedroom in Phase 2 are these bigger than yours?
I have a similar issue to you as my garden area is not what they said it was!

Just heard that Andalucian Dream Homes (ADH) have gone into administration. They were the main agents for Promaga's Vista Hermosa Developments. I wonder what trouble Promaga are in, as most of the apartments in the VH developement remain unsold!
It sounds like long hard fight to get our deposits back if we are lucky.
Any news on LoFO on this phase - anyone?

Hi All,
I am happy that ADH has gone to the wall. Most of the so called Estate Agents here in Spain were no more than a bunch of cowboys. They got so many people into trouble over the years. They all deserve to go the same way, they reminded me of "time share touts" that caught me for an apartment in Tenerife many years ago!
I have pulled out of VH and done a deal with Promaga to buy a house instead in another location, I got 50,000 discount so I am happy.
I wish all the people who bought there the very best of luck in the future. I know that some of you have lost your deposits and others are trying to get their deposits back through the courts...good luck with that.
To the people who contacted me through private messages, thank you for your input, all of it was useful and I think I put it to good use.

Please would somebody Living over there close to the complex or has knowledge of what is happing to the development post an update please. I am particularly interested in if Promaga have/have not yet applied and received the certificate of completion and/or certificates of Habitation?

As far as I am aware this should happen sometime in September as during the month of august Spain shuts down!
I have one in phase 2 but you never know with these people, frankly as long as they do not go bust, and we eventaually get the flats its fine with me (better late than never).

Hi all
I would appreciate it if someone could give me an. I put down a deposit for phase 4 of VH in 2007 and from reading this forum it appears that things are not going particularly well. In the last few months I have correspondance from a law firm who are offering to represent buyers in an action against the developer but the fee required for this seems to be very high and it is all upfront which makes me suspicious that this is another scheme to persuade a fool like me to part with my money. Does anyone know if there is likely to be much success with such an action, ow long it could take, would there be extra cash calls along the way etc
To add to the urgency I've just had a call from the developer this week who are suggesting the phase is nearly complete and want me to go and have a look to compile a snagging list. Has anyone had any success i renogotiating the purchase price with the developer?

Has anybody been around the development lately ?
I have had a phone call from a promaga office girl telling me the site as now been cleaned up.
also I have been told that the L.oF.O has not been granted because of more work required to supporting walls
can anybody confirm this.

This is what we would all like to see, the supporting walls is the only thing I do not like about the estate. If they are preassured into fixing them it would be great!

Anyone seen this?
Promaga/Vista Hermosa, Hercesa Dona Julia, Altos de Alcaucin and Arrohabitatge/Don Juan are some of the developers/developments which, having read a recent article published on the Daily Telegraph titled Buy-to-let investors backing out of off-plan deals face court action, are now avidly typing their lawsuits. The article goes on to say:
UK Buy-to-let investors reneging on off-plan property purchase contracts need to be aware that they risk losing more than just their deposits, warns City law firm Wedlake Bell. It said “hundreds of buy-to-let investors have already been pursued through the courts for trying to wriggle out of off-plan contracts’”.

Depends how you look at it. On one side you have a greedy "investor" backing out of an agreed contract. On the other, you have a lifestyle buyer cancelling the contract because a developer has not upheld contract commitments (completion dates etc).
Between the black and white there is a lot of grey !!

When you mean "I keep on calling Promaga but they do not reply" do you mean that they are not answering the question or that no one picks up the phone??

Just got a few minutes to spare so I thought I would go through a few old threads of Dec 08 it would seam we are no further forward , with only the option of litigation payed for up-front without any guarantees of getting our money back, any sugestions. Regards J Bell.

I have heard from Promaga that they have got the LoFO and the 10 year guarantee is in place - so I think they would be asking people to complete soon - they have asked me to finalise my mortgage plans and to complete as soon as possible.
Has anyone got anything to add to this?
There are already numerous people living in the southern parts of the development.

Hi,
I am in Phase 2 and I have already been told to complete, this should be some time soon (April or May) but bear in mind that IVA will go up (1% I think) in July so everyone should try to complete before then.
Just wondering how much percentage wise will be completed within all the different phases?
