When you assume that everyone knows what is happening, how do you expect people who don't use this website to know what is going on?  Perhaps you might extend them, and indeed the rest of us, some professional courtesy and have your directors formally write to everyone to explain the mess.

Also, please have some respect for us and do not lie by suggesting that you will answer any queries.  You are well aware that when it comes to the pertinent questions re. compliance with the law, you simply do not answer and hide behind Baugat Abogados.

Majestic ought to be ashamed of itself.

Majestics role in La Condesa is one of assistance. We are dealing with all queries until such time as the new developer has set up a suitable communication system. After this we will remain in contact and giving updates to all clients who bought directly through Majestic as agents aswell as taking care of their investment portfolio. I presume those who bought through other agencies will receive the same service from them.

An e-mail, approved by Directors of Majestic was sent before Christmas to all owners explaining the current situation. Our solicitors have also communicated with our clients solicitors. By all means, if you still do not understand what is going on, please contact me and I will be happy to explain.

With regards to your statement of me not assisting you and "hiding behind solicitors" ; I am not a lawyer, therefore if you have a legal question it is only logical that I refer you to our lawyers. 

Most owners are enthusiastic about the recent activity on site and what this means for their investments.

If Majestic's directors are not prepared to write to the owners explaining the new situation, perhaps you could liaise with the new owners and ask them to write to us confirming their good intentions to honour our contracts and the specification for the property as laid down in those contracts.

Stephanie - Many thanks for taking the effort to respond to my queries.  Sorry to say but I am still not clear what you mean by "assistance", "dealing with queries", "remain in contact", "taking care of portfolio", "same service", etc. I am sure you have the clients' interests at heart. However, exactly what service are you referring to ?? Would greatly appreciate it if you could explain again - does that mean you will market the clients' properties if they want to resell? or help with completing procedures and paperwork? help them move in? get furniture packages? wait to take Majestic commission on resale? help us get our deposits back if we wanted? or what ? I am sure the other clients are equally confused and eager for you to clarify as I am. Thanks once again.

There is no change to your contract as these contracts where originally done in the name of Sol Mijas Developers S.L  (Not Majestic) The new owner has acquired the company Sol Mijas, therefore it is not optional or good intentions as to whether they are going  to honour your contracts or technical specifications, or not; its a legal obligation. The ownership change of Sol Mijas SL is irrelevant to your legal contract.

Perhaps I could try to ask some very simple questions, which do not require any of us to be lawyers:

1.  Spanish law requires developers to provide all buyers with a bank guarantee at the time of signing the private contract.  This is very basic, I'm sure you will agree.  Would you therefore advise (yes or no) whether Majestic/Sol Mijas has issued these bank guarantees to all buyers and if not why not?

2.  If you were to discover that Baugat were refusing bank guarantees to buyers, what action would Majestic take to ensure compliance with the law?

3.  Who are the directors of Majestic?

News just received from Manzanares - "The Developers have informed us that you can contact them on the following telephone number: 0034 952 47 13 06. They have also informed me that their web page www.smd-spain.com is now ready and operative."

 

Completion date appears to be September.

Just to let everyone who monitors this board that my happiness at winning my court case with Sol Mijas was short lived,as they are appealing. Anyone play poker out there? I WILL NOT GIVE UP!!!

It does seem like a poker game for you and if you're not a gambler the highs and lows will be exhausting. I think that is their intention .........to wear you down. Good luck all the same and keep your spirits up.

Thank you for the information. I have just visited the website and I noticed the telephone number is a digit out to the one you posted. I have copied and pasted from the site-see below.

We were told the condensers for the aircon. would be sited on the roof and the cool/warm air would be distributed through ducts. I see from one of the photographs that the condensers are sited on the terrace, rather warm I would think on a hot day. I have emailed SMD and asked them about the distribution method.

I also noticed another slippage of the completion date from July to September. By Christmas they will be 3  years overdue. Ah well!
