Hi all does anyone else who walked away recieve anything from prodinal lawyers? are they presuing people for compensation. i spoke to a lawyer a while back and she assured me they couldn do that all they could do was keep the deposit we paid. apprecaite any feedback

i received a letter from the lawyer today as i have not signed my title deeds and they said they might take legal action???
i am struggling for a mortgage so i dont know what will happen there?

we have had a letter claiming they have tried to be in touch with us recently. we told proindal that we would not be able to get a mortgage in november as now we have no one with a regular income in the family. we ahve heard nothing from anyone since. i sent a copy of this e mail to the lawyers as proof . what can they do they cannot get blood out of a stone

Hi there mr karlsson here .Yes I got a letter aswell and I am reluctant to complete as I think the burden will be to heavy in the current economic climate also the exchange rate is getting even worse as the GBP/Euro is heading for a 1/1 by the looks of it.I will speak to a spanish lawer tomorrow and have them have a look at the contract to see if they can really sue us for damages .It will be hard enought to swallow loosing the depostit let alone to be sued for even more money.
if anyone has heard anything from a laywer regarding the matter it would be well appreciated to hear something back.

Just heard back from my lawer and they said there is nothing in the contract that gives them the rights to get more money out of us but that the wording is done in such way that it covers them for taking the full deposit of us to cover there damages.
If any one has heard any different pleace get in touch on this forum please.
It is a bit of a sad day anyway loosing the deposit but se la vi.

hi all
We had a phone call to day from MRI lawyer saying that since we did not complete, the building company has found a loop hole in the contract , and is taking precedings in this country for damages. Hope this not true.
We also lost are deposit.

Hi what is this loop hole ,we have had a letter saying they were going to take legal action against us for not signing,we had a letter from our lawyer that said if we were unable to sign the builder could keep all depoits paid.some conflicting information here,surely the deposits are all they can ask for

Hi,
I just got a phone call from my lawyer ( one recommended by MRI) asking me if I have received a letter from the builder's lawyer. She told me that the builder has hired a lawfirm to take action against all who had not completed. She said they are hoping to get more than the deposit by claiming against our assets in the UK ( for those resident in UK of course ). The lady who spoke to me is not the person who handle contract but someone else in the firm, so I couldn't find out if there is any loophole in the contract that permits the builder to come for more. Do we all have the same contract from the builder ? Is it likely that depending on which lawyer you used for your conveyencing, the contract could be worded differently and some might have legal loopholes for them to exploit ?
It looks like many of us are facing the same battle, and I propose we should get together as a group, both for morale as well may be pooling our resources together to deal with this major worry. For those who are receptive to the idea, please send me a private email and I will find a way for us to move forward.

Hi all
We too have had the phone call this morning from MRI solicitor.
But we have not received a letter from developer yet, and have been advised to phone solicitor as soon as we get one.
I too think strength in numbers. Already lost 40k talk about kicking someone when they are down.

I've also had the letter from the builders lawyers as well as an email from them.
I spoke with Manchester law firm DWF yesterday. They encouraged me to look for other people in our position. Anyone wanting to know the outcome of my conversation pm me and I will tell you.

Hi....very new to all this. In the same shaky position received no completion notification from developer but a snotty email from developer's lawyer. There is a clause in our contract that gives the developer the right to either cancel the contract and keep the deposit or to oblige the buyer to judicial fulfilment. Have not consulted an independent lawyer yet but does anyone know how the developers achieve judicial fulfilment ie what does that actually mean to us? Will do pm to spondonites when my registration complete.

HI TO ALL...
I to have recieved an email from the developers lawyers and face legal proceeding for not completing on a property which was overvalued
when sold to me in 2005.Managed to get a mortgage approved, subject to valuation.Valuation came out lower than purchase price(valuation carried out in 2008)
MRI try to tell me it is because of the credit crunch which is a load of nonsence.
Something is not quite right with the whole set up,not getting much help from the MRI 'independant' lawyers.
Chris you mentioned that DWF law firm encourged you to look for people in our postion... any more info?

Today recieved the LETTER , Has any talk to GARRIGUES in spain yet????
Have found a web site about spanish law , found Q@A about our problem . Dear Sir,Of course, the developer can force you to complete on a property which has a LFO already granted (fully legal). They will compell you to complete before a Notary Public on a certain day and time by means of a burofax to the address provided in the PPC.
Failure to do so will result in them not only withholding the deposits as laid out in the PPC but more importantly also they will now be free to take legal action against you for breach of contract as you failed to complete.
It's up to them to decide if it's worthwhile or not to pursue legal action against you even in your home country. Some do some don't.
It is something that quite definitely does happen.

totally different information from what i was told salty and i spoke to maria del castro the legal eagle on this very forum. She told me we could cancel due to lack of finances, and that if they thought they could seek more damages other than keeping or deposit that part of the contract is against consumer law and this is not good for them. Not many people me being one had and communication from mri,the builders, and prodinal up until now. There was no explanation as to why all the propertys were late in completion and i never heard if the licence of hababtition had even been granted. so now there on peoples backs when they didnt care to let them know or anything. I find that quite sickening and unprofessional.

Has anyone seen the posts from Maria de Castro?
I've just been checking out some of the other threads, i.e. "Is the current economic climate a reason for non completion", Maria's post on (1) 15 Jan 2009 2:34 PM and (2) on 14 Jan 2009 11:42 AM on the "Non completing question... " thread make you wonder...
As always some clear direction would be greatly appreciated by us all I think.

Hi, I have also received an email from Proindal's lawyers eventhough I recently submitted a mortgage application to the developer' bank!
Didn't even wait for approval, just pulled the application and added my file to all the other non-completions.
I'm willing to join any joint initiative to defend this action.
