I second that.
In these difficult times for some of us, John and and many others have shared invaluable information that has seen some positive end results. EOS has been and is such a very useful forum tool of knowledge too many who otherwise would definitely have been lost without it.

I have received this from my solicitor. I did not send him the e-mail from 'HUMA' and I feel this is quite worrying:
Dear Allen
At present we have not an official proof through which Huma has presented before the Court a declaration of bankrupt.
Our procurator in Murcia is checking every 3-4 days before the Mercantil Court of Murcia the matter.
In few days I will send to you the consequences to present said declaration.

We also have had all our money refund through our Guarantees this was also actioned in under 8 weeks over Christmas by our Lawyers Fusters. Were given a date of 4-6 weeks end of November payment received by them last Friday not bad considering Christmas and New Year. Delighted now to be out of this mess and now looking for something else.

Can you just tell me if you received your deposit plus interest? I'm not sure if you went to court - did you therefore get your costs paid too?

We received our money back from the Guarantee that we held excluding the deposit, The deposit we have contacted the Credit Card company on advice of the European Consumer Advice Centre as they say we have a claim down this route. We did not receive any interest I believe this depends on which Bank you have the Guarantee with as some Guarantees state that they will pay out the interest. You normally have to take Huma to court for the interest, costs etc. In the current climate we have made money from this due to the exchange rate and quite happy if we get our deposit back via this method to call it quits.

Thanks for the info.....I don't blame you for feeling lucky just to get the main bulk of your money back......trouble is, Huma knows that's how all of us feel and is bargaining on getting out of paying back the full amount due to buyers

The banks must surely be questioning Huma and the fact that everyone is claiming back on their BG's (for those fortunate enough to have been issued one) and not getting money refunded from Huma direct. ? What must the Huma credit rating be like ?
We are also going down the Credit card claim route, there seems to be a few of us trying this. Why not. It may prove to be a faster way of getting the refund than the court hearing / date......Let's keep each other up to speed on progression. Maybe start a new thread.
This developer beggars belief.

We went down the Credit Card line,with Barclaycard,after sending them copies of all documents (including contract) Barclaycard,(after refunding the amount to our card)decided that THE CONTRACT HAD NOT BEEN BROKEN!!! I am not sure WHO read the contract,lets just say I would not trust them to read my shopping list!! I am now going to chase B/C again,as our Spanish Lawyer Miguel,has kindy agreed to contact B/C,to confirm that the contract was BROKEN,and we have now received a refund of most of our money.Still more work to do though!! The one started by Ruth is for those who have legally binding Bank Guarantees, but who find that the banks are refusing to honour them. It will be sent to the Governor of the Bank of Spain. This petition can be signed at:

There is another Petition which aims to cover all problems with property abuses in Spain, and also welcomes supportive signatures, even if they have no property problems. It will be going to Gordon Brown PM at No. 10, and also to the EU in Brussels. Another couple of weeks (appx) left to sign this one:
