Hi All,

 

This is just for information and may not be relevant and any thoughts or opinions would be gratefully recieved, but had discussed with my solicitor several weeks ago the possibility of writing to the judge hearing our case just to let him know my  views and how SJ dishonesty has affected our life. Our solicitor asked me for a period of time which has now elapsed before we took this course of action.

In principle he had no objections to contacting the judge or anyone else he thought may be of help, but he did say that he did not think sending a letter to judge would be of much use as judge would be so busy hearing all the legal arguments and probably would not have time to read it, but perhaps if enough of us sent the same letter he may take more notice than an indivudial letter. We also have someone who was a purchaser like us but works in PR and is willing to offer their expertise in helping bring this more into the public domain.

I personally have been compilling a list of names of people  mainly spanish but a few UK MPs and working on a letter very much like what Brian is suggesting. Perhaps a collective letter could be drawn up and signed electronicilly with our names and parcela numbers and perhaps solicitor acting for us, like Sal I have nothing to hide and have no problems providing this information on a letter in the hope that it may further the cause of right over might and downright dishonesty.

Hi Arlene

As i say i will work on the first draft and have it ready over the weekend....................can you look at picking a Spanish contact who could translate.anyone? ........if we aim for the end of next week for it to be ready to go....thats a week to get from first draft to completed letter.

Also when the letter is done, how it can be linked somewhere for access for all.......any idea how we could do that?

Then you can add your details and send it to who we choose as recipients.

Hi Brian, Sal, JA, Sue and everyone else,

Have a contact who can translate for us  but if JA works with spanish nationals it may be quicker and more cost effective to arrange with her, think we should present in both English and Spanish and should be targeted to some of our politicians as well. I also have address to send to judge if we decide that is the route to take.

As to the letter once completed it can be posted either on a link from any of the forums subject to moderator's agreement if they are not keen on this, then form can be sent electronically. As we can not physically sign ( too complicated and too time consuming). Thoughts at moment is we have letter  and then a seperate form with our names parcela number and acting solicitor and expiry date of our contracts. This can all be done electronically by email though someone has to collate all information.

We can also arrange it through a  new website but time is against us as we have to think of our aims and objectives and register domain name design site and then propagate through the web much quicker if we can have a link through the forums connected to San Jose preferably all of them, as not all use the same forums for various reasons and you will get a wider spread.

Also PR guru says it would be helpful if we can have amounts involved as it makes it more newsworthy if we can give a sum total of monies involved in our complaint. Personally I have no problem with this but others may not want to divulge how much deposit they left.

After all the news is full of doom and gloom on a daily basis so we are going to have our work cut out making people sit up and take notice. ( Don't mean to appear defeatist) but we need to be realistic in what we hope to achieve.

Also think it is important that we remain focused and do not get into personalities or having a go if someone differs from our opinion it wastes time and deters a lot of people from both visiting forum but more importantly putting their views forth. Our wrath should be against San Jose and the system that has let us down and not against each other.

Myself think we need to act as quick as possible if we hope to influence judge. UNITED WE STAND

Great idea Brian, lets put the fear of God into them! I am not going to give up. I want my deposit, interest and legal fees refunded  in full. We do need to galvanise ourselves and be a constant thorn in their flesh. It never fails to amaze me that SJ/HdT hope that we all just give up our hard earned cash without a fight. I for one am looking forward to the weekend and starting to get this ball rolling.  Ive written a lengthy question list to my Legal for some answers/opinions in the meantime. Thanks for all the sensible dialogue. 

 

To Sue, I wont distract from the thread of this debate and will PM. In short, no unfortunately it would mean a small mortgage to complete and have taken note of the posting about the difficulty in raising one. I wish it was inland but its not, tho the coastal area is quite satisfactory especially now grandson is 6 (he was only 2 when I paid the deposit on SADM).  So he would love it.  I guess it would be my main priority to put an end to the nightmare and have bricks for my money.  In the ideal world, money back to choose a country property.  Ive made it very clear that I wouldnt accept SJ's 'scraps' just because they havent re-mortgaged. They have 98,600 euros of mine that I could never afford to write off.

Priority now ,in this moment, is to fight alongside everyone else for our money back.  If we could achieve that for all of us.. I would feel so much better from within.  They deserve one hell of a battle and to know how we feel about them.  Its obvious we are all sick and tierd of pussyfooting around  these crooks.  Im going to ask for a deadline to exchange.  Even if I got one, I would still want to assist anyway I could with everyones battle.

If the letters could be varied, that is, one general and one detailed, so that they could be sent by anyone who has an issue with San Jose as well as the details and outstanding finances of others.  People could download them and make simple changes to include their personal situation.  Obviously there may be a problem of privacy, but this is a risk worth taking.  We can discuss this further.

With regards to distributing the letter, don't worry about that for now, I have two or three web sites I have control over and can distribute easily from any of them.  Once we have the letters ready to go I can set up a link to collect them.

Also, I think I may now be making some headway into bringing the Spanish contingent into the mix, including other partners who are owed money and who may be more than willing to give us any further information.  This however is time permitting and  may be in the longer term.  I'm going to try to speak to a few Spanish people next week.

I think publicity will be the next step, but one thing at a time.  Anyone do T'shirts?

Hello All

This is a great idea, pity its taken so long to realise what we may be able to do?

Martinbrothers I agree you should not accept scraps thrown out by SJ, but if they are offering you an alternative at least you are getting something back even if it is worth less than you paid for it, you may be able claim the difference back later, of course it depends on where it is an could you live there?

as for judges not reading a single letter as he is too busy dealing with the case more than likley right.

what might be seen as a positive and agressive action against SJ/HdT, is to go ahead with the letters one with everyones name how much is owed to them and  parcela number this could be stored on a link once completed with al those who wish to continue it should be sent to every EuroMP including the foriegn secretary (Milliband)?

a further templated letter signed by an individual with deposits time scale for completion should be sent to every lawer or legal rep that you are using with instructions for him/her to deliver it to the court on the same day. Lets see the judge ingnore a few thousand complaints landing on his desk at the same time, the only thing here is the co-ordination, they should be delivered at a given date to make the most impact on the judge.

Like the way your thinking keep those thoughts coming and certainly more impact if lots of letters presented by our solicitor's all at the same time though am sure that as we are all using different legal firms that they all have their own time slots in which to present the case on behalf of their clients, still am sure with a bit more thought we can come up with some solution.

Hi all,

After letters to politicans and other admin stuff, has anyone given thought to protest / demonstration. How many of us would be in Spain for hols and would be willing to travel to Madrid or wherever  for a day or 2 to vent some frustration against authorities / politicans / anyone who would not want adverse publicity?

I'm up for it and contrary to Twitit I want to get these criminals liquidated as soon as possible.
