Hi Blue and Toddie,  love the posting's, made me smile,  it certainly sums up the feelings of most of our fellow purchasers, I have received a number of private mails from those that have now seen this forum for what it sadly has turned into. We have also received a nod and wink for next week, watch this space. Also did a bit of jcb breaking dancing on the drive of  604,   no problem, but had a bit of difficulty getting it down the steps of the pool though,  still practise makes perfect as they say.

Well it has now been 2 weeks since the visits and last postings and there hasn´t been any updates and I wondered it anybody was able to complete with the COH or planning queries answered

Yet another week gone by and soon another month and still awaiting confirmation on completion of our Esther which is finished and looking good but still waiting for the Habitation Licence. The last news we heard was that the licence was not issued due to a road that needs tarmacing??? Yeah, and I just fell off a Christmas tree!  Also, no workers on the other phases??? WHAT IS HAPPENING does anyone know? As usual no news from the developers. Like so many of you we had our mortgage in place when we got that letter back in October  so we are now paying a mortgage (or our mortgage offer would have run out) and also storage for our furniture. All we hear week in, week out, is "it should be this week" . It's all bulls**t !!!  There's something going on that's holding this up and the powers that be are now running out of excuses. I also heard that work on the other phases and the Commercial Centre (if built) has been put on hold until phases 1 & 2 have completed!!!

Has anyone got any constructive news?

I always find it odd on these site when people that have been very active vanish when the going gets hot or when they make statements which may potentially have been fed to them by the developer that don´t actually happen

We have also received a nod and wink for next week, watch this space. (from 3 weeks ago)

As I have always made clear the comments that I make on these types of sites are designed to help people not create trouble and have come form year of experience in dealing with constructors and development issues.

Again I must make clear that I don´t sell properties but I make my living by completing on new developements so I want people to buy but equally, because it happened to me, I don´t want them to get ripped off.

There have been a whole range of statements made here, the most recent ones being from people who would claim that the thread has been too many negative comments, that everything is fine and going ahead and that you would soon be enjoying your new homes. Perhaps, given some recent facts, that there could possibly be a problem however those same people seemed to have stopeed posting, and because the developer has stopped communicating, all that is left is the speculation and I would urge somebody if, they have real information to update this thread, especially thise who visit the development on a regular basis.

The fact is that in order to get the Certificate of Habitation The Town Hall will look at all of the planning regulations and finished properties to ensure that the infrastructure is fit for purpose, that the roads, drains, electrical connections etc are completed and that the buildings meet the agreed specification.  If anything is not correct refuse the licence and this processis not straighforward, and realted to the final construction certificate from the buiilder.  We have real experience where it can take years to resolve if everything is not right and a property legally is not complete untill the licence is issued however people  that get concerned about loosing their properties often complete anyway.

There are rumours, not confirmed, that the builders have left the site and stopped construction on later phases, and that CAM Bank have wothdrawn funding until phases 1 & 2 are completed. In the current climate banks are tightening their lending, construction companys are now regularly filing for administration due to cash flow and sales problems.

Another example this week, more than 1000 buyers on Fortuna Golf where a large established developer, San Antonio, have decided to pull the plug on the development. Buyers here without any Bank Guarntees that have paid more than €50k for their villas have no alternative but to start legal proceedings to recover their money with a chance that the builder may end up in administration.

So isn´t it about time for the sake of all the readers sanity, that somebody from the nod and wink brigade,or event the developer as we know they read the forum,  that is not an agent or has a vested interest in people not cancelling contracts, that is local and can see what is now happening onsite, provides some information

This is my first post on here. I have been with the project since 2004 and have visited the site 5 times the last one on the 9th of March, I went on spec this time as I wanted to see for myself what was going on.

I was suprised there was no construction work going on but even more suprised there was no sales office showing site plan with units taken as you would normally see on a development like this.

We did see Maria and she was kind enough to show us the show houses which are excellent and built to a very high spec, It also looks to me like about 200 units are completed and near ready for occupation.

We were told habitation licences were due next week but obviousley this has not happened lets hope things start moving again soon.

Hi all,

 

 

Has anyone moved in yet?i havent heard anything from my sales agent since december and was told then that people would be moved in for the end of January,i am hoping to visit site on April the 9th ,so hopefully all will be revealed ,any updated info prior to my visit would be good.

No-one's moved in but a lot of people have moved out (namely the builders). Last I heard was that further building on Phases 3,4 & 5 has been put on hold until completion monies for Phases 1 & 2 have been paid, whenever that will be is anybodys guess. Who knows when/if the Commercial Centre will be built. Will building continue after Phases 1 & 2 have completed. Will anyone give us an honest answer???

Also heard that because of the dive in the Euro they are losing money but if we'd moved in when we were originally told we would be moving in the Euro was better then so it's nobody else's fault but the builders. Our Esther is ready awaiting the Habitation Licence but we've been given so many excuses for the delay we now don't believe anything we're told. We've asked our Lawyer to contact the builders with some answers/update but as yet nothing and we're not holding my breath. How's the saying go "No news is good news" - Yeah alright!!!

Some good news from the local press this week, despite the continuing legal problems -  

 

 

The urbanization is proceeding despite the legal problems that are finding is that of the fig in Hellín.

De hecho, según el concejal de Urbanismo, Ramón García, la empresa ha pedido 48 licencias de primera ocupación ya que una parte de la primera fase ya está terminada, aunque la empresa eleva a 73 el número de viviendas terminadas.

In fact, according to the councilman of Urbanism, Ramon Garcia, the company has asked for 48 licenses first occupation as a part of the first phase is already complete, though the company brings to 73 the number of houses completed.

Pese a que un juzgado declaró nula la licencia de obras concedida a la empresa Cleyton Ges por parte del Ayuntamiento de Hellín para la construcción de las 105 viviendas de la primera fase, la empresa sigue adelante con las obras.

While the court declared void the license granted to the company works Cleyton Ges by the City of Hellín to build 105 homes in the first phase, the company goes ahead with the works.

Según el director de proyectos de la compañía, Ramón Ramiro, ya están vendidas más de 400 de las 617 viviendas contempladas entre las cinco fases en las que se divide el proyecto.

According to the project manager of the company, Ramiro Ramon, are already sold more than 400 of the 617 homes referred to the five phases in which the project is divided.

Según Ramiro de esa primera fase apenas falta una pequeña parte por terminar de construir y que la segunda, que cuenta con otras 68 viviendas, también se encuentra muy avanzada.
 
According to Ramiro this first phase only a small part for lack of building and completing the second, with 68 other homes, is also well advanced.
 
Tanto que calculó que en dos o tres meses se podrían finalizar las obras de las dos primeras fases de la urbanización.
 
As estimated in two or three months could complete the works of the first two phases of urbanization.
 
Aunque la empresa mantiene sus plazos, reconoce que con la actual coyuntura económica tienen más problemas a la hora de conseguir la financiación para el desarrollo de las fases siguientes.
 
While the company remains on schedule, says that current economic conditions have more problems in getting funding for the development of subsequent phases.
 
De hecho supeditó a la finalización de la primera fase a la consecución del crédito para poder iniciar la tercera «por eso nos interesa empezar a escriturar ya las viviendas y que sus propietarios, que son de nacionalidad inglesa, puedan empezar a habitarlas».
 
Indeed subject to the completion of the first phase to the achievement of credit to launch the third "why we are interested to start writing and residential properties and their owners, who are British, can begin to live."

Can anyone please elaborate on Debs C's Highlighted paragraph posted on the 31st March - "While the court declared void the licence granted to the company works Cleyton Ges by the city of Hellin to build 105 homes in the first phase, the company goes ahead with the works"  Does this means he built the 105 homes in the first phase without the neccessary licence/permission therefore illegally???

The comments made on the spanish new release site actually didn´t really say anytthing, were made by a local councillor and most people here know the way that the systems work at the Town Hall

ALL of the people that claimed to have real information on what is happening at the site have ceased posting and I have been advised that the CG have not made any clear statement

Given that you are dealing with a very small Town Hall with a limited amount of construction in the local area I would have expected that the COH, if there were no problems, would be available by now for phase 1 properties

For those people that do not have any BG, which is a legal requirement in Spain, we have seen 2 more constructors Escadero and San Antonio, with financial problems and pulling the plug on developments this week leaving people that have paid over €80k each in deposits high and dry

I have a clear statement from CG on the issues concerning the COH and I have been in regular and informative contact with them over the last few months. This is why I have stopped posting and I would urge you all to contact CG with your issues if indeed you are genuine buyers or propsective buyers and from my experience you will get an informative response.

When you buy a house in the UK, who do you go to with queries? Your solicitor, the vendor and the estate agent. I suggest you adopt this approach here coupled with site visits if possible.

hello blue

i think there is some problems with the licences. not sure if its about the building licences or occupation licences?

from what im told no licences can be given as the urbansation requirements arnt in place. By this I mean the high? electric cables and water supply need to be finished and the little bridge by the entrence on the road up there, it needs to be bigger or wider?

Im informed that nothing is happening on the site now, its stopped all work, but there are roads and things needed to be finished to allow the first houses to be given the paperwork.  Also no finance available to finish the remaining works.

Thats all ive heard. Long wait ahead

I to have stopped posting as i have been in regular contact with my agents, here is the statement made by Cleyton Ges,

Statement from Cleyton Ges S.L.

                                                                April 9th 2009

 

The development of Las Higuericas has been a complicated  process as opposition from the various political parties has continued after the original planning permission was approved. The current situation is that on the first two phases, building licenses have been granted and on phase one sector one and two  the “Certificado final de obra” (certificate of final works) has been issued. The certificate of habitation or first occupancy is at present waiting to be issued subject to removal of the high tension electrical cables. The removal of these high tension cables have been held up by a local town hall architect,  the Environmental Administration have objected to the proposed new route of the cables claiming this to be a threat to the bird population. The new project has been submitted to the town hall using a route favored by the Environmental Administration therefore we are expecting this new project to be accepted during the next planning meeting scheduled for later this month. Cleyton Ges S.L. have submitted all necessary paper work in relation to this final matter and fully expect the Certificate of Primary Occupation to be released after the meeting has been concluded.

 

On release of the Certificates of Primary Occupation the financing entity of the project will release the funds in order for works to re-commence on site.

 

Phases 3,4 & 5 have of course always had the “Urbanizacion” licenses granted but the individual licenses for the properties cannot be issued until building work is able to be completed within the 18 month time frame set by the local authority. 

 

With regard to outstanding bank guarantees that have still to be issued, we have been told by the Cam bank that after the certificate of primary occupation have been granted for the first phase villas, they will address the issuing of the remaining guarantees on phases 3,4 and 5.

 

We recognize and share your frustration in the delays that have been caused to the development of this incredible project but we are still passionate about achieving our goal of Spain’s most unique village development and with the knowledge that no one can take away the stunning location our project is situated in.

 

Cleyton Ges S.L. would like to ensure all of their valued clients and agents that we are doing all within our power to minimize any further delays to our Las Higuericas project.
