Letters are going out today.

Procumasa want 300euros to arrange the connection of meters etc. This price includes a sum for 'the minimal charge for the water consumed up to now'

They are also witholding the paperwork that allows individuals to do it themselves. So in effect they are blackmailing us into paying their price for a basic essential.

Payment has to be made by 18 May and water will be turned off 1 june!

This is from another thread with a builder wanting to charge for water supplied:

The law in Spain regarding the supply of builders water and electricity is taken very seriously in Spain with big penalties for builders who fail to live up to their obligations

If you search this forum you will be able to find a thread for another development in Campoamor where the builder threatened the same action and the consiquences of his actions, his immediate arrest by the Guarda Civil, it is taken that seriously

You don´t have to go thorugh any lengthy legal process simply go to the local Police statuion as a group, ideally with a translator and denounce the builder and they must take immediate action but you must do this ASAP

I would suggest that the lawyer isn´t being quite as helpfull as he could be or is he perhaps connected to the builder

It is nothing to do with having an Escitura as it is simply the law, no COH and the builder must supply FREE OF CHARGE utilities 

It will be difficult to get any connections without the COH and you would be better chasing the Town Hall to establish where that is in the system first.

Remember when you are adopted your SUMA Tax will be backdated which covers your rubbish collection and I know its 2020 hindsight is great but what lawyer allowed somebody to complete on a property with no deeds and a loan or mortgage showing, is it the same lawyer that is advising you now

Don´t just take my word for it look at the other thread as the builder will just bully and rely on peoples ignorance and failure to act

Just had phone call from our solicitors.
 
What she has said is the Procumasa will be unable to continuing to pay the water  after next month and that the water company will cut the site off if its not paid. .Procumasa have said that they are only asking for  50 Euros (which the solicitor says is illegal) extra which they will use to finish off the site with the money they will be saving on the water and the extra everyone pays.
 
She says yes what they are asking for is illegal but she recommends that we use common sense  to pay it other wise it will be near impossible to get the water connected later. She also said that the builder dont have one of the papers they need but have made arrangement with the town hall to get the water on without this paper work, that's partly why it will be near impossible to connect your self.
 
She said she has spoken to Procumasa and had an assurance from the head of the company that they are not leaving the site and have informed her that all snagging,pools ect will be finished.

I'm sure what you say is correct.

I suppose your solitor did'nt tell you what the missing documant is?

Some people on site have their Habitacion Certificate (LOF) and they have paid a plumber to issue a Boletin for the plumbing, so they can go ahead on their own.

One thing that concerns me is if Procumasa do not have an essential piece of paperwork then we will not be legal - so if you try to sell at a later date then you will have BIG problems.

Even if they do have it all what is to stop them charging an 'admin' fee (say 300euros) for us to get hold of them when this farce is over?

Finally I trust nothing that Procumasa says, we have been promised, lied too and robbed all along the way and the hope of Procumasa ever having the money to finish off the Urbanisation is just pie in the sky.

Does anyone know what has happened about the Bond Procumasa are supposed to have lodged wth the Town Hall which would enable them to have another builder carry out completion of the urbanisation if Procumasa are unable or unwilling to do so?

The recent email from the Presidenta has thrown the whole issue up in the air again - not that I object to that.

I only hope that if logic prevails and we do not have to pay Procumasa blood money then the people who paid in advance can get their money back from Procumasa.

We sent presidenta email to our solicitors who have informed us they are not paying Procumasa until they have investigated this further...

Have meters been fitted to property of people who have paid,

If not Procumasa should be refunding money

We have just had an e-mail from our Solicitor saying that Procumasa are going to connect up those properties where the 300 Euros has been paid over and are going to look at other cases on an individual basis but won't be cutting the water off!!  Where we go from there I don't know.

This news has yet to be released on site!

It will be interesting to see what an 'individual basis' means!

All we want is the paperwork so we can do it ourselves.

Latest advice from our Solicitor is to wait and see if the properties where the owners have paid over the money get connected to a water meter

I have been informed that Procumasa have been doing deals of 200 euros for water if you are an holiday home owner without a pool and that if you are a spanish resident then it has been accidently omitted from your property so free of charge

I paid the full 300 euros and feel totally ripped off by a corrupt company called Procumasa who will squeeze every euro out of its customers without doing anything in return. I have paid for this item twice because it was included in my purchase clauses

I think we need a barrister to act for all residents against Procumasa in order to get things done .

Is this a case of financial Racism to British Customers?

It seems nothing at the moment, if you tell Procumasa that you are a Spanish National and that the meter is missing on your property you will probably get it free of charge.
