Certificate of Habitation

We received a letter from Carmen on 16th Sep stating that an appointment had been made with Notary for us to complete on our property on 22nd Oct.  I had some questions for Carmen one of which was to ask for a copy of the Certificate of Habitation as given Calidona record to date I did not want to arrange travel and then find that we could not complete.

Carmen eventually responded to my email today with a copy of Licencia De 1a Ocupacion which is dated 1st Oct. Due to work commitments and upcoming medical appointments ideally I would like to delay completion until the New Year.

Could someone please let me know what legal position is on this? I'm sure that I read somewhere that you had 3 months. If that is the case would it be 3 months from 1st Oct or today when I received certificate?

Legally you don´t have any rights to delay completion on a property that is finsihed and has a COH issued but Corvera will look at the practicalities of travel and getting the finance in place if you ask

Someone you trust could sign on your behalf, and you could sign a deed of ratification later.

I donlt think that that is the issue and we have done lots of inspections for people that have not yet even travelled to Spain or seen the properties and they have completed by Power of Attorney

What we do is check the properties, take measurements and take lots of photographs even check the furniture fits

It is ofetn the case that people want travel to Spain to actually see what they have and the builder has toi appreachiate when it is practical for people to travel as you need as least 3 days to complete, snagging, bank and finance plus the Notary appointment and they all only work Monday - Friday and that doesn´t include time for furniture shopping

I have sent you a mail as I sent you these photographs 3 weeks ago and perhaps you have a filter stopping large e-mails 

I am a little cross by your comments as people know that I am always available on the e-mail and telephone and you could have mailed or called me if there was a problem

As you know. because you have refused to complete, that I cannot get into the property but I  mailed you 20+ shots of the outisde areas, the pool and golf course which I believed would help you to try to sell your contract

I do hope that you are not going to become a FREE advertising agent for those people who do not intend to complete and can't even be A**ed to go and take their own photographs of the properties/contracts that they are trying to sell on. I know that you are a great guy and will do anything for anybody but business is businness and you should at least make a small charge for such a service.

I think that comment  may be  unfair as Sheryl did come over and we together snagged her property and at the time I believe that she intended to complete but people´s circumstances change

I have no problem because I am onsite most weeks taking the photographs and I have done this for lots of people but actually mailed the photos to Sheryl

Finally, apologies a little later than expected, I have just updated my site with photographs on the clubhouse construction, internal shots of a Menta, shots of The Magnola´s updated pool and gerdens plus phase 3 on the hill

Please remember with the clubhouse that a lot of the initial works were on the foundations and now they are really cracking on and up 2 levels and I counted more than 40 builders working that I could see

I will do more shios intranally and externally on the Mentas this week plus what will be good shots for people want to rent of people actually playing golf

Sheryl my apologies, no personal offence meant towards you , I misunderstood what Roy was saying in his post and I sincerely hope you manage to sell your contract if that's what you must do.
