Hi All
I have been of site for many months as I did not want to jeopordise our court case against Taray for their breach of contract. Many people have said they would be taking action against Taray but I have not seen any threads on it. This is what happened to us.
I have praised Taray for the build quality of their properties and complexes but heavily criticised them for appalling business ethics. basically lying all the time and poor customer service. When they were in breach of contract and admitted it and still treated us with contempt, we had no option but to execute our BG. It took a lot of work to get our two BG originally but it was worth it. After about seven months the Judge has ruled in our favour and awarded us full refund of deposit, interest on deposit, interest until it is paid to court and our legal fees. I expect the bank will appeal as it is over 100,000 euros.
San Cayetano is a great site and we are a bit sad that we are unlikely to purchase there. If Taray had not tried to run rough shod over us and instead had renegotiated the contract (due to their breach) we would have completed by now. They have lost a sale but maybeTaray has a waiting list of buyers eager to purchase!
Good luck to those on phase1 and 2, take Taray to task on completing the rest of the development. Dont let them off with half measures and run down the area. Get the presidents/communities formed as you will only get out of it what you put in. Taray have demonstrated they are only interested in hard cash, legal action against them is very expensive, so it is up to those still to complete to use their upper hand to force Taray in complying with the development plans.
The good news is we can now have many trips to Murcia looking at completed properties and sampling the local cuisine (wine).
Cheers
Colin
