Can you tell me what Maria's legal tip 409 actually means - I may be a bit thick but I really I don't understand it or how it applies to lack of facilities

Well reading between the lines ellie, i think it means we can claim our deposit back because they have not delivered the lifestyle/facilities as promised in all the marketing, which is obviously the reason why most of us bought on convera golf and country club!!!
Notice i said most of us, there are some people on here to be fair who did not buy for the facilities!!!

Surely the only reason to buy on Corvera was because of the promised facilities, if not then why not buy something far cheaper without facilities. Anyway that old chestnut aside, I still can't find mention in Maria's legal tip that lack of facilities is a reason to get back the deposit. I can't make sense of it reading it as it stands let alone reading between the lines. Trust me, I want to believe what you say, have you asked Maria for clarification?

If you go on search EOS at the top of this page and type in maria's blog she will come up and you will see legal tip 409 on thr right hand side, go on that and read her response to the first comment???

Thanks Noel I found it. Still to get the deposit refunded minus the 5% the developer would have to be sued, more money I might lose if the developer goes bust as soon as they are found against. Until someone richer than me sues, wins and gets their money back, I am between a rock and a hard place. Thinking about it even if someone does sue successfully there is nothing stopping the developer going bust after that, to stop any further losses.

I don't doubt that they will go bust at some point!!
at that point i am hoping to step and cut a deal with the bank to buy my property at a masive discount and then hopefully in 10 years time the place maybe viable, i am fortunate enough to have time on my side.

Hi All, There is no way any Spanish Court is going to find in favour of a foreign buyer against a Spanish Developer, especially as the developer has not really done anything wrong except be a victim of the credit crunch like the rest of us, no one can say that the Clubhouse and Hotel will never be built, they can only say it has not been built yet, but since it never said in the sales contract that the clubhouse and hotel would be built before your villa or apartment you don't have a leg to stand on. The bottom line is if you do not complete you can waive goodbye to your deposit because you will not get it back through any Spanish Court, that is why the only thing left is to complete and become a happy owner like the rest of us. Reliable message posters on this forum say 400 buyers have completed so far and that new completions are running at up to 20 per month. That means completed buyers are already or very soon will be in the majority, at that point all non completers will have to consider completing and moving this resort positively forward or throwing in the towel and handing back their property for re-sale. At least if you complete you have an asset which you legally own and which you can actually enjoy. As i have said before several times everyone you meet on site are very happy with their purchase, the only place you find the same tiny handful of moaners is on this forum. Get with the program, complete and become a happy owner ! The new Corvera International Airport, the new Corvera High Speed Railway Station linking us with Madrid, the Paramount Studios Murcia Theme Park, the Weather, the good build quality at Corvera Golf, etc, etc are all reasons to believe this is an area and resort that will be firmly on the up very soon indeed. Hi All, there have been one or two lawyers posting on this forum in the past who have held out the olive branch of a possible deposit refund, presumably they were trying to gain a couple of customers, but no one anywhere, on this forum or anywhere else has ever been able to show you any single case where someone in your exact same situation has won their deposit back plus legal costs (this last bit is really important because even if you hit the one in a million button and won your deposit back it would all be gobbled up in fees and costs unless you were awarded all costs as well). Someone in this forum said previously that there were 1100 properties at Corvera so the 400 completers so far were only just over a third of the total, but i believe there are only around 800 finished villas and apartments at Corvera Golf, so that means the 400 completed buyers so far are already in the majority or will be in a matter of weeks. Get with the program, this resort is now in positive territory and is going to be moving forward from this point onwards. I'll think of you moaners huddled over your computer screens in the cold when i'm sunbathing on my terrace eating my Christmas dinner at Corvera !

Tis week, apart from today, the weather has been great, 21 degrees and we have had Christmas dinner before on the terrace and a BBQ on Boxing Day but the weather is not guaranteed, at Corvera it gets very chilly in the evenings
Simon not having a go but I am afraid that you are out with your numbers at 20 per month, they have slowed down dramatically, there were around 5 in November so nearer 20 in the last 3 months, please remember that I visit the office on a daily basis
You are correct though that there are not 1100 completed properties but I agree about the airport and LONG TERM potential for the airport and have already had some response about rentals for car hire organisations for when the airport opens
Also had a trip around the area looking at some rural properties with land where he was showing me that pricing was bucking the trends and increasing in price
Build quality in properties yes there are many issues, especially exposed after the rain
I also think that perhaps there may be a little bit of a wind up going on here by some people
I know that some people have got refunds for properties on the hill, also that some people have agreed deals with Corvera where to cancel their contracts by loosng their deposits and pay Corvera an agreed amount as compensation, yes compensation paid to Corvera
I do not believe that anybody has gine to Court and won an action against Corvera, yet

Hi All, i accept the completions have slowed, but i still think i'm right in saying that there are only around 800 properties in total that have actually been built at Corvera Golf, that means the completers are either already in the majority or very soon will be. The bottom line is that i am a happy completed buyer with a tilo apatment in phase two, that gives me a right to post my thoughts on a Corvera Golf community forum, what bugs me is that many of the people posting on this forum do not have any REAL connection at all with Corvera Golf. Paul & Carol - if you got your money back that means you no longer have any connection with Corvera Golf, certainly not a financial connection and presumably not an emotional connection either since you chose to back out, why are you hanging around a Corvera Golf forum ? If your lawyer obtained a deposit refund in a Spanish Court then your lawyer would be fighting off clients wanting to join a class action. My tilo apartment is my third property purchase in Spain and i said good build quality because compared to most Spanish property i have seen it is pretty good. I am happy with my purchase at Corvera Golf and completers like me should have the biggest say in what happens at the resort from here on, because in poker parlence we are ALL IN !

Now simon i am very pleased you are happy with your purchase, well done good for you hope you enjoy it.
But some of us are not happy with our purchase, now surely we have the rite to decide that for ourselves!!!
This thread is for those of us whom are unhappy with our purchase and would like to help each other and exchange any information we may have, which again i think we have a rite to do.
As i have said before why don't you start your own happy completers thread and you can discuss how happy you all are!!!!

If you look back at previous threads you will see a lot about build quality, the buildings shot up so fast the actual build quality is so poor I would be very worried if I was you not that I believe for one minute you own on CGCC

Lordie lordie, I only posted once or twice and all I asked was some info on where I might find the details of Maria's legal tip 409. I can't believe the snidy rubbish on this forum especially from you oh so happy completers..Even if I could still complete I'm sure I could manage to live without the neighbours from hell you lot would turn out to be. Change of lifestyle was what I wanted in a community, a real community, CGCC promised me all that. What a lucky escape I have had.
