Hi All, I knew the positive voices were out there, i have had lots of PM's saying they agree with me, the positive outlook owners obviously vastly outnumber the negative ones who were just looking for a quick buck and over reached themselves financially or just didn't know what they were doing or BOTH of course. I genuinely feel sympathy for the small number of buyers who found themselves in that situation but i now feel it's time that the positive majority start to crowd out the squeeling voices. I urge all positive outlook owners to post a positive message on this forum, momentum is with us !! I urge anyone who has not yet completed their purchase to come out and visit Corvera Golf and have a look around and speak to the positive owners on site. If anyone wants to open a shop, bar, cycle hire centre or rental agency at Corvera i also urge them to post a message on site because private financing is out there, some buyers at Corvera Golf actually have quite a bit of dosh and commercial financing is also very slowly showing signs of a return in Murcia.

Thanks for your reply - I appreciate the impartial advice.
The property was not completed when I asked Corvera to cancel the contract on the basis that it had been 4.5 years since I signed.
They refused, so I filed a case in the courts - the property has since been completed.
If the clause is abusive and the property was not completed when I asked them to cancel it then how can the court rule in favour of Corvera?

simongolf ...... my question ... have calidona managed to obtain financing for the clubhouse ? or are the wealthy corvera owners you refer to going to finance it themselfes ?..... sweeping genralisations regarding peoples finances would appear to be rarther stupid as you presumably would have absalutly no idea of there personal situations ...... maybe wrong here but i thought as a new poster the pm facality was not available ? as i say could be wrong on this .

I agree with you, completed a few months ago and I am enjoying life at a beautiful location. I beleve things will get better, jsut need time, and everything will come along.
I have been reading EOS for long time and many of the negative post always come from the same people, jst go through the old posts and you´ll see many familiar nicknamesAs you I am sorry for those samll buyers who found themselves in this situation, but not for those who bought many apartments or/and just wanted quick money.
. You are right there are many of us who are positve about Corvera. Time will say!!! not anyone else.
I also encorage all positive people to leave their comments on the forum

There is no such person as SimonGolf, there is a well known person on here who is very pro-Calidona and is using aliases to stir things up
At the end of the day I for one find it extremely bizzare that anyone will now buy at Corvera so how this wonderful club house and 5* hotel is going to get built is beyond me
And Simon (I mean ***** *** ****) you need 10 posts to use PM facility
Ps Landrover have just been on to me and said there is a different Freelander in stock which I can have and they will throw in 3 air freshners and 5 car washes for my inconvenience

Hi All, I am real and i am certainly no Calidona Group stooge, i just got fed up of reading all the negative stuff from the same handful of people on this forum, PM's certainly do work for people from their very first posting, i have had 11 messages of support so far and they are still coming in, it seems that a lot of positive outlook owners like me do not want to openly post on this forum for fear of being shouted down. If you have a different opinion to me that's fine but please keep it clean and behave like adults. I'm sorry you got your fingers burnt but i have been listening to this for many many months now. No amount of negative voices will make me change my opinion, i'm happy with my purchase and i want to visit Corvera, enjoy my apartment and be with like minded people. I look forward to the building of the clubhouse for sure like everyone else, does anyone have any news on the clubhouse ? The new Corvera Airport is supposed to be opening in November 2011 so it would be nice if we could get our clubhouse built and open around the same time.

Well said Dave - the only people trying to stir things up on here are people like SimonGolf but because he is getting so much support from fellow owners all ELEVEN of them - whoopee, he thinks only 'positive' posts are appropriate!
Simon i am pleased that you are pleased with your purchase but please do not be so condescending as to speculate why others have decided not to proceed with their purchases. Many of us feel very bitter and angry at the way we have been treated and mislead by Caledona from the outset and as i have said previously my 'dream' is over and i will not be giving Corvera one more euro irrespective of the outcome of my legal action.

Hi All, it's 13 positive message PM's now and still coming in, again i urge anyone reading this forum with positive things to say about Corvera to make a post, let your voice be heard ! I never said only positive postings should be heard, i just felt that the same handful of negative voices had effectively taken over this forum, i genuinely believe in Corvera, that's why i bought here and i'm not leaving anytime soon. The new Corvera Airport is a really positive thing for the whole resort and for other resorts in the area. When i first walked in to my bare apartment almost a year ago i did entertain negative thoughts BUT NOT FOR LONG, i rolled my sleeves up and turned it into a beautiful apartment, the build quality is genuinely good for Spain and is actually better than a few UK home builders i've come across. The location of Corvera Golf is great, my swimming pool is great, the weather is great, the food and drink out here are great. Life is what you make it. Now forging ahead with positive stuff does anyone have any news at all about the clubhouse ? There is no rule which says we just have to sit back and wait for Calidona to build it in their own good time, i urge everyone with a property at Corvera Golf to independently contact Calidona by email, phone call or letter and politely ask 'CAN WE HAVE OUR CLUBHOUSE PLEASE ?' particularly if like me you would use it not only for an after golf drink but regularly for eating meals if like me you hate cooking. There still seems to be several Golf Society Groups and Golf Tourists coming to Corvera to play so it would not just be residents using the new Clubhouse. Let's help ourselves where at all possible and move this resort forward in a positive way.

1100 properties built!!! 350 people completed, do the maths and i think you will find you are in the minority, and if you take the time to look at the heading of this thread you will see it is about people who are concerned about there legal rites against corvera.
So why not start your own happy daft thread!!!!

dont think anybody minds a posative views on the resort ..... it would appear what people dont like is condescending attitude and totally unfounded views on peoples circumstances and reasons for taking the action they are ....... as i have said before what sort of a company put together a business plan to build a public golf course in a location like corvera and not allow for the provision of a clubhouse ? "CAN WE HAVE OUR CLUBHOUSE PLEASE " i think you will find people have been asking calidona these questions for years both on corvera and the facalaties on roda ..... unfortunatly they have met with no responce ...... perhaps looking at the "FACTUAL " history of the developer would be more revealing than giving unfounded opinions on other people .... the simple "FACT" is calidona have never completed a resort as per sales literature spec .... and are simply using thre "CREDIT CRUNCH" as a conveniant crutch to cover up the unacceptable delays and lack of sales .
imho both corvera and roda could be 5***** resorts but that requires calidona to start to show commitment to both resorts and deliver facalaties .... a business relationship is a two way commitment not just take the money and not deliver !! Hi All, i really don't understand what it is you negative bunch need in order for you to decide that you haven't been ripped off at all, did you really believe there was going to be five star hotel at Corvera Golf ? If we now had the hotel would you be happy ? I don't think so, negative equity where your apartment or villa is worth less than you paid for it only really matters if you have to sell during the negative period. I based my decision to buy on the floor plan, the contract specifications and the location, i also visited roda golf and decided that the build quility was actually pretty good, i never expected the hotel and i never believed we would get the luxury spa, the horse riding, the cyce centre, etc, etc. Perhaps that is it, perhaps the positive people like me who have completed their purchase and have made an effort are being let down by the ones who went into this in a dream like state and who have now woke up and realised how gullible they were ?
I not sure the maths in the earlier post are correct by the way, i don't believe there are now 1100 properties ready for occupation at Corvera, it is probably more like 800 and from what i have read we are probably already past 400 completions, if this is correct the positive brigade are already in the majority and this will only increase as the weeks and months pass by. Does anyone have accurate figures ?
To all the moaners i say get out the way because the positive majority are on the move, when i'm sitting on my balcony sipping my beer i will spare a thought for you negatives sniping from your bunkers back in the UK, but that is the difference between talkers and doers, talkers snipe, snipe, snipe and doers get up and make positive things happen !

Time for an agreement to disagree type of truce guys.
You all know that I am probably one of the most 'positive about Corvera' posters on this forum. I am not going to mention names but lets start thinking a bit about HOW we post what we post and not get so personal in future. I have 'known' quite a few of the 'negative' posters for several years now and fully empathise with their plight. Their negative posts have been taken on board and do provide a balance which is needed on a forum.
People have put deposits on properties for their own reasons, be it lifestyle or investment driven and this really needs to be taken into consideration when trying to understand their comments. Some are VERY DISILLUSIONED and want their deposit back for whatever reason, some like myself are happy to have a great apartment on a yet to mature golf course and apparently some are so filthy rich that it just don't matter.
Completions are still in between 380 - 400 (NO MORE). FACT
Did I expect a fantastic clubhouse? Yes! and still do in the fairly near future or at least a temporary one along with the opening of the course with the main clubhouse to follow when finances permit.
Did I expect a 5-star hotel with spa facilities?Yes! Do I still expect it? probably not and definitely not before the airport is built and tourism goes back up to a level to make it commercial sense. Do I expect DeVere to manage it, NO! but then DV aren't what they used to be anyway in my eyes and 5-star in Spain is not the same as 5-star in the UK.
Did I expect an equestrian centre. Yes! and we have one.
Did I expect tennis courts etc.? Yes! we have them.
As for the commercial centre etc. that was always planned to be outside the gates so I never considered this part of the development, more a sweetner for the town of Corvera.
I am going to try harder to avoid personal attacks in the future and hope that the rest do too, if for no other reason than keeping the thread relevant to the title.

As you have hijacked this board and prevented me from getting some answers I need I'll let u know why I'm not happy:
1. I did believe them about the hotel. Only a moron would buy here if they didn't believe.
2. As proved in Roda it takes all properties to be sold to get enough community fees to run the place. When you're drinking ur beer up to ur eyes in dog sh*t and rubbish I hope you will be as happy.
3. The financial crisis is far from over. To move more money out to Spain is maddness I expect Spain to leave the euro in the next 5 years. You're investment will never be worth what it was when you made it
4. Corvera will most likely go out of business at some stage. They will lose phase three cases as there is no building licence. They won't build a club house as they are fighting too many cases. Calidona no longer exists. It was wound up. There is no longer a legal relationship between Roda and Corvera. Perhaps this is to avoid Roda having to support Corvera when it gets wound up. Who pays for the golf course etc then?
5. I already own on Roda and already the upkeep is suffering as the community fees have not been paid. Are you aware that the developer has pulled out completely?
Now I wish fairies existed and pixies came in the night and mowed my lawn but no matter how much I wish or believe it, it's not reality so can you start a new thread for people who don't mind getting screwed and let us get on with trying to get our money back from those who screwed us please.

right here goes my turn
i am on neither side here i would like to say i have lived in spain many years now and what i have learnt is quite alot .
there are two types of people out here there are people that have never lived in spain that have put deposits down and are now refusing to complete because they are not getting what they were promised and i agree with them from there postion 100% because they dont know what spain is like.
the other people like myself know what spain is like and accept places like corvera never get finished 100% communal fees will never be paid by every one ever so it will suffer at points because of this but at some point there will be a finish of some kind on this place some people will love it some will hate it but i have lived in corvera for a while and have seen this place being bult have spainish friends in area and the area will boom at some point not because of corvera golf but because of the airport and the postion of the village , the people that have completed i say well done you live in a great up coming area which in time to come prices will rocket people that have not completed i dont blame you because you have not got what you were promised but all i say STOP bloody arguing everyone we all come from different places and know different things but there is no need to keep all this up nobody is right or wrong in what they are doing they are doing what makes them happy or is best for there family or finaces so leave each other alone you only have one life so just enjoy it if you can.

Sorry for not answering your question earlier, but I’m not used to be in a forum like this, and I only look at it sometimes. As I said in one of my first comments I was just curious about it because a client told about it and I couldn’t help to give my opinion.
However, answering your question, first of all you probably know that law isn’t black or white; everything depends on the circumstances and the criteria of the judge. So I would need to see the sentence from court to be able to give you a good opinion.
What I can imagine is that probably if you waited for 4/5 years before acting in Court, probably the dwelling was already built, probably not legally finished but probably physically finished, so according to the judge it didn´t make much sense to wait until the property was built to take the issue to Court. Sometimes buyers see the property as an investment, and when the income isn’t the expected one, the purchase isn’t interesting anymore for them. So if the judge sees that it was your case, probably thought that you cannot get out of a contract just because the object you were buying wasn’t a good investment any more.
I’m just guessing, as I told you I would need to see the sentence.

The case has not been heard yet - it's next year so we will see the outcome.
I understand that the law is not black and white, I just can't see that the intentions of the purchaser should have any bearing on the outcome of the case.
Either a clause is abusive or it is not. If it is then the contract should be void. If it is not then the contract should stand.
How can the judge determine why the purchaser did not complain earlier. Maybe there was not enough knowledge of the legal system, or they believed that Corvera would build the property sooner or they did not have funds to pursue the case?
Surely the case must be determined by looking at the contract not the intentions of the purchaser?
If the developer intended to wait for 3 years before starting to build and put the 18 month clause in the contract to facilitate that intention, then surely that is an abusive clause? The fact that the purchaser did not complain until 4 years later on should have no influence on the case?
If it is law in Spain that an 18 month completion date from the building licence being granted clause is abusive, then I would have to believe that if the case is taken to a high enough court the law will prevail rather than Judges reading the mind of purchasers.
However, maybe this is not how the Spanish legal system works?
