Just got the latest update from herrada do,tollo, another pack of excuses, they actually ave the nerve to complain than the local town hall (Jumilla) will not release deposits to them to continue the build. Looks even more likely that all those who voted to keep them in business will not be back to square 1 .
I like others voted NO and have an action going against the bank.
It just goes on and on!,,

Yep, true to form this farce goes on and on and on. The HDT management or Directors must laugh themselves to sleep each night knowing they have successfully dodged the inevitable by using the system for over six years now. How it's allowed to carry on is a crime.
We also voted against their scam of a rescue package and have since gone down the action against the bank under. Law 57/68. And we still wait for judgment on that one too.

I'm sorry for the HdT supporters and the people who want their house, but I get the distinct impression of Deja Vu.
I feel the company is looking down the barrel of the parachute payments coming in next year and the revenue has not been good enough to support the continuation of the ventures.
I dont get any satisfaction but I mentioned in the first set of troubles that the company should have gone bust and wound up, while they had some liquid assets.
I think they are now about to go into liquidation proper, and all may now be lost for the supporters, albeit blind faith supporters.

This really comes as no surprise, as of the last update from SARC, HDT were going to act quickly re getting the new plan passed by the town hall in jumilla, so finaly seven months later, they seem to get their answer, which by the looks of it means liquidation.
We like a few others have gone down the bank route to try and get our money back, although no guarantee of success, there's no way you will see anything from HDT, as for them ever building it no hope. I just feel for those that have waited for the generous offer of 65% of your money back only to be royally shafted at the last moment. What do they do now take legal action or just accept it, hopefully SARC will have an answer.

I agree with the other posts, and for those that voted to continue now have another dession to make. Keep believing the lies od HDT who have spent YOUR deposits, still have no building permits or funding, Give them another 3 years and things will be allright. OR take action now to recoupe the losses before the banks are able to close the loophold forcing them to cough up our deposits.
My last posting was about a year ago advising the build would not happen and HDT was full of Bull.
I also voted no and am happy for all those who took the legal root and got their money back. Always said once those brave investers took the legal path in the early days it would open the flood gates for others to follow.
The courts are slow in spain BUT a president has now been set with banks having to repay the deposits.
I was also able to find the money to start an action, about 6 months ago,against the bank in a class action with 6 other people, so hoping after all the banks duckinin and diving they know they have no leg to stand on.
The Court now know the situation but in Spain they can't order a full refund to everyone at once (I would) ONLY those that lawyer up and make a claim.
I would suggest looking through the last posting of Spanish lawyers and sending one of them an e-mail.

HERRADA DEL TOLLO APPLIES FOR LIQUIDATION AT MERCANTILE COURT
We would like to inform that, last Friday, Herrada del Tollo was forced to apply for the voluntary liquidation of the company at the Mercantile Court in Alicante, because they are not able to fulfill with the creditors’ agreement and release the first 10% payment of the debt to the creditors.
Please note that when the mercantile court accepts this request, all the properties purchase contracts signed with HDT that haven’t been cancelled yet, will get automatically cancelled. Furthermore, the Mercantile Court will declare the breach of the 35% release and 5 years payment schedule agreement, which won’t be valid any longer.

Following our last thread, we can confirm that today the bankruptcy court from Alicante has called Herrada del Tollo (Santa Ana del Monte), for liquidation.
