Not really - you are still supposed to abide by community rules and HPA.
On Community P12 (Phase 2 apartments) it was agreed at an AGM that roll out blinds, in a colour to match the walls, would be allowed. The installation has to be requested and approved individually by each owner to the committee. If you are a member of the P12 community and you want a blind then you need to write to the president on presidente@rodagolf-p12.com and supply details of the blind (material, size, colour etc) and in all likelihood your request will be granted.
My personal opinion is that if it is a sensible colour, blends in and is not obtrusive, then what is the problem? Although I would hate for someone to put up a bright red one, I see no problem with a cream one. Let's get real - Spain is a hot country and shade is required especially for penthouses who do not have the benefit of the cover from the floor above.
Villas are not subject to the same rules as town houses and apartments as there is no community for them and I have to agree that it does seem that they can get away with what they like. There is one awful metal above-ground pool that is a total eyesore but legally nothing could be done.
If you are concerned at what has happened on the Villa then write to Resortalia and complain to them - as what they have done is in theory not allowed. Unfortunately nothing will happen if you just comment on here about it.
