Now that Gerens have settled in, and things should be progressing early May, has anyone out there a new number that we can contact them on to arrange access to appartments?

Hi Martin,
Yes we bought in block 7 ground floor phase 4 and I think we'll be lucky to be completed by october at the rate things are going.The lack of information from Gerens/ Spanish estate agents does not help the matter either.

Hi,
I am just back from CDS and visited site. Our latest info from our meeting with Lawyer is that Block 7 of Phase 4 will Sept/Oct for completion.
Should help our cause for compensation.

Hi Matt,
Thanks for the update on block 7,I presume there are no builders on site.We agreed an extension till august (8 months) last january on our apartment so it ill be interesting to see what happens.Did your lawyer talk to Gerens about the completion dates.

Spoke to our solicitor yesterday pm. We were told they had to be completed by August as i agree with Neutral there will be severe financial penalties all round and compensation. I am in Block 4. Got to be in by August.

Phase 4 Block 10 my latest update. Spoke to Miguel Ant Moyano the only member of staff at the site office at Arenal Golf. I got my solicitor to speak to him when we visited yesterday (2nd May) because of his limited English and the outcome was that Gerens (Cajasur) has taken possession on the 2nd April and is processing all the information so that they can take full control of the project. They estimate that they need two months before they are in a position to continue the project. The two month period should finish by early June so they will know more then about completion dates etc. He was very helpful but could not say anything more forthcoming. It looks as though Block 10 in Phase 4 will not be completed for quite a few months yet, I have two telephone numbers 957 340 000 or 952 44 86 43 the only trouble is that Miguel is on his own and when I was in the office the phone was just ringing all the time. I do not want to throw a spanner in the works but I have not seen or read anywhere that there will be great amounts of compensation given to all if the contractor misses completion dates.What I have read is that if the contractor does not complete on time the buyer has the right to withdraw and claim back your deposit monies plus 6% of annual interest..Or you can concede a time extension.
By what I have read on this forum it would seem all or at least most have conceded as everyone is talking about lawyers giving different dates for completion or no information atall. I do not believe anyone has got a new defined completion date.If everyone has conceded and are waiting for information as to when someone is likely to tell them about new completion dates I do not see where compensation can be claimed.

Article 3. – If the deadlines for starting or finishing the development are not met, the buyer can choose between cancelling the contract with the return of advanced amounts plus 6% annual rate, or to concede a time extension, which will be stated in an additional clause in the contract, specifying the new deadline with the date for finishing the construction and completion.

We have purchased in block 2 phase 4 and have a certificate to say our apartment was finished and signed off by the architect on the 15th November. Our apartment was supposed to be handed over on 31st December 2006. Needless to say we do not have the keys, nor any idea as to when we will be asked to complete.
According to our lawyer we are not entitled to compensation or the right to cancel as Arenal have finished the apartment. Arenal are blaming the town hall for the delay as they have applied for the habitation license in January and the council have not signed it off. My guess is the council will not sign off as they do not consider it completed. When we went over in March it looked worse than when we were there in December.
Anyone else in blocks 1-3 have any news? We are now in May, no keys and a flat in the middle of a building site with no recourse.

have spoken today to gerens and was told licence of habitation for block 2 phase 4 have been granted and they need some time to change all relevent paper work from arenal should be able to give a date of signing by next week

I have just phoned Gerens who informend me that blocks 1-3 on phase 4 are ready, but block 4 has a problem with the electricity, that should be resolved in 1 week???? They have no further info on the habitation licence but have taken my details and have agreed to update me. I am aware that August is around the corner which will mean down tools. I have a number of bookings in August to september and I am becomming anxious. I hope they pull their finger out soon aand get things moving asap.
