Hi All,

I've scoured the forum for examples of community rules that we can consider when setting up the Communidad and have found the following which apply to use of the pools and pool area - hopefully this will make it a little easier when drawing up our own rules:

RULES FOR THE USE OF THE POOL & GARDEN

In the interests of safety and the convenience of all, the Community requires that the following rules are observed:

a) Use of the pool and pool area is restricted exclusively to owners, residents and people staying on Los Olivos in accordance with internal rules of the community.

b) It is not permitted to swim in the pool with normal clothes on, it is necessary to use and wear appropriate swimwear.

c) Before bathing it is compulsory to shower, at all times.

d) Do not throw paper, litter or other waste on to the ground in the pool area, use the litter bins provided, or take away with you.

e) Do not leave Lilos, inflatables or other pool related objects in the pool when you have finished with them. Do not leave Lilos, inflatables or other pool related objects in the pool area overnight.

f) Under Spanish Law – Health & Safety, smoking, eating food and drinking is NOT permitted in the pool area.

g) Consideration must be given at all times to other users of the pool area.

h) Under no circumstance must Glass, China or sharp objects be taken into the pool area. 

i) Animals are not allowed in the pool or pool area, except for guide dogs for blind people.

j) It is not allowed to play any dangerous games that could cause harm to or disturb other people.

k) Hard ball games are not permitted in the pool area.

l) It is not permitted for any person who is not an owner, resident or staying at the property to use the pool or the pool area. Guests may be allowed to use the pool and pool area as long as they are invited guests of the owner, resident or person staying at the property. The owner, resident or person staying at the property must always be present and therefore be responsible for the actions of those guests.

m) It is forbidden to provide a key to any person who is not an owner, resident or person staying at the property for the purpose of accessing the property with a view to using the pool and pool area.

n) Children under 16 must always be accompanied by an adult in the pool area, at all times.

o) The swimming pool will open on the 1st of April and it will close on the 31st of October. Any use of the pool outside of this time is at the personal risk of the person using the pool. (The pool is analysed for bacteria and other pool related water problems every 15 days during the summer period in which it is officially open. No such tests are carried out during the winter period in which it is formally closed).

p) The pool will be closed for cleaning from ?? to ?? …. Every day / on xx days.

q) Bathing is prohibited for people with infectious diseases.

r) Please respect the quiet hours at all times.

s) Diving into the pool is not permitted. Any person so doing does at their own risk.

t) All children must be accompanied and supervised at the pool by an adult.

u) Swimming at night-time is not allowed.

v) Swimming under the influence of alcohol or drugs is not permitted.

Does anyone have any other suggestions for this aspect and/or other aspects of the community ?

Hi Everyone

From my recent experience in Los Olivos I wish to see a regulation that those people with dogs must remove all their fecal waste when walking their dogs.  Just a question when it says no drink do you mean alcholol becuse i imagine people would like bottles of water with them if swimming.  One of the questions myself and Terry hae been discussing is the implementation of the rules if apartments are let out how/who?  I children under 16 feasible/ or the law it seems a bit old to me I think it depends a bit on if they can swim, their matureness i would suggest 14 and a lot of parenal responsibility around the decision

Hi, In the proposed rules a) and l)  cover the same thing but  l) adds guests. Where we were in Cabrera there was a smaller pool with 36 members. We found that during the peak summer months (August in particular) it was overcrowded because of the number of guests. On one occasion 14 people were in the pool area on one key. A maximum of 6 people per entry key was introduced.

Also Lilo's and inflatables apart from swimmong aids were banned. There will be people who want to swim while others want to play so somehow both have to be accommodated.

We will rarely use the pool and made sure we picked a property as far away as possible but  I am sure some of those nearby would appreciate consideration, e.g. no loud music. Hours when the pool is available should be included - say 8 a.m. to 9 p.m. at most.

Hi to everyone,  I've been thinking, as you do on a wet Sunday afternoon, re:some of the Community rules Obviously a situation of "them" and "us" must be avoided at all costs, i.e., residents and holiday-home owners - everyone has paid for their apartments so all are equal, but the people who will be renting must be aware of and must adhere to the rules - this will be up to the people renting out to enforce.  Community rules printed & laminated and placed in visible areas of the apartment - just an idea. Although I don't think Los Gallardos is really an 18-30s holiday destination, but  we don't want a post-war Butlins stalag atmosphere on Los O do we?

Children:

1. Parents are responsible for the conduct and safety of their children at all times whilst using the facilities.

2. Children under 14 years of age must be accompanied by an adult or someone at least 18 years of age at all times whilst using the facilities.

Rules for use of the pool and communal areas:

1. The pool facility will be open between 7.00 a.m. - 11.00 p.m.

2. Noise is to kept to a minimum at all times, no shouting or screaming.

3.Swimmers must shower before using the pool, but no soaps or detergents to be used.

4. Glass bottles, glassware and barbeques are not allowed anywhere around the pool and garden areas.

5. If using  inflatable devices, consider other pool users. Do not leave in the pool/pool area overnight.

6. Hard ball games are not allowed in or around the pool area.  No running around the pool area. No dangerous behaviours, i.e., "bombing" or other behaviour that can result in hurt or injury to self or others is allowed.

7. Anyone diving into the pool does so at their own risk.

8. Suitable bathing costumes to be worn in the pool at all times.

9. Smoking is not allowed in the swimming pool area or in the communal areas.

10. No food is allowed in the pool or garden areas.

11. The swimming pool and garden communal areas are for everyone  to use, please keep these areas clean and tidy - remove all litter.

12. Keep the pool area toilet facilites clean at all times.

13. Dogs (except for guide dogs) are not allowed in the swimming pool or in the pool and garden areas.

I sound like a real tyrant don't I??  I'm not really just want rules that are liveable.  Working on washing lines next! And awnings etc, etc. Folding washing driers do not dry sheets.......!

Have looked at the rules and feel that they are very reasonable - we have young children and more than happy with the comments.

As far as sun loungers go will it just be a case of bringing your own out or we will be buying some as part of the communial charge?

I like Loraine's rules - note the inflatable rule which I think more flexible.  I don't use these things myself, but I do know how much pleasure children get out of them.  

Also re chairs loungers - I would rather we had some communal ones, but am happy to go withthe majority.

Yes we should all have an equal say regardless if we are living on site or not.
Are we trying to run before we can walk, with these rules!
Although it is not an 18-30’s destination some of us have grown-up children in this category that will be using the apartment, we need to consider the diversity of owners before making sweeping statements and rules. Are we not all reasonable adults?
How are the rules going to be imposed?
When people let out their apartments they are doing so in good faith and will not be on site to monitor conduct, are you going to have fines or prevent these people letting out their own property?
If the dog’s fouling come from other areas on the development are you going to prevent people walking around our street? Or fence us in?

Hi to all,  firstly can I say in my defence - the thread title is: "Community Rules for consideration" - not rules written in tablets of stone, but obviously everyone will find something that they may agree with or disagree with.  What I meant with the 18-30s destination remark was that Los Gallardos is not Kavos or Aya Napa.  The people that go on that type of holiday wouldn't look at Los Gallardos - its too quiet! I am sorry if I've offended some people -  that was never my intention, I was just trying to put forward some suggestions .  Believe me some of the rules and regulations that I've read up on make the suggested rules seem soft!  I don't know how rules would be implemented, that is something everyone would decide at the Communidad meetings, with votes given to some by proxy. 

Once again sincere apologies to everyone.

Hi everyone,
Just to backup what Loraine just stated - my intention for starting this thread is exactly as the title states i.e. rules for consideration - just somewhere for recording what people come up with as ideas (or have seen on other forum postings) that we can then take forward to the setting up of the Communidad where we can vote on what we want. 

When the first meeting takes place depends I guess on when there's enough people to make it reasonable to do so (and should perhaps, in theory, be when everyone has completed, so we all get to discuss and vote on what we want). However I'm not familiar with the process so am guessing.

So, keep on inputting your ideas - debating what should and what should not be included should probably be better done over a few bottles of wine on a warm sunny evening in Los Gallardos (there's me dreaming again....) rather than emailing from a cold and wet UK.

Ailsa and I are flying over for 4 days - arriving Thursday night - very much looking forward to meeting as many of you as we can fit in, in between shopping trips....

Hi to everyone.

A few points I would like to be considered as to possible sugestions from Loraines' post.

The age limit of children under 14 are to be accompanied by an adult you sugest. I agree, however what do you class as an adult as my son is 15 1/2 and has been swimming for some 8 years. Does he constitute as a minor ?

The pool hours shold be restricted more than 7am - 11pm. - I think more 8/9am - 9pm would be more suitable as in line with any local hotels due to personal time/noise issues

In this day and age, just about every bottle of drink conceivable, i.e. Water, Beer, Wine, Coke ect; comes in plastic bottles, therefore, I would sugest that drinks are permitted but restricted to plastic bottles or drinking beakers.   NO GLASS.

At what level do you restrict No food. I agree with the element of people eating lunch/dinner by the pool and BBQ's although, what harm would a packet of crisps or buscuits be.

All issues regarding ball games, inflatables and diving / bombing should be in line with sugested points, but other restrictions / possible acceptable things should be under review as we go along. Perhaps for the first year we start with the basics and evaluate on a monthly or quarterly basis as to what would/would not be acceptable for the fortcoming years.

Hi all  .Missed your last visit Drew but met your neighbour from Glos.who kindly gave us his straw berries when leaving. & Dave & Ailsa hope we wiil meet soon.It,scomforting to read the various opinions on the Community Rules ,to see that everybody is prepared to throw the subject for open discussion, with not the slightest suggestion of anybody being dogmatic & letting the rules evolve with experience & not set in stone.I think it all bodes well for the future.All thebest Haydn & Judy.

Hello to all

We have been looking with interest at the discussion on community rules and it has just occured to me, Eddie in 20B must have a good knowledge of community rules having already lived in one.

It has also occurred to me that with luck he may have a copy of the rules of his former community on which we could all possibly base our future discussions.

We would agree that, the residents should have more weight given to their opinions.

We are just about to instruct our solicitors to complete and hope to meet you all soon.

Hi All Los O's,

With regard to the community, I think It more important at this stage that we put in place a committee to oversee the rules, and let the builder know we have done so.

We can establish the rules with progression, but if we dont put the committee in place the builder will have to appoint someone, (he may not ask the residents about it.)

I am more than willing to do a data base of all the residence for contact purposes. But feel one or two of the full time residence should come forward to start the committee. i.e Chairman and secretary to start with, we can always change what we do but must get started soon.

I think it is good that so many suggestions are coming forward with regard to community guidelines, and it is useful that Loraine has come up with a basis for us to discuss.  My thoughts with regards to this are:-

Assuming this "under 14 must be accompanied" relates to the pool area - I agree there needs to be some guideline but it should take into account a childs swimming ability and lay the emphasis on parental responsibility to assess this.  I know many a 10-14 year old who can swim much better than I can.

Whilst I can see that we wouldn't want food/drink being taken in or around the pool, other than perhaps plastic containers of water and a pack of biscuits etc,  feel it would be a shame to too restrictive in the garden areas.  Especially those in upper apartments who have no private garden area at all, might like to partake of a sandwich and a refreshment on the grass.  Indeed, I had rather hoped that we all might get together as a community now and then to share a bbq or picnic feast in the gardens.  I do see that waste food and rubbish could be a problem and that people must be encouraged to take their waste away with them for proper disposal.

Not smoking in communal areas seems a little vague to me as well as being contradictory to the laws of the land.  Just what is a "communal area"? I assume it incudes pool and garden areas but what about pathways and roads??  We should remember that in Spain it is unacceptable only for people to smoke in indoor public places (and so many bars and restaurants are already flouting that) but perfectly ok to smoke in the open air.  I cannot see why we should try to impose anything too different.  In and around the pool may be reasonable (not least of all because your fag would get wet and go out!) but I can see no reason why people should not smoke in other open air areas.  Of course, they should be encouraged to remove their cigarette butts as with any other rubbish.

Overall though, I think the suggestions so far have been sensible and sufficient to make a starting point from which we can monitor and adjust as appropriate.  I agree with Don that it would be really helpful if those resident on Los Olivos could form a starting committee sooner rather than later.  Of course, involvement is a personal choice but as those who will be most affected by activities on Los Olivos it makes sense for them to have as much input as possible at this stage. 

It also occurs to me that our discussion so far seems to be all about the pool and gardens.  What about other things like appearance of the properties?  Should we have some guideline regarding building adaptations, sat dishes, wrecker designs, colours for exterior walls, washing lines etc etc?  What about residential noise and activity?  Some might wish to enjoy the spanish habit of sitting outside til late at night sharing a drink and a discussion with friends, but will that suit a neighbour who likes to retire early?  Knowing how noise carries through the apartment floors and walls, might we even restrict indoor activity that could cause a nuisance to a neighbour?  Our rules could be endless......

It seems that many of the apartments will be let out to holiday makers for at least part of the year.  With the best will in the world, it will be impossible for the owners to ensure that their clients abide by the rules.  We can make sure that people are aware of the rules but it will be their choice to comply or not, and surely it will be up to someone acting for the community to take on the onerous duty of speaking to any offenders.  If the nice approach doesn't work, what then?  In the most serious of cases, would the community have the power to expect those holiday makers to leave their rental?  Perhaps owners could impose some form of damage deposit that would be lost if more than say 3 warnings have to be given by the community representative?  Ok, we might think twice about renting out to a bunch of 18 year olds, but that could be quite judemental.  As someone who has let out property in the UK over many years, I know that it can be the most unlikely family people who go on to cause a problem whilst a bunch of students can be most considerate of others.  You never can tell.

Lots of food for thought......but not by the pool!

Please take a look at "Horizontal Property Act" (Parts 1 - 7) which was written by Lawyer Maria de Castro. It's in the list Latest articles of interest from Eye on Spain.

This gives an insight into the running of a Community of Owners and may help us all to get our Community up and running.                                                                                                                                                                                                         

Is it a forgone conclusion that Marinasol will be our Administrators?   If not,  then how do we change them to say Alhambra?  Does anyone know the address & Tel. No. of Alhambra so that the Los Olivos Community can start the ball rolling?!

Hi all,

Just for info.  I've received a telephone call tonight from Marinasol saying that in order to assist with connections could they please have my property number as it had been ommitted from the papers sent to them and that they would be emailing me shortly with details (also needed to clarify my correct email address).  I assume BMS have passed on my telephone number to them?? But obviously they actively participating in the process (whatever that may be).

Just a thought!  I had assumed that we would have to form a Communidad to become legally registered as joint owners of the shared area including pool , gardens etc.  This is what usually happens. However, when we completed I was surprised to find that although we have exclusive use of the land at the back and side of our ground floor apartment. and a parking area we would not actually own the land. The price of the ground floor apartments varied with the size of the plot  and I had assumed we would own it. I'm not bothered about this - just surprised at the time! But perhaps the intention is that we will not jointly own the shared areas - just have use of them. Marinasol are then presumably acting for the owner of the land - the developer. Our escrituras do say we each have a vote. I wonder when we will find out what is going to happen.

I was told by my solicitor that the builder would retain ownership of the land untill the community is set up, the land will then be transfered to the joint owners (community) and each woud have a percentage share.  This  I am told is standard in Spain. I could double check if you like as my solicitor is still retained by me untill I collect all documents.

Hi All,

We were advised at the time of completion (and it is stated in our deeds) that our ownership responsibility would be 1.30% of the commmunal area.  This would also be used to calculate our contribution to community fees.  This figure was calculated by the number of the apartments on the development and the size of the apartments.  Going by this figure we will have 40 upstairs apartments with a ownership responsibility of 1.30% and 40 downstairs apartments with 1.20% responsibility (assuming all the downstairs have the same %?).

Thats if I understood it correctly of course
