I'm not absolutely certain on this one, but I do believe that the Bank Guarantees we were given have an expiry date. We need to get together on this one to ensure that we are not left with worthless pieces of paper in a couple of years time.
Will everybody please check their Guarantee to ensure that all is in order. My understanding is, than on the stated expiry date, we need to engage our solicitor to negotiate another Bank Guarantee. Failure to do this could result in the Guaranteed funds being lodged into the promoters account.
I don't think any of us would like to see that happen!

I can confirm that our guarantee has a 3 year life span, as I bought in phase 1 26 months ago we will be addressing this problem in the next couple of month in order to sort it out well before it expires

hi everyone
not posted for a while, but have been reading everyone coments on a regular basis, did not want to be negative about anything as this is still our dream and still trying to stay positive. Things do look encouraging so lets hope it continues that way.
we have recently contacted our solicitor reguarding our bankers guarantee and it is for 3 years ending march 2009, lets hope we are property owners before that date.
We are holidaying in murcia in Aug (This will be the families first time out there) so lets hope by then there is something for them to see.

I think that if the developer has not completed the property by the time your guarantee expires then you should be able to make your claim against it as the developer will be in breach of contract. However I am not entirely certain of this although I have heard of people having deposits returned plus interest in cases where the developer has not kept to reasonable timescales.

Hi All/
we also have a 3 year bank guarantee issued by La Caixa. Did everyone get a bank guarantee as there was some suggestion of a 'company' guarantee being issued to some buyers?

We bought at TH in august 2005 with NO bank guarantee whatsoever, we have been trying for almost a year now to get one but its like trying to get blood out of a stone, Any ideas would be greatly appreciated

We actually paid our money October 05 but apparently our contract is from March 06 and the bankers guarantee runs from March 06 also. The acutal guarantee was negotiated for by our agent so I suggest you speak to your agent to see if they can arrange that for you.

Hi All when we bought in July 2006 we were told the price of a Macarena at there sales office at El Trampolin but had already had a price from our agent who was meeting us there,but the price Trampolin told us was slightly less,this price seemed very good to us but to us it was about to get a lot better,we were then offered a 50,0000 euro discount if we would except a company guarantee not a bankers guarantee,we did not make any decision for few days but decided to find out as much as we could from talking to as many people as possible, and conluded firstly that we could afford to take the risk as the deposit they required was reasonable with the money we saved we have had our Macarena put on two plots plot 51 and plot 52 any one with the new plan will notice there are less plot numbers now on the side that we are on as plots 51&52 are now just plot 51. If it all goes pear shaped which i dont think it will, those with a bank guarantee will have a battle on their hands to get their money back,if it all turns out ok my gamble will have paid off........... see you in the sun soon i hope...............

I am beginning to think that it is only neil and me that have actually parted with 50% of the purchase price, Am I right? let us all hope to god that everything does go ok as we have bought an alhambra.

There are clearly many prices for each property. Which price you pay will depend on whether you want a bank guarantee for all your deposit ,a portion of it or none at all.
Holding Company Guarantees have been mentioned also and whilst they may be better than nothing at all they might not be a whole lot better.
As always there were also discounts for buyers who clubbed together and bought blocks of properties (I am part of such a group).With Antonio everything is negotiable, especially if it means deposits will be released to GT.
I'm sure there are people who got a better deal than me and if they did fair play to them.
Having already signed my contract the most important thing to me now is that TH gets built. Once that happens I think we will all be happy with our purchases.

Without a doubt we all paid different prices for our properties,on the day that i bought the owner was sitting in the cafe and the sales girl was going back and forth to him saying Mr Cox wont pay the money you want, I'd been in 12 months before but walked away over the deposit of 50% up front ,I was using an agent who had an agreement with them for a small deposit with nothing to pay untill hand over of keys,So to conclude I have paid a small deposit on a lovely property on a lovely size plot on a lovely urbanisation if it all goes pear shaped I have plan "B" ...............

You certainly seem to have struck a good deal.
For those who have paid over a 50%deposit, don't worry, things are really starting to look up at TH.There are now 4 fully erected cranes on site on the latest Building Progress photos on the GT website.
I know this mightn't appear much to newcomers to this site but when you've spent months looking at pictures of palm trees on the golf course I can assure them its progress.

it does look like we have all paid different amounts dependent on the 'type of guarantee' and payment structure we negotiated. In our case our solicitor advised not to proceed without a bank guarantee. Another similar issue is whether contracts require final payment made with the 'handover of the keys' or when the title deeds (escritura) are signed in front of the Notary i.e. the problems being experienced at El Trampolin.
It may be of interest to visit the Residencial Santa Ana del Monte (Jumilla) message board as the golf development there is amost exactly at the same stage of building licence application as TH with similar issues associated with Bank Guarantees.

Yes it seem we have all had differe3nt experiences, we only paid a small deposoit, but have no bank guarantee and no discounts, but at the end of the day WHEN everything is ok, lets hope we shall all be very happy with what we have bought heres to that day
