Hi Everyone, Dave & I received an e-mail from Sandra Rodriguez requesting our Bank Details, Account No. etc. I sent this reply - Please would you clarify a few things? Who are Marinasol? Who elected Marinasol as the Community Administration? Do Marinasol have any references, recommendations that the Community Owners could look at?
As you can understand my husband & I are very reluctant to give bank details out to a Company that we have absolutely no knowledge about!
No details have been received about how much the Community charges would be. Also how the charges would be divided between each and every one of the Owners. Please would you e-mail me answering these questions.
The response was - "The Promoter was who decided about the community administrator. We are a company which deal with the community adminstration in a lot of communities in the area.
At the moment, we are preparing all the documents for the community and shortly we will inform all the owners about a community meeting to establish all the points in the community (charges, maintenance, etc.)
I understand if you do not want to give us the details, but we are trying to update the data base to have full details of all the owners. Other Community Owners had given us their details.

Has anyone given Marinasol their bank details? They have our Name, Address & Telephone No, also our e-mail address as contact details. Please could the residents get back to me on this as Dave & I are really not keen to give out our bank details and wondered if anyone else has given their bank details out.

We have not knowingly given details BUT, I suspect that they are being collected through solicitors who will go ahead with them if owners have given power of attorney.
This would also explain why we have not been contacted as we did give power of attorney.

Hi all,
Marinasol contacted me by phone earlier this week asking me to clarify a) my email address & b) my Spanish property number as they could not read it on the paperwork that the Solicitors had sent them. They then advised me that they would be emailing me soon with regard to the Community charges, Direct Debits etc. I assume, therefore, that my Sols have already passed on my Bank Account details.
Spain does have a Data Protection Act by the way!! although you'd never have thought it.

I've not heard a word from Marinasol and I don't think that Janice has. If, as it seems, we are stuck with them, I do hope that they give plenty of notice of the first meeting so that as many owners as possible can be there. It will be good for us to be heard and take charge at the earliest opportunity.

This is just a pragmatic response, but I think that we are in a very weak position to do anything other than run with Marinsol for the first year. Owners are still stressed over various things - snagging, getting completed, the pool (thanks Rob and Linda for the very much appreciated updates). We are still worrying about connections and this must be the first time I have gone into a bank account only to be DISAPPOINTED that money had not gone out of our account. Not all residents who will be full time are in place yet, and to try to change would put a huge amount of pressure on the people who are in place, especially while they are also trying to get their own snagging etc done. SO, I suggest we all just run with Marinsol for the first year. The benefits would be that we don't have to do anything other than hand over some cash, the pool will be opened quickly once ready, and if my understanding is right, we still get to have our own rules and regs for the use of communal areas. We can then appoint a new company if we want to after a year. I should also say, that while there are no rave accounts of Marinsol on other sites, they do not appear to have been dishonest or disastrous - just a bit useless! I think we can live with that for a short time, for the sake of getting things up and running. We have a beautiful, and very friendly community, and I think to change companies is just giving us problems. Other views very welcome!!!!!!!!!!
As to the direct debit question, I don't think they can insist on this form of payment, they can simply bill you. So people should not feel obliged to give bank details. Sadly, I think they already have ours!!!!

I can understand the reluctance to give bank details to Marinasol. It is a pity that we haven't all been informed by BMS of the arrangements made for the Community. However, I would just point out that all other bills such as Electric, Water, Telephone, etc have to be by Direct Debit. Any additional expenses that Marinasol incur in collecting the charge from those that do not give a Direct Debit will increase the charge to all. For four years I was Treasurer for a pool with 36 members in Cabrera (not on Direct Debit) and that was a headache. When the annual bill wasn't paid I had to write again and then do further investigation. One problem was those living in UK changing their addresses without telling me - in spite of constant pleas.
The share of the charge that each of us have to bear was stated in the escritura we signed on completion. Like most I can't remember exactly the percentage but someone said recently that theirs for upstairs was 1.3% and worked out that it seemed to make each downstairs 1.2%. That seems about right. Marinasol will not know the actual charge until they have agreed maintenance contracts.

Hi All,
We have had an e-mail from marinasol advising us they have been appointed administrators.
They say they have our bank details and authorisation and will deduct €100 by diract debit.
I have asked them to explain where they got the information as it certainly wasn't from us.
I have also asked what the €100 is for and what they envisage the annual charge will be as i have heard of charges ranging from €150 to €500 on other urbanisations.
By the way they got our number wrong is that an omen.

Hi, received a reply to my e-mail around 1900 last night.
So a prompt response, no complaints there.
They will send notification of the proposed meeting to all owners.
Open for discussion will be all items re the community.
The monthly charge is not fixed yet.
The 100 Euros is an initial charge to get some money in the kitty for the community so they can start work ( contact community services,
maintenance, cleaning etc ).
All owners to pay the initial sum.
My feeling is that that is okay and when can we get this woman to transfer to BMS

On checking my bank account today I discovered €100 had been deducted which I assume was for Marinasol ( domiciliado su cargo ). However I have not been informed of any meeting as yet.

On checking our bank account we note that 79.64 euros has been taken out (Repsol Butano) and 84.21 euros (Seguros Groupama).
Does anyone know what this would be for - we presume it is gas and water but are not sure.

No, Seguros Groupama sounds like insurance e.g. contents ... although 84.21 sounds quite low for that.
Water will be under Gestion de Aguas Levante Almeriense and the amount should be 192.26 or thereabouts.

Have just looked at an email sent to me by Marinasol yesterday. It includes an agenda for the meeting to be held 18.30 on the 30th July, Minutes of the last meeting held 1st March, form to say attending or if not attending to authorise someone to vote for us, and a budget for the year from this August. No constitution.
The 1st March meeting was with the developer acting as the then owner of all the properties and appointing someone from Marinasol as administrator and José, one of the developers, as President - for one year. José is an acquaintance of old from Cabrera.
There is nothing on the agenda for 30th about appointing a Committee. Only approving the last minutes!, choosing awnings?, deciding opening and closing times of the pool, and approving the budget.
The budget total is for just short of 35,000 euros including Marinasol's fee - could be worse but I would expect the cleaning, garden and pool maintenance to be at a high standard.
We will not be able to attend.

Hi Eddie,
I would recommend editing your last post to remove your email, or at least change it so that it is no longer a link (e.g. put spaces either side of @) - otherwise you may get hit by spamming software.... good practice to never have your email address on any web site in fact.

I am surprised that there hasn't been more comment about the papers sent out for the meeting on Monday. I am not sure who might have access to this site so will try to be careful what I say.
Reading the Minutes of the 1st March meeting again, when José attended as the representative of 100% of the owners and elected himself President, I see that a Constitution, Statutes and Internal Regulations were unanimously agreed. We should each have copies of these - even in Spanish.
If ownership of the Communal areas is to be transferred on the Property Register from the Developer to the 80 property owners I assume this will involve legal expense. I say if.
First item on the agenda is to agree the 1st March Minutes but only the President was there. If you are going to the meeting and have any questions I am sure you will be told what it is thought you want to hear. Ask for anything important to be minuted but don't count on it being there when you eventually see the Minutes. Sorry to sound cynical but .....
