All these points are valid and worth using to support our case...What you haven't seen is what I put in my request to Rosa ,and our President was cc'd on it,  was that although  ie he did attend he did not advise me, and he did not represent DV. BUT ,as I and others were residents at that time, we should and could have been advised by the President of the meeting.

To be fair to AEA , and i gulped when i said that, it isn't their meeting as they say but from my understanding our President should have used his community ie AEA to advise all the residents of the meeting. I know that the president in Duquesa Suites did that.   So to me not all the resiedents were informed who could have attended the meeting, and this was because of a failure of an individual who was subsequently elected to the EUC management team, and thus as we were not represented and informed  so it must be illegal.

Jan...i probably have benn banned from receiving anything more from Rosa because she accused me of a missing a meeting with her when I was playing golf with Patrick Boland!!! ( i even lost that )

As usual thanks to JC & Pitby for the updates

As AEA will probably be taking the next quarters service charge from accounts at the beginning of July and may try and add on the El Hacho charge , I suggest we all recind any direct debit instructions and ensure that AEA submit proper invoices to us before payments are made.

Although I wouldn't give AEA a direct debit for anything (and we haven't!) I believe the EUC will be biling owners directly.  AEA are not the administrators for the EUC, apparently, so they will have no authority to collect monies on their behalf in any event.

The last macro-community did bill the communities' administrators, but this time they will be biling directly, I believe.

Jan,

Do you know what the process and penalties are if one does not pay ?  I assume most of us intend not to until we get some more answers at least.  I just wondered what authority the town hall etc will have to prosecute / withold amenities etc.

I imagine that non payment will result in court action by the EUC or council. That is the same action for community fees to AEA. When we are established and we are manging the community ourselves we will have control over what AEA or whoever spends on our behalf. And if you are in arrears you cannot vote in the agm and interest is applied to the debt.final restitution by the community re debtors is legally confiscation of the property and selling to pay the debt. And that is how it should be as we will have an elected board to manage on our behalf and its important we all pay.we might not like something but at election time we can vote for something or somebody else.

I totally agree that there shoud be penalties for non payment of fees but was unsure what these were.  I do however intend to delay payment for this el hacho until it is proven to me that it is a legal entity that will in fact be providing additional services for which I am not already paying.

 

On the topic of non payment of community fees - I am sure this will become a problem for us in the future being such a big community.  I hope we do find this is dealt with effectively so we are not incurring escalating debts each year that we can't do much about.

PS - I am bemused that the only reason I know anything about this coming tax is because Jan found out about it on another message board and was good enough to let us all know!  I have still had no official notification about it and the town hall minutes / notes don't even mention Duquesa Village at all.

Incidentally, it will be very interesting to see where they send these bills since we have no postal system other than a pile in the AEA offices (the location of which I personally have no idea having not been informed).

it was on manilva life where it was posted and as you say none of us had been advised.the minutes are on aea website which means diddly squat unless you know what it is and know where it is. I am not in a popsition to pay even if I wanted to as I have not been asked yet. Then I will consider it after listenning to the views of the protest group. I do know of people in other communities who have paid as they are of the opinion it is legal!! So not everybody it seems is opposed to it. As I said previously managed properly by the residents it should bring us all benefits. Its that student saying from the 60s ( showing my age now)..No taxation without representation!!!

CarolineJ...just noticed the post about the post boxes..we didnt know either officially ..it just seems to be common knowledge as every community has a pigeon hole in the same room. Don't think there is anything official anywhere about it...but i think this is where your bill will be...just like your water and electric bills.

It's just gone 7.30am, on a Friday morning, after an extremely late night (!!).   And what am I doing, after my son woke me up?  Reading EOS!!  I really do need to get a hobby!!! 

Fortunately, JC1 and myself just happened to be on Manilva Life at the same time, asking the same question about this EUC!!  As I've said before, I don't think we'll have anything from them in our post box yet, maybe because we are not a completed community.  Not sure, but there are quite a few who have posted here who completed some time ago who have not been notified of this or received bills from the EUC.

According to the Minutes of the EUC, there are "guarantees" in place for those who "decide not to pay".  What that means is anyones' guess!!

We, obviously, will be checking our 'pigeon hole' in Duquesa when we are there in July and see what there is.

We all have to check out what the policy is regarding non-payment (and DV owners will at some point be officially notified and billed for this) and take it from there.  But, obviously, we can't do that until we receive a bill!!

Personally, if a court action is taken against this by the group that is building up, I don' think the EUC will be able to do anything about collection of the monies until such time as it is deemed a legal and functional entidad!   They have already re-set a 28th February deadline for people to pay until end September, apparently.  Hence, we're not going to pull any hair out wondering about paying it or not, even if we have received a bill!!

And, yes, it's interesting to note that nobody has advised us of the post box in the port, outside AEA's office!!   Yet another shortfall in admin by AEA.  Glad that we have others who are willing to share information, otherwise we'd have no idea that a box in the port exists!!!

John, have the other people you know of paid because they believe it is legal or that they are of the opinon it is a good thing or that they really don't have an opinion either way?  And have they received full documentation about the entity and its functions/responsibilities?  Again, I don't have a problem with the whole idea, as long as it is elected and run correctly.

Now, a bacon sandwich is calling my name!!

jan...just after 7.30 here and i am starting working which includes scanning EOS and others...I am not vreally sure about their reasons to pay any more than I said but thinking about the voting for EUC alot of communities voted FOR and they are developed communities so one can only assume that they too will be paying or have paid. My source wouldn't go into detail.

for some reason i keep thinking that within the minutes of EUC meeting there was refence to lack of post boxes for for the residents...perhaps we might as a result get a decent system in place.

My bacon sarnie is waiting or is it the pool..didnt know you were allowed pig in an Arab country???

On the subject of post boxes I too remember the mayor saying that the town hall or post office def wouldn't be providing a system as we were a rural outback ( or something!) and that was one of the things the EUC money would supposedly pay for.  Unbelievable that we have to pay for our own postal service but then again when I too lived in Dubai we had to pay for PO boxes or use our employers'.  Is the much talked about postal delivery service in Dubai in place yet Jan? (Don't laugh too loud - you might wake Nigel up!)

Caroline, we are still using "the house about 50 yards down on your left after you've turned near the bank on the corner from the first interchange" direction system for taxis!!  How on earth are they going to deliver post!!  Could you fit all that info on an envelope???

In fact, saying that, the one and only taxi service here has decided to update their database and no longer has directions to the house on their system, so we're having to walk out to the main road to flag one down because it's quicker - although not nice in 40c on a Thursday night!!

My bacon sarnie went down very well, John - along with the very sensitive head!!  Funny place out here - you can go out and get sloshed while eating a pork pie during the holy month of Ramadan if you like, after 7pm, but you can't do it listening to live music!!  Personally, I think it's because the live music would interfere with my drinking method!  I might have to put the glass down to applaud or something!!

Yes - Dubai is a 'funny old place.'  You can't drink water in 50 degree heat during ramadan even if you're not Muslim but you can head down the Cyclone or Garage and hire a couple of Russian hookers even if you are...

As the minutes of the meeting in November clearly show allocations to communities of 100% WITHOUT Duquesa Village or Duquesa Hills, surely the lawyers would have to go back to the Courts to alter the percentages to include us and this might be a good blocking point for our lawyers to use.
