We completed in Costa Caribe II in late December 2005. So far we have heard NOTHING about any local Council or Municipal Tax (similar to Rates or Council Tax in the UK)  We pay something like 115 euro every 3 months to Servicom Oropesa. I don't really know exactly what this payment is for. I presumed it was some sort of Maintenance charge. Can anyone with properties at Marina D'Or tell me if they have paid a Tax to the local Council or Town Hall,  If so, why have we never received any such bills, some 18 months after completion. If we are liable, how much is the bill likely to be for a 2 bed apt? Alexander Homes are unable to give me a definitive answer to this and suggested that the money we pay Servicom may cover any such tax!!!!! Doubtful.

I have also seen other threads discussing "Spanish Wealth Tax". Anyone in a position to elaborate, as again I am at a disadvantage?  I certainly do NOT want to find myself suddenly landed with bills for maybe thousands of euros now, solely because as "Jennydor" says, "In Spain it happens when it happens" or words to that effect.

Any help from others with experience of these two matters would be very much appreciated.

To all people that have recenthly purchased property in Oropesa, Marina Dor and other areas.   You will receive to your Uk address a letter from the Oropesa Council relating to your Rates similar to this one: 

TRAMITE DE AUDIENCIA
En relación al expediente seguido en el Departamento de Gestión Tributaria ­Recaudación de este Ayuntamiento referente a la primera liquidación de alta del inmueble situado en AV CENTRAL, 3X 1 07 357 EDIFICIO COSTA CARIBE I, REFERENCIA CATASTRAL: 7451701BE5475S0357, del cual figura Ud. como titular catastral con domicilio declarado del extranjero y considerando el articulo 3.4 de la Ordenanza Fiscal reguladora del Impuesto sobre Bienes Inmuebles "los sujetos pasivos que residan en el extranjero durante mas de seis meses de cada ano natural, estarán obligados a designar un representante con domicilio en territorio español, a los efectos de sus relaciones con la Hacienda Publica" , se pone de manifiesto el expediente y se le da audiencia para comparecer en el plazo de 10 días, de conformidad con el articulo 138.1 de la Ley 5812003, de 17 de diciembre, General Tributaria, a efectos de poder alegar y presentar los documentos, y justificantes que estime pertinentes para regular el domicilio fiscal del inmueble señalado, advirtiendo que, en caso de no aportar ningún domicilio se hará coincidir en los recibos posteriores, el domicilio fiscal con el domicilio tributario.

El presente tramite de audiencia servirá de notificación individual de la liquidación de alta del inmueble señalado, advirtiendo que las sucesivas emisiones de recibos emitidos en concepto de I.B.I. Urbana se notificaran colectivamente mediante edicto.

Para su comodidad, puede domiciliar el pago de los recibos en la OFICINA MUNICIPAL de Recaudaci6n, situada en Cl PINTOR SOROLLA, 15 de Oropesa del Mar, con teléfono: 964310100, y FAX: 96431053

Dear Sir,



The letter you have received from the Council offices of Oropesa is in
relation to your first payment for council rates of your property in this
country.



You stated that you are resident outside of Spain and according to the
article 3.4 of the fiscal law of the property tax, states "if a person lives
outside of Spain for a period of over 6 months of each year they are
obligated to designate a representative with an address on Spain in relation
with the Spanish tax system".



You have 10 days according to the article 138.1 to do this.  In the case
that you don't the address of your property in Oropesa will be used in
future communications but at your own risk.



The document you received was a personal notification for the required first
payment of your property.  Future notifications will be to the whole
community and not personal to yourself.  For your convenience you can
arrange the payment of this and future payments through your bank to the
"OFICINA MUNICIPAL de Recaudacion".  The full address is on the Spanish
letter you received at the bottom

COMMUNITY CHARGES ARE NOT PART OF COUNCIL TAX OR SPANISH TAX SYSTEM CHARGES.

Te Community Charges Cover thinks like:

The wages of the apartment block caretaker.

The cleaning of the communal areas, swimimg pools, passage ways, lifts, children areas, cleaning of the parking bays, the cost of the communal lighting, the cost of the administrators (in most cases SERVICOM). General building insurance (but not the insurance of your apartment : dors, windows, furniture, contents, thirt party liability etc).

But remember DO NOT COVER Council taxes,(Contribucion Urbana) or any other goverment taxes.  Water Rates (metered).

Hi, to all propietors of Marina Dor (Oropesa) Apartments:

Normaly you will get the first letter from the Council , 18 to 24 months after signing the deeds.  The current average Council Tax, Rates (Contribution) per year is around 200euros, including 24euros per year rubbish collection. The owners of apartments on the following building have to pay the corresponding taxes.  Trebol I.- II,- II,  Costa Narfil I,  Playa Coral I,  Costa Caribe I, - II, - III.

Thankyou for your response. As yet I have NOT received any letter from the Council after 18 months, but it seems from what you say that it will arrive in the next 6 months. You say that owners of apts in certain blocks which you have named(of which I am one) will have to pay the corresponding tax. Does this mean that the rates for the blocks you mentioned have not been set yet? I have read some information about the Wealth Tax but I am not really too clear yet exactly what is involved.

I do appreciatr your help, thankyou.

Hi

We completed on an apartment in Costa Caribe II in November 2005.  I believe that the local rates/Council Tax/IBI for 2006 was paid by us to Marina d'Or in their final invoice before completion under the heading 'Providence Fund'. This covered odds and ends such as provisional IBI/ Plus Valia, the Notary's fees, registration of ownership, I.T.P y A.J.D. Modelo 600 whatever that is and Factura Tramitacion ditto. This Providence Fund was an estimated amount and we received a refund of £500+ euros just before Christmas 2006. Presumably then all new owners will have paid their Council Tax for their first year in this way.

I have never received a letter such as the one described by Daniel, though we did have an initial problem with mail. However, a couple of months ago I received a little form (Notificacion) from the Ayuntamiento de Oropesa (which we should have signed for but the postman put through our letterbox in England).  The bottom half appears to be a receipt for council tax/IBI for 2006, and the top half refers to IBI for 2007 for the same amount and has space for our bank account no.  On the back in small print is Notificacion ... and the heading Resolucion and the rest in Spanish which I can only understand little bits of.

Please could someone tell me if I'm supposed to fill it in and send back to the Ayuntamiento de Oropesa, or send it to my bank in Spain, or what? I'd be very grateful for help. Thanks.

Hi

 

I have received the same request in May. I have send a letter with the address of a family member leaving in Spain and ask my bank to pay directly to them ( via electronic transfer) They stamp the payslip and after thatyou should be safe.

I will strongly advised you to send a letter via recorded delivery to the council office,as there  was a dateline to pay which was unachievable as I received the letter after the dateline!!!

I have called the council and explain and they were find about it. I think its just a formality that if you don't pay one year they can go back to who ever you told them is leaving in Spain..

Thank you for your reply. Unfortunately my Spanish is not quite up to having a sensible discussion over the telephone with the Town Hall in Oropesa, even though I have been trying to learn for a few years.  Also, the form I have received doesn't seem to have a recognizable bank account for the Ayuntamiento, which is why I wondered if it should be sent back to them with my account details, rather than taking it to my bank. Also, I cannot see a reference to a date by which it should be paid so I wonder if I've got a different form.
