jmtwsm, I am only expressing how I am feeling. And you must admit Arenal/Gerens/Cajasur have or are acting unprofessional. They have sent out poorly translated letters that tell you nothing, apart from 'We value your custom' I am sure they do! Because at the moment we are being treated like idiots.
I agree with Elaine, with so much money waiting to be claimed by A/G/C what is the problem. When Paul Cox left he assured me that the licence should have been granted by May, but he said if we missed then he was very concerned as to when we would actually receive the licence. We seem to be given a different excuse on a monthly basis. We have been told it is the road, and then the new mayor being voted in, now we are waiting for them to do a site schedule. When in all honesty the site building schedule should already be there.
I am hoping to purchase a holiday home for relaxation purposes for myself and my family, I am aware that it is all a roller coaster ride, but quite frankly I believe I am having the wool pulled over my eyes and I for one would like to know why?
What are the real problems as to why we have no licence and basically when will we have a licence so we can complete on the properties? Not a difficult question... but a question that A/G/C find very hard to reply to...infact they seem incapable of replying. It is not difficult to send emails to all solicitors involved explaining the problems they are obviously experiencing, but for whatever reason they choose not to do this, consequently it leaves myself and some of us (the client) dissatisfied with the current situation. I have for 3 years been very excited at the prospect of owning an apartment on CDS, but unfortunately the current situation is making me have doubts and for the first time I am considering cancellation. I am losing confidence in A/G/C.
I run my own business here in the UK and if I treated clients like I am being treated I would be unemployed. They have no understanding of customer care. Which surprises me, especially with Spain experiencing property/building problems you would have thought they would have been falling over themselves to obtain the licence and have Phase 1 completed.
I shall be interested to hear what PEPS has to say when she comes back on line, after her holiday there this week.

I agree with Laurdan, my enthusiasm has waned dramatically in the last month simply because there appears to be no tangible reason for the delay. When I last spoke to my solicitor she said that two weeks after the elections we would have a decision regarding the road therefore the license. Those two weeks are up today so we shall see what transpires. Compensation was supposed to have been sorted out by the 13th but I have heard nothing. I will give it till the middle of next week and if I have heard nothing I will be on the case. But the longer this goes on I get a really bad feeling about it.

Have a theory. Gerens are obviously dealing with us and Arenal Golf. Arenal Golf is much further along than us, they have more money in the bank from these clients. If you look on the site for Arenal golf a large amount of clients are now in the process of trying to recover their money. I dont think there is anything more sinister going on than we have been put to the bottom of the list. Our site only has phase 1 complete, the other 4 phases have probably only had the initial small deposit paid. Even if we pull out on phase 1 we are a much smaller group than Arenal Golf.
I think the developers are trying to finish the larger site with more at stake, we receive no info that actually means anything and I think that is exactly the way they mean it to be.

My husband spoke to our solicitor today . She has no feedback as yet re compensation or cancellation of the contracts discussed at the meeting with gerens on the 13th.
She feels that the habitation licience will be awarded by the end of june with completion happening in early July...
The issue is still who is responsible for the costs and construction of the road to the development.
Also likley that the gardens that looked great in may are overgrown and site will need to be cleaned up before we eventually sign off.

I fully understand your frustrations etc etc - but I don't feel your doing yourself any good by all the negative thoughts you have !!! I must say, I have never seen so much despair from a forum member. Do you have a lot of spare time on your hands or something.
I agree with you, on a buisness level, customer service and all that goes with it has not yet reached Spain, maybe in another 20 years they might have grasped the concept !! Its just something you have to accept at this stage. But, as a purchaser of property, you must have known some of the pitfalls and stresses you would probably encounter?
Have a look at number 5 on the Forum Rules ... BE HAPPY, ENJOY THE FORUM
Try talking to the rest of us about something that is exciting - come on - BE POSITIVE - you have made a good choice in your holiday home and area.
Promise me one thing, don't start wondering about the concrete mix ratio used in building our Apts !!!! I really don't want to hear about that one. !!

Sorry Ridgebacks, have to agree with Laurdan and Alan Spencer, the joy of buying in spain is now gone and one big headache has replaced it.
Over three years waiting on your dream vacation property with no end in sight is pushing our patience to the limit. We knew all the pit falls involved in buying but nobody could have forseen the stand off between the developers(not even the original lot) and the Town Hall.. I know the Spanish take twice as long to do anything but even you have to agree this is way toooooo long to have to wait.
At this stage would consider pulling out of the contract but dont think that's as simple as they make out.. ..
No choice but to wait but am not very happy bout it.........

Not posted before but agree with what Ridgebacks is saying, though appreciate all others concerns. I'm on Phase 4 so I have even longer to wait and signed up almost 3 years ago myself. One of my friends has bought on Phase 1 based on my recommendation ( he got a cancellation) but he is really pleased with the quality (he got Paul to take him into his property at Christmas) and I managed to get into the shell of my Phase 4 Block 7 by getting through the fencing on a Sunday ! I'm more concerned that the new contractor will not achieve the quality seen on Phase 1.
I think the location is perfect and it will all be worth the heartache - I am in construction so maybe my expectations are not so high! I don't expect to be in occupation until next summer -it may be complete in Spring but I'm wondering if it will take 3 months to sort out the papaerwork. If Phase 1 has 500 units then will there be a mad rush by all to get their's priotitised - being pessimistic, if one person deals with the paperwork of 500 units, then based on a 5 hour day, and 1 hour per unit then could it take from 0 - 3 months depending on your "slot".
Has anyone been given an indication of how long all the paperwork takes?
PS Do we get an invite to the party too!

Quite agree with you Sandra. I dont think it is being negative but trying to get a realistic overview of what exactly is happening, what the delay is and getting an exact date. I myself was not in a rush to complete but it does get very annoying when the reasons given change from week to week and there is no further work done. Alot of us have invested quite alot of money and as long as we are kept informed to what exactly is happening then we wouldnt have to be so critical of the professionalism of this developer. Another thing that did annoy me was that my solicitor advised 'we must stay on friendly terms wth them' more or else dont upset the apple cart or you wont get your money back. The problem is theyve got the trump card cause they ve got our money so until our Solicitors pull their finger out and get some correct information and dates we ve got to sit back and wait and wait and wait.

Hi again everyone,
Just had an email thro from my solicitor advising the following. I quote
At the moment we cant confirm you any date regarding the devolution of the money, first of all we have to send them a list with the clients that are interested in cancelling the contract and after that we are goingto prepare the payments, because they cant frefund the deposit at the same moment.
Of course we have to determinate a date for recover the deposit, this is something essential that has to be determinate before the resolution of the contract.
According with the contractual terms you have 15 days after the 30th jun to communicate to the developer that you wish to cancel the contract, but we are trying to do that a a friendly way, we we appreciate a prompt decision regarding conceding a new completion date or regarding canceling the contract.
We have a meeting regarding that and we are not going to charge you any legal fee for this additional work that is quite different to a normal purchase transaction, but the costs of doing the formal notification has to be paid by the clients.
Please also note that in future the developer changes his policy or if there is any problem we will see the solutions and the costs, but according with the actual situation the developer is cooperating and they seem to be open and they want to satisfy their clients. Regards

Thank you for your posting Karen. Basically we all just want to know when we can complete on the property.
That may make sense Elaine that Arenal Golf are being finalised before us. I don't really care what they finish off before our development, all I want is a time schedule. If they say next year, not good , but I would like to know.
Contrary to what impression you may have Ridgeback. I have my own reasons for wanting to know what is going on and when it will be going on, so that I can accommodate it into my schedule. I don't feel that is unreasonable, I am sure that other buyers are in the same position.

If you understand my frustrations you'll be the first man that has! . Unlike you I can allow myself to have negative and positive thoughts. You need to look back further you will see that I have been very positive in the past. It is only recently that I have become disillusioned with this project. Wake up Ridgeback, get a grip, obviously you have everything riding on Arenal Duquesa and only want to hear positive comments, and there is nothing wrong with that, but you can't bully me if what I say is not what you want to hear. Shame on you

Go Girl!! I think we will finalise before the summer is out. But I must admit the info is alway so fuzzy its like no info. I am in the fortunate position of just wanting to use it for holidays. But I retire in 20 years and Im not sure if I should put my retirment back 5 years. It will all be ok, just hang on in there. My cheque has now cleared on the rental villa near the apartments so we will probably complete just before I fly out! Negative thoughts come from frustration and I can understand how you feel. We are all grown ups who cannot get a straight answer. This time next year we will be laughing about it. I do intend though to put the great Gerens letter in a frame and put it on the wall in my apartment. Gerens know they can play us for a little longer until they have finished the other site. Hold your nerve for a little longer, it will pay off in the long run.
Or just have a very large vodka, site out in the English summer rain and pretend!

Hi everyone,
We were out in Duquesa in January 2007 and was actually allowed to view the apartment which was complete apart from the oven hood being attached to the ceiling! The finished apartment is lovely and to stand on the balcony and look at the pool was ideal. However, it was an interesting coversation which we had with the Site Manager who took us into the apartment. We happended to ask him if he thought we would be in a position to complete in April and he actually said, and I quote: May, June perhaps even July but you will agree it will be worth the wait until July as everything will be done, and we will have had time to go round all the apartments and do the snagging before completion! I now wonder whether he, as the Site Manager, knew something that the rest of us didnt know!!!

Ok. My sister in laws parents live in Estapona and are also buying an apartment in the same phase. I spoke to him today from spain. They went to the apartments last week, and took with them an english builder friend. They were allowed into their apartment, they think the finish is excellent and the builder also thought the same. They spoke to the staff in the sales office who seem to think the hold up is the change in mayor recently.
Also, a couple of their friends also had apartments on this phase, they decided not to continue with the purchase, they have received their monies back and interest. From the info I got today I am going to definately continue with my purchase. I have asked them to give me more info next week.

Thank you Ken & Lyn for your kind words, I am afraid that I was not able to read what jmtwsm wrote about me in his/her posting that has now been edited clear. Shame really I am always up for a little banter . The purpose of the forum is for all members to be able to express their views, these views may be positive or negative. As potential owners of a property in Spain it is always wise to listen to all views. Each individual takes from the forum what they deem to be of interest to them, we all have our own circumstances/reasons for buying a property in Spain and should apply the information accordingly.
I do wish Mr Mayor would get a move on though as it would be so good to be able to move in this year!

Im intrested to hear that some people have recieved their deposits back. Did they have to go to court or were they returned by the developer when requested.
Maybe i have the wrong lawyer but he doesnt seem to know much or how to get my monewy returned , which is the only way i want to go, now,
