looks like a class action would be the best way forward with your solicitor  my main concern  is that if we sign any cancellation papers we presumably give up all rights to the apartment with no guarantee of being recompensed but if we don’t cancel at least we hold some sort of title deed to the property which at the very least stops them selling it on to someone else and making even more money from the development.

Could you ask him/her as to the above for their understanding in Spanish Law and any recomendations

And I for one still wish for the apartment to be finished but getting more pessimistic as time goes by

URBASA ARE SUPPOSE TO BE STARTING WORK AGAIN BUT WHEN

i am contacting the solicitor on wednesday to take urbasa to court

In relation to the above purchased property by which you have cancelled, I hereby inform you that the accounts department has been looking into your file. They have informed me that the Real Estate crisis that is existing worldwide is affecting us, therefore, during these months including November and December our financial department is searching for financial help, therefore, it is not as from January 2008 that we can include you in our reimbursement provision, whereby the reimbursements are done via payment calender. We ask you to please give us this margin of time until we can obtain finances.

i do think they will finish the building off sooner or LATER but personally i think it could take a few years more

I told her that i would be hapy to wait if i get a bank guarantee that i will get my money back in jan 2008

just got email back they cant give me a bank guarantee

We have finally composed our letter to both Grupo Urbasa and to Palmera Properties cancelling our purchase, these have been emailed this afternoon with signed copies in the post - I will update if we ever get a response!!  Let the fight for our money back commence...........

Hi all just caught up with all your updates,b4 itell you how far I have got I want to say how lovely it was to meet Phil (was surprised you were male and not female) Mikeb and Vijam and hope you are all well. After reading the letter which Mike shown us when we met,I got on the phone when we arr home and spoke to the agent who sold us the apt (same people that sold Debazhers), he had'nt received a letter but I think Deb had anyway he told me he had photocopied everything he had and sent it by recorded del and advised me to do the same which I did, posted it Mon 22oct, thurs25th had a phone call from Ainhoi saying we had'nt received a letter as they had'nt got details of us but without going into detail all was ok with paperwork I asked if it was ever going to be finished and she said yes, reading through all your letters she told me the same as all of you they had a surveyor tell them 4mths work talking with different builders for quotes doing a big audit at the mo and it is in the best interests of all concerned to finish the build. She then phoned me back 1hr later to check if I had photocopied the papers or had i sent originals my reply was I know we may appear to be stupid for how we have been taken for a ride by you all but not that stupid. She did say sorry  and chatted for a while and I felt a Lot better, she did say it might be a while b4 we hear , but a lot to sort out and it will get finished and you might all think I'm gullable but I did believe her, and I do think one day we will get there.Fingers X I always said I would buy the bubbly and I will gladly Gabe .(for those I met in Almoradi Janet)

Not so sure all will work out, but of course we hope so.  In the past two weeks we've exchanged several e-mails with Ainhoa Reyes at Grupo Urbasa, thought you might like to read her latest reply to us received Friday 26 Oct 07:

"KINDLY SEND US THE DOCUMENTS WE REQUESTED AS SOON AS POSSIBLE.  THERE IS A CRISIS WITHIN THE REAL ESTATE AND FINANCIAL SECTORS WHICH IS CAUSING US DIFFICULTIES IN OBTAINING FINANCIAL HELP TO FINALISE THE SITE AND RETURN ANY AMOUNTS.  WE CANNOT RETURN ANY AMOUNTS UNTIL THE INTERNAL AUDIT IS FINALISED BECAUSE CLIENTS HAVE PAID MORE AMOUNTS TO PALMERA THAN WHAT URBASA HAS RECEIVED.  WE ASK CLIENTS TO WAIT A LITTLE MORE UNTIL WE CAN FINALISE THE SITE BECAUSE THIS IS OUR OBJECTIVE."

The fact is they cannot get any bank guarantees, so anyone needing a mortgage could be up the swanny. Remember too, they've said they want to finalise the site so that appears to mean they are not going to pay back until at least then, and there's no guarantee that the four months will be achievable as they are still looking for a contractor to carry out the work, and who is likely to do so for a company in financial difficulties...??? four months from when??? the request for documents appears to be an assessment of how much Palmera has gleaned off what was paid by us.  However, we wish everyone well in their endeavours to solve this dreadful situation, but feel it will take a long time, and personally we've been with it for five years so far having reserved in October 2002.

just found something out i just got the paperwork for the transfare of my money to urbasa i sent over through my agent £5,500  thinking all this was going to urbasa - got the paperwork today and only 5.124.49 as been sent

at the time i never new you could send it yourself

what as happened to my £400 that didnt get sent

i have all this in black n white

dont trust anyone -  i am going to look into this and get it sorted

seeing this as happened to me i would put money on it that its happened to one of you if not all  ask your agents for the transfare paperwork of your money to make sure urbasa have received all the money you have paid

surprise surprise!! guess what..yep, same problem arising.  Asking for transfers even though all receipts were sent.  They want everything backed up by proof of where the money was drawn from, and I guess some people don't have the information they're asking for.  It seems that the receipts from Palmera and letters received from them don't hold much credence in their audit, so boy are they stalling for time.  We sent everything we had paid in photocopied, they've said they received it but need more proof.  So looks like here we are into another sticky time with this. We sent the copies of stage payments made on the garage/storeroom for example, and also the total receipt received from Palmera's office in Blackpool, and would you believe they are not acceptable as proof of payment.  This is going to be a long slow nightmare, and I guess they think in time some will get so fed up they go away. 

if you have not got the paperwork i suggest you go to your agents or to who ever it is that sent the money over and ask for the paperwork  - crossing your fingers they still have it

 i needed all the paperwork to prove it and i got a little help from ionah she sent me my payments that urbasa had received, then i had to go to one of my agents to get the transfare papers then the figures started to add up

yes a bit more extra money for christmas  -  would be better if i got my thousands back tho anyway

I have cancelled my apartment at amarion 111 now,  

They havn't  paid me back  my money and my spanish solicitor is in the middle of taking them to court, He has taken money from my bank account and he is now waiting for the courts to sort out there paperwork

its ashame really if they got there act together and sorted either the building out or paid us off, they wouldn't have to pay court cost and solicitors fee's on top

but it seems they have no intentions of paying me at the moment  so i have no choice

i have rang them and emailed them and still i am getting nowhere

Hi all just had another email from a estate agency saying urbasa are going bankrupt and she does'nt think we will get our money back

but she isnt a lawyer its only her oppinion and she told me to get in touch with a lawyer
