If they are confident a building licence will be granted that's fine - what happens if not I wonder?

I would have no worries about there building licence as there is no set reason for the Town hall to refuse a building licence.

Look at the building thats going on around them and they have licences

Dont bank on the building starting first of Jan allow extra time becasue of red tape it may over run a month or so or suprise us all and strt on time.

If youy have a BG then you should have date put into that as to when the property should be ready. If you have not yet signed a contract and are about to do so add extra time onto the BG.

Your lawyer should have advised you not to sign a contract without a BG where no building licence exists. If you exchange contracts without a builfing licence and it all goes pear shaped you are exposed according to our Lawyer as the contract has no legal standing.

My BG runs out before the new completion date - They are for 1 year .  Completion date has changed from Jun 07 to Sep or Dec 07.   My solicitor is speaking to one of the Directors of PEINSA to see if info from site office re: licence in Jan 07 is correct.  After all we bought our villa in Oct 05.  She will email as soon as info from him is through and also with info on extending my BG to the new completion date and a bit beyond.

The very reason that there is so much building work beginning all around is the reason I am worried they may be having problems with it.  The Town Hall may be worried about water supplies as it is poor supply in this area I now know. Who knows what the hold up is?! Golf Invest seem to have theirs and same time started.   I am sure you are right and everything will suddenly come together though as they are a large builder and must know what they are doing. 

As you say - you can't rush Spain!

I'm the same my BG also runs out Jun 07 as we paid our deposit April 05..

Will be e-mailing our solicitor to speak to Peinsa , it's all very worrying don't think I'll ever purchase of plan again , I do hope they get the license the lack of true information given by Peinsa is very unsettling.

From my solicitor today:-

There is a delay on the approval of the licence that needs to be issued by the Townhall of Murcia due to the authorities demanding a modification of the project presented by your developers. They are requesting the developers to have it modified including more green areas and that is what is causing the delay with the licences. This requirement from the Townhall means that your developers do estimate that they will not be able to start working on the foundations until January 2007 and completion will be initially postponed to September- December of year 2.007. Your developers will be sending you a letter informing you of this delay shortly. You have anticipated their letter.

Regarding the bank guarantee, it will expire 30th June of year 2.007. A new one can just be ordered after this one has expired. A bank guarantee is especially relevant to have it in place when construction hasn´t even started. Once materials and work is invested in the site, the risk decreases, and especially if the dwelling is built or almost built. Therefore, I would suggest to wait and see how things do progress since we do not know how far the building will be at the time of expiration of the bank guarantee.

Like you I won't purchase off plan again either.

Certainly won't be looking at tiles yet either.

What a nightmare with the Licence no doubt I'll be hearing from my Solicitor also.

Just hope there won't be any other delays .

I am tired of it all to be honest.   I must have been very naive to not have found out about licences and BG's before sending all my savings to PEINSA.

Maybe good news in Jan who knows.

Hi All

Spoke to our agents today. They made enquiries on the building licence for me and said that the licences are issued for each phase of the development. Apparently Phase 1 is ok and thats the one most of us are involved with.

On the bank guarantees, i am just about to send over my 30% and have been offered a bank guarantee for €450 which is valid until completion. I am still a bit nervous about handing over the money however i think i will go ahead with the transaction
