Hi Investor

As a potential interloper you might like to think about the impact this issue has on other phases.  There may only be 5 villas on phase 1 but there are considerably more on phase 3 and 4.  So the waste of time and effort is of advantage to other buyers, even if not a concern to yourself, and after all that is what this forum is all about.  Surely if anybody has any concerns they need discussion and solutions to avoid issues escalating into bigger problems.  I am sure you will welcome any reduction in your community charges if it is agreed that villa owners should contribute to costs.  I did not purchase a villa to be isolated in its grounds.  We were told by Roda that we had use of all the communal pools and gardens.  I think it is important that all residents are part of the community and contribute accordingly.  Our teenage children will interact with others within the community, use the communal pools and we too hope to make new friends (even if it is by illegal interloping!).  By the way I am glad you find it amusing because Roda have told several villa owners they can use pools on any phases so we might all end up trudging over to yours first!

It is now quite apparent from all of the postings on this subject that there is no easy solution to this issue. There appears to be a consensus that there is no way to police the issue of pool usage and the by laws in which the community charges were laid out make it clear that villas are stand alone properties, the owners of which do not pay community fees, other than for refuse collection, security etc. whether they like it or not.

The sensible approach for you and any other villa owners who are serious in their desire to finally conclude this matter and get proper advice rather than personal opinion is for you to contact the administrators for Phase 1 and 2 and the other comnunities ie info@housingcomunidades.com  

You will get proper advice  rather than conjecture on whether it is a possibility for you to pay community fees to include the costs of pool maintenance in the Phase 3 Apartment community or not as they are the only people who can say whether or not this can happen. The other AGMs will have no bearing whatsoever on Phase 3 so you are most likely going to have to wait until your Communidad is formed to raise this issue for full approval of your community but again the best place for real advice is the administrators and not the forum.

Thanks Ip.  Good advice indeed.  It seems Roda have misled a lot of villa owners before they purchased and my gripe is with them.  However,  it seems to me that if villa owners did contribute to the communal pools and maintenance then everyone would be happy.  I will speak to our Solicitor and get together all our paperwork that confirmed this arrangement.  I have already e-mailed Roda regarding this matter and will do the same to the Administrators.  The fact that there are niggles about this issue now indicates a potential problem brewing which will only get worse.  We do not want our kids to be frog-marched away from the communal pool when we visit - we just want harmony!

Hello Mrs H,

I think we are agreeing about the villa issue regarding the use of pools.

As I said this is not a big issue because there are only 50 villas approx in the whole resort out of 1800 properties.

If they  were to pay  for example in Ph 1 it would it will make a difference of under 2 euros a year per property.

That is why I feel the issue is a waste of time and as we are in a 5 Star resort we should be above fighting about who swims where.

Maybe people who feel that this is a major issue for them are in the wrong resort.
